Credit Card Woes - The Letter

Now that you’ve figured out how to deal with that credit card collector on the phone, expect them to start pushing up the ante. The battle has now been joined, and they’re now ready to unleash one of the most effective weapons in their arsenal, The Demand Letter. Just one of these if received unprepared - especially the first time - is enough to bring a grown man down to his knees in surrender. So let’s gear-up and find out if there’s a reason to fret about this threat.

Most credit card demand letters come in two types.

One is the pretty straight-forward type, specifying how much you owe, a reminder of the contents of the credit agreement, plus a bonus threat regarding what action they’re gonna take against you.

The other kind of letter is more indirect in its approach but nonetheless more potent. It is formatted to look like an official civil/criminal Complaint ready to be filed - or to the impression of some - already filed in the appropriate Trial Court. No wonder people who are uninformed and unfortunate enough to get one of these would seriously contemplate on how much painful it would be if they were to jump off a building.

So before you jump, allow this to sink in: You’re not in trouble, it’s just your impression. So CHILL! (repeat as needed)

Let’s look at excerpts of a sample Credit Card Company Demand for Payment:

Dear {Your Name}:

Our client, {Your Credit Card} has referred to us for appropriate legal action your total unpaid account of {Your Debt Amount} as of {Date} representing purchases and usages made thru your above-stated Card, inclusive of finance and penalty charges, as well as collection fee.

Under the terms and conditions of the Card member’s Agreement,
{they now quote the small print at the back of the credit card agreement you so happily and excitedly signed a couple of months or years ago}

Despite repeated demands, you failed to pay your said account, hence, we are formally serving this DEMAND for you to pay in full your said unpaid account, including all charges within FIVE (5) DAYS from receipt hereof. Otherwise, we would be constrained to CRIMINALLY PROSECUTE YOU for Violation of R.A. 8484 (Defrauding of Creditors) if the evidences warrant and/or CIVILLY CHARGE YOU, for Collection of Sum of Money with Prayer for Attachment, before the (Regional or Metropolitan) Trial Court of {City}, in order that you may be penalized with imprisonment including the recovery of litigation expenses and judicial cost, as applicable, and twenty five (25%) percent attorney’s fees, without further notice and delay.

Please consider this as our LAST and FINAL DEMAND.


Scared you the first time right? Now let’s take it apart!


1.) They’re demanding that you pay in full within 5 days?! - Ridiculous! If you don’t have money, you don’t have to pay. Why? Because you can’t! No need to borrow from anybody. It will just get you deeper into debt.

2.) Their asking you to pay in full the principal plus the charges which continuously accumulates every month! - Again, Ridiculous! You weren’t able to pay last month’s balance so how could you pay for it now when it’s higher than last month’s? I’d love to see them jack it up into the millions and let’s see if they’d be able to collect anything by then.

3.) Criminally prosecute you for Violation of R.A. 8484 – now don’t focus on this sentence, focus on the next – if the evidences warrant. Now that’s a big IF!

- So what kind of evidence would warrant a violation of R.A. 8484? Let us quote:

A cardholder who abandons or surreptitiously leaves the place of employment, business or residence stated in his application or credit card, without informing the credit card company of the place where he could actually be found, if at the time of such abandonment or surreptitious leaving, the outstanding and unpaid balance is past due for at least ninety (90) days and is more than Ten thousand pesos (P10,000.00), shall be prima facie presumed to have used his credit card with intent to defraud.”

Ergo you're off the hook!

Why?

How?

Because you're holding that letter. Which means you could actually be found. And as for you not informing them, - the fact that you're holding that letter is the best evidence that you did inform them, - if you did move. Let them prove otherwise.

- Is that paragraph all that R.A. 8484 contains?

NO - but that paragraph is all that could possibly apply to you! The rest is all about credit cards (and other devices which they call access devices) fraudulently obtained. Like if you used a fictitious name to obtain the card, or you used a stolen card. But if you did all that, I don't think getting a demand letter is what you'd be worried about.

So the fact is, a demand letter works to your advantage. It has your name on it. It says that you were honest and upfront when you obtained that card, but unfortunately you can't afford to pay right now.

If you really had any intent to defraud, do they think you'd be stupid enough to have used your mother's house as the billing address?!

4.) Civilly charge you for Collection of Sum of Money with Prayer for Attachment – They can but they won’t. Why? It would cost them more than the amount you owe. And the most likely result would be a settlement. With you paying maybe less than what they’re asking for. But do you know what’s really stopping them? BAD PUBLICITY.

5.) Consider this as our Last and Final Demand – Well, I have a friend who has a box full of these.

OK! But what should I do when I do get one of these?! – Get a big box.

  1. thanks for giving us hope, btw, m a card holder of 4 big card (i think it will reach to 100-150K if summed up to now) companies but failed to pay them all when i got jobless that was year 2001, but only last march dis year i received a billing from 1 CC and it went real big and i dont have enough money even though im already employed it only covers my daily need, so i realy dont know how i can pay them. but if get some excess i tried to give relief goods or donate to gma foundation instead of paying those cards, which i know that it will be a lot of help to the foundation than to those CC, coz like you said they have these insurance for delinquent card holders.

    i tried to contact them when i get jobless, but failed to get some information on how to pay them.

    what do you think of my way of paying?

    p.s. do you think they forwarded the case to the NBI coz i cant renew my clearance coz when i applied in megamall they said that i should go to the main office because i have "HIT" printed on my clearnce. what should i do?

    You may get statements occasionally. Like christmas cards from long lost friends.
    No harm finding out what your 'HIT' means. But HITS are usually about something like your name being identical to somebody else's.

  3. i saw a post in another link www.gov.ph about her brother in law being sued for estafa after 2years of dodging CCs and wants to pay to clear his conscience..dinampot sya sa office..that was the only thing i have heard of..and i really don't know why it was called estafa when the girl mentioned her brother in law did not issue any check nor sign anything...

  5. ive been wanting to get clearance from NBI but my past credit card due has been stopping me. im afraid that my name would just appear on their record and jail me right away. my past credit card due has been 8 years ago.what can you say about this?
    and can i also apply for a passport even if i have unpaid credit card dues? or open a bank account? would the banks still allow people who did not pay for their credit cards open an account with them?
    pls enlighten me on this. i just have too many fears.

Anyhow, i would just like to post also, what i experience now.Somebody called me,from "atty. benipayo's law ofice" my question is, is it possible that the atty. will direclty talk to you, instead of the agent?are there such as this that happen? and now he is demanding me to pay immediately the sum amount of 33t or else i will face a civil case at makati trial court., how true is this? please i need your opinions.......

    It is possible that the attorney will directly talk to you, but highly improbable. Unless his office is downsizing and can't afford any more staff. If he's not the attorney, then your caller is misrepresenting himself, one more reason not to take him seriously. Anybody can call you and claim to be an attorney.
    As for your next question, I'll ask you one myself. Do you have 33,000.00? If you don't, even if the pope himself calls you, I don't think it would make any difference would it?

    Anyhow, just this morning, they called me again asking me to pay immediately 33t or else they will going to file the case now.

    And another thing that keeps me nervous is that, they told me that they will going to send a letter to the president, stating that they will going to put the company in blacklist., is it possible?
    And also they will going to investigate me and they are asking me to go to manila to attend the court hearing?"weird"

    One thing I offered them, that what i can afford now is 2t and the remaining balance will be paid on a staggard basis, unluckily they refused that offer., why? as per his information the atty. will not accept the said money.

    please help., am quite confused now.,

Beltran filed a civil/criminal case againts u for violating the R.A. 8484 and article 315 of the revised penal code. Be prepared, court order will be serve!     If you work for let's say SM Department store, do you think they'd blacklist that? And besides, even if they blacklist the entire country, I don't think they could make you pay 33,000.00, 'cause you ain't got it. It's just a threat, and a useless threat at that. That agent should resign.

    They just want you to talk to them. But first, they want you scared. Because people who are scared, would agree to anything.
    If they call, talk to them. Tell them what you can afford. If they don't want it, forget it.
    By talking to them, you provide proof that you're not in hiding. By offering terms of payment, you show willingness to pay. So what case are they talking about?

  12. i got a call from a police in makati informing me that an attorney filed a case for RA 8484. I haven't received any demand letter from any law office. The police said they will come to my house and will conduct a preliminary investigation regarding the case filed against me. I have talked to the bank 2wks ago if i can pay them bit by bit. And now i am surprised for the call.
    I called the attorney and he wanted me to pay at least 10k now.
    What should i do?
    Please give advise.

  13. Well, as far as I know, investigations come first, that's why they call it preliminary. A lawyer files a case because he believes he has enough evidence to prove his case. If the lawyer already filed a case, what's there to investigate? And if you violated RA8484, which is a crime, why would the police call you and say they're coming over to your house? To give you enough time to hide incriminating evidence?

    So you see how it works? They say words like; police, lawyer, case, house, investigation, in various combinations and we start getting a heart attack.

    Don't call, let them call you. If they offer you a way out and you like it, fine. If you can't afford it, make a counter offer. If they don't like it, then get on with your life.

  14. good pm...i have the same problem n mejo gipit naku sa pagbabayad ng cc kc nga nagkproblema sa company where i use to work. its been 6 months when tey started calling the landline of my cousin asking me to pay 62k,(thats my accumulated utang with them), but i cant afford to pay it.
    today po, an agent visited our house pero d ako ang humarap kc nattkot ako, sabi daw nila sa pinsan ko, kng d daw ako nkasetle ngayong araw, magpapaunta daw cla ng sheriff dito sa bahay para manghila n lng n gamit na pwede nilang mkuha..
    is that possible po?

  15. Before a sheriff can go and get anything from you, he needs a court order. Something like a Writ of Execution. Which means a case must first be filed against you and 2nd, it means you lost that case.
    That agent is just trying to rattle you up. Next time, go talk to him outside your house. You don't owe him any money so don't be intimidated. He could be very insulting and if so, gently remind him that it's not his money you owe. And while he's doing his thing, keep telling yourself that he's just another poor guy with a bummer for a job.

  16. i have a question...what about the case of Chinatrust bank? I have a personal loan, and due to some unfortunate situations (i was jobless for quite some time), i wasnt able to pay them religiously. The thing is, when the loan was released, they asked me to sign checks which would serve as post-dated payment of the credit. but i don';t have a checking account with them or with any bank. i havent been able to pay them. would i be charged with estafa?

  17. Well, if you signed a check, they can. I think the loan account you availed of also doubles as your personal checking account with a credit line. So any payment you make to that loan account covers the post-dated check issued against that same account.
    It is reassuring though to say that what deters banks from taking you to court is: (1) the time and cost of litigation, (2) income loss due to possible bad publicity even just thru word of mouth which would discourage other prospective loaners out there; - versus the amount of your loan. Of course it's not a guarantee that they won't. If they ever thought of teaching you a lesson... they can. But then again, be cool (especially when agents behave badly) and pay regularly with what you can afford for the time being.

HI, sobra po akong natuwa ng mabasa ko 2ng blog nyo pero i was thinking or should i say nakokonsensya po ako kasi ginamit ko naman po tlga yun card pero but due to some reason wala na sa budget ko po yun pag bayad dahil ang magaling ko pong kuya ako na rin po ang taga bayad ng kanyang utang eh yun po sobrang laki na po tlga ng interest nila gusto ko sila bayaran pero sabi nila nasa law firm na daw...one time po tumawag sila d2 at nanakot...gaano po katagal bago sila mag padala ng DEMAND letter kasi may nkikilala po kame na isang taga law firm na pag may demand letter na raw po ibigay lang sa knila tapos sila na po bahala maki pag aayos parang atty. sa atty. na raw po. pero sobra po akong natatakot

    Thank's for this blog. Actually i 3 credit card's, before kase im working as Accounting Officer, so kaya ko pa xang i handle, but because im the bread winner of the family, yung hsbc ko nabayaran ko pa xa, then may isang tumawag sakin nag aalok citibank pinilit nya ko...even my union bank, para kaseng since they have the details from my account to hsbc, nakakagawa sila ng application, and i sign it nman coz im not expecting na maaaprove, honestly nagamit ko naman xa, but after i used it, yung citibank and Union ko never ko ng nabayaran kahit isa, because lumaki yung tuition ng sister ko and natanggal ako sa dati kong pinagtatrabahuhan. I already received a demad letter from the tree CC...for my 3 cards, before kase hindi ako nakakapag communicate sa kanila, becuse im so busy looking for my new job, tapos before, kung iba-iba ng statement nasasabi ko coz nananakot nga sila....wala akong magawa kase wala akong pera talaga...now i receive for one CC ng CIVIL/CRIMINAL CASE FOR SUM OF MONEY / R.A 8484 daw. tumawag naman ako...and i'll give them my new number..na stress kase ako kaya i change my number...pero ngayon willing naman ako makapag bayad...but hinihingan nila ako ng 10,000.00 until today, but i only have 3,000.00 i am willing to pay naman this. Okay naman yun diba, hulughulugan ko xa, kahit maliit na amount lang basta mabayaran ko lang sila? Wait ko po Answer nyo?? natatakot po kase ako, infairness effective yung mga ginagawa nila. May dapat ba ko ikatakot??hehehe tnx po

  21. If you read all of the comments / letters above, you'll see that your case is really no different.
    Don't force yourself to come up with "10,000.00 until today" or whatever amount they decide on, especially if you really don't have that kind of money. Just tell them what you can afford. They can take it or leave it.
    Don't sign payment terms which you think you cannot sustain in the long run just to stop them from harassing you.
    Their tactics are effective and these are meant to scare you. But hard as it may be, relax. Don't be afraid.

    Well thanks for the advices. I have one question though, does the collection agency have the right to call our company office? I was approached by one of our HR personnel and was told that someone from a collectoon agency called them and was looking for me. I stopped paying my card because they're not sending me my monthly bill plus the collection agency and the bank itself has different amount that I should be paying them. Well, what the HELL that's the time I stopped paying them which was last month. they never even sent me my SOA. Now, those idiots from the collecion agency are sending me SMS saying that they already filed a case against me for violating RA 8484. LOL! I would be very glad to receive their demand letters!

  23. The collection agency can call your company office or anybody. I suggest you tell HR, your officemates or whoever you think might receive the call that you are expecting calls or even visits from collecting agents. In this way, you save yourself from embarrassing situations which the collecting agency wish you to experience. Answer the calls personally if you can. They may sound angry, but that's all.

    I am really glad a friend mentioned this site to me...I would like to share something. I had credits cards a couple of years back..and I am paying religiously. other time I payed less than the mim pay they required ...it happens right..? so got mad when a girl asked me if I read my bill and if I was aware of the amount indicated in it??? like I was some idiot not knowing my abc!.....most of the collection agency used other means just to collect..like they will tell you their from government offices! more so...one agancy even used a cargo company informing that a package was sent for us..??? how to we deal with this..? thanks in advance...!

  28. Hi! really this site is very informative. Thanks to a friend telling me about this blog. I have a lot a credit cards, but can only settle the minimum due, it seems that i've been paying the interest alone but the outstanding amount continous. I have this one credit card Standard Chartered, they stop renewing my cc maybe base on my capacity to pay they opted not to renew anymore. I called the bank they responded that my cc was already cancelled. Until now I still continue paying the minimum amount. But now I decided not to settle anymore due to some financial reasons. Do they have the right to file a case against me if worse comes to worst now that the cc is not activated anymore?

    i am planning to go to my CC bank to negotiate on how i can settle my debt of 88K. I want to pay it without any interest increasing ... fixed in a period of time. like 3 years. is that possible? how can i do the negotiations successfully? and if they do not agree with my capacity to pay, what should i do? I really wanna close my acct already. Dont want interests anymore. HELp pls. thanks!

  31. Yes you can go to your CC Bank to negotiate. But first, try to email their customer service first to get a feel on what policies they have with regards to accounts like yours. You can use an anonymous email account if your not comfortable revealing your identity yet.

    If you think they already have forwarded debt collection to a collection agency, then I suggest you just wait for their call and offer them what you've got. If they don't want it, wait for their next call.
    If you want to stop paying high interests, the best thing you could do is:

    1. Stop using your credit card.
    2. Take out a loan with a lower interest rate than the one your credit card charges and which has a monthly payment you can really afford. The SSS Salary Loan is a good example. Then use the proceeds from this loan to pay off your credit card balance.

    In this way, you avoid paying your credit card's monthly interest which is really too high, and also avoid having to negotiate with the bank.

    my question is:
    (1) I have a personal loan with HSBC and BDO. Before the loan was released, they require me to issue post dated checks, but i told them i dont have a checking account.
    So HSBC just asked me to sign a promissory note stating the amount in which i need to pay every month. while BDO asked me to open a savings account wherein they would automatically deduct my monthly dues. Can they file ESTAFA againts me because of that promissory note?

    Please give me advise...

  34. Banks never offer loans just because they simply trust that you would pay. They GUARANTEE that you would pay. One way or another. They do this by asking you to sign documents (post dated checks, promissory notes, etc.) that can be used in court to demand payment from you. So be it credit cards or other loan instruments, the bank's strategy always apply. (Take note, it's not my or your strategy.) The banks CAN demand payment from you IN COURT. But banks are undeniably motivated by profit. Therefore, if the amount you owe is not worth it to take you to court, they most likely won't. But it's not a guarantee.
    So, what now, when you got this loan you REALLY cannot pay for? Is there Hope?
    Of course. Read the stories above. You are not alone. If your loan is 50,000. There's somebody who owes 600,000. The important thing is, we get on with our lives. You and your family comes first. Life is good. And it's short. Your loan is just a part of it.

    i just received a "Formal Demand for Payment" Letter from this law firm. It was stated there that i need to pay amounting to 65K within 5 days. i dont have money to pay right now because i was jobless for almost 7 months now.
    the moment i hold that letter it really scares me.
    what if ituloy nila and demanda sakin? i couldn't pay for my balance. lalo na kong wala ibabayad sa LAWYER.

    how will i know if naka file na yung case sa court?
    papadalan ba ko ng subpoena?

    If they decide to file a case, they can.

    If they filed a case, they will send you a subpoena.

    They might call, visit, or write you more scary letters.

    You can worry about all these things over and over again. You may even lose sleep over it. But all that worrying won't add one peso to your purse.

    Not having money is actually liberating. You don't have to make up an excuse.

    So here's what you do..

    1.Stop worrying.
    2.Don't be afraid.
    3.Relax.
    4.See a movie.
    5.Find a job.

  38. hello argus gud pm.. i was searching for the content of RA 8484 when i bumped to this site meron kc ako na-receive na txt earlier from 1 of my cc stating that my acct is scheduled for case filing today with the grounds of credit abandonment under RA 8484. Actually, i have 4 cc na may past due, nung una maayos ko naman sila nababayaran so walang problema kya lng recently ngkaroon ng financial crisis & health problems so most of the time di ako nkakapasok sa work at hndi ko na rin nbabayaran ung card ko kc short lagi budget ko. Out of that 4 cc, 3 ung naka restructured payment kc nga meron sila promo that time & they offered me that para fix na ung babayaran ko monthly & mas magaang ang pgbabayad ko kc 2yrs nman ang term so i grabbed their offer kaso un nga ngkasunod-sunod ang problem. Question ko pwde ba sila mag file ng case against me under that grounds? Kc pg nag apply ng restructured payment meron pinipirmahan na document. Tnx hope u could reply soon. -mitch

    Check out my reply to Mr. Debtor's Nov. 14, 2008 letter. Bank's always have that option which is to demand payment from you in court. Of course it's a long process and they seldom do it, also partly because they have insured themselves against loss. Part of your payment goes to credit insurance. And that should be your strategy too. To take care of yourself first. So, your priority would be to:
    1) Ensure that you take care of your health problems. (No health, no wealth.)

    No, I don't think your case could be considered criminal.
    It is criminal if there is an intent to defraud.
    Ex., You used a fake name, address, or you maxed the card and you suddenly disappear.
    And you got a text right? That text means you can still be contacted, which means you're not in hiding, which means you have no intent to defraud.
    So, be very happy when they call, text, write or visit.
    Just make sure you don't agree to anything you can't afford. Like sign post-dated checks.

  42. nice blog for people having a problem with their cc like me...im really glad that i have found your site in the internet when i searched what is r.a.8484, i looked for it when i received a text message telling me that they will file that case against me and they will post my picture in the newspaper if i will not settle my account on that day they have texted me, is it possible that they can post my picture?...yes, im one of the many people out there having the same problem about cc...im out of the phils. now, before i have 4 cc and im really a good payer then and before i left the country, i settled and closed my 3 cc, i just have 1 cc now and that is bdo, i did not settle that because im not the one who used that, when i was still in the phils, my friends asked some help from me using my cc, and i trusted them,and they are paying every month but before i leave i asked them to settle and pay everything in my cc so that i could close it already but they asked me again that they will just pay it monthly until it is fully paid because they dont have enough money yet to pay it all so again i trusted them until i received that text message and now i also have those demand letters and phone calls in our house which my mother is the one who receive those phone calls because im not there anymore and it really threatened my mother every time she answers the phone and now those friends of mine are gone and i couldnt contact them anymore, my mistake,i shouldnt have trusted them...i know that my case is just a civil case and i wont be in jail because of that, isnt it? but my problem is im already married and my husband doesnt know anything about that problem of mine and im here in the u.s.a. and we are applying for a green card, my question is does it could affect our application? i will really appreciate and be thankful if you could help me in this matter...

    It's unlikely they will post your picture. If they do that, newspapers will be thicker than encyclopedias. 2nd, would anybody want a credit card from a bank/institution that does that?

    Reassure your mom that those threats are unlikely to happen.

    You won't be jailed.

    It won't affect your green card application.

    It's your marriage you should worry about if you can't tell your husband about it. (For richer or poorer...) ;)

    nakatanggap ako ng demand letter galing sa isang collecting agency (Law Firm)
    and they asked me to pay my credit card balance in full which cost about 21K on or before Nov. 26.
    i called them up para pag-usapan kung possible ang settlement.
    they told me na kung mababayaran ko yung 5 thousand pesos before dec. 5
    mabibigyan nila ko ng discount ng 5 thousand and the rest of the balance
    pwede ko bayaran ng 11 months without interest.
    na ang naging computation is like this:

    21,000.00 Total Credit Card Balance
    5,000.00 Initial Payment
    5,000.00 Discount (given by the Law Firm)
    ========
    11,000.00 Remaining Credit Card Balance (payable in 11 months)

    1,000.00 Monthly due for 11 months

    Is this really possible?
    nagbibigay ba sil talaga ng discount...
    kung sa law firm ba ko makikipag-settle and mabayaran ko yung balance ko
    minus the discount na binigay sakin ng law firm.
    ma-clo-closed na rin yung utang ko sa Citibank?
    or kailangan ko pa tawagan ang citibank at sabihin sa kanila na nakipag close ako ng deal sa law firm nila.

    i'm willing to pay 1K a month for 11 months..
    for me affordable na sakin yung payment suggestion ng law firm
    i just want to know if tama na sa kanila ko mkipag settle.
    kasi citibank kausap ko, di sila nag bibigay ng discount.

    Sorry for the late reply.
    If you think it's a deal you can afford to pay, then it's ok.
    Just make sure, everything's in writing including the terms on the discount and remaining balance before you give your initial payment.
    You can verify with Citibank regarding the status of your balance and the authorized collecting agency.
    Also if you complete your payment, request for a document certifying that you have already paid everything.
    Don't worry about the Dec. 5 deadline. You can still re-negotiate.

    No need to panic if they say they will visit. They just want to embarass you into paying. So better if you tell your officemates beforehand. Maybe even instruct the guard to not let anybody from any collection agency to get in. It's also better if you talk to them (outside that is) just don't sign anything that you can't afford.
    Some collecting agents really enjoy doing those nasty things. Imagine the fun you'd have getting paid to say those things to strangers and getting away with it. It's like when we were kids and we go jam other people's doorbells with masking tape then running away just to watch them go out and scratch their heads in frustration.

    Relax. No need to write a letter.

    I got the same demand letter from Domingo and Moaer law office, abt my cc debt which i failed to pay.

    what is rediculious is thye are asking me to settle the amount of 33k IN % DAYSs HAHAHA and i owe 49k. i originally owe 26k only.

    i also knew no one goes to jail for a cc debt and after reading this blog i was enlightened as well.

    I am a collection specialist also working for a call center and we collect for a big internation company. we call American cartd holders and as agents we do follow certain laws and have ethics. failure to follow these rules might end up carholders suing the creditor for harassment. but i know for the fact they dont go to jail if the failed to pay the debt. it is just that theyr credit rating wll be ruined which will be a big factor.

    now here in thew PI its diff. cc company sell the accounts to agencies and these agencies intend to harass and visit yourt home or office. i told my brotyher and parents that these letters are from agencies only.they didnt know that.

    i have friend who is a manager of these agencies ansd told us they are pretending to be as lawyers etc..

    I recevied a text today stating
    "Dis is Mr. Medico legal COUNCEL ng "bank" regarding ur account. Anung plano m ito? kasi nasa legal na ung account. Actually ngpunta ng tauhan mamin jan para magkaron ng AMIGABALL setlement". check the spelling , and whou would beleive a lawyer would compose such text emssage he doesnt even know how to spell correctly. HAHAHA!

    I replied that I wasnt applying for a visa, di ako mag abroad. LOL

    I have no intentions in paying that agency. if i will pay out of good faith I will call the bank not them.

    Ag is right Estafa is only for bounced checks only.

    anyway just wanna share my experience, only downside of these is these agancies will harass you till you surrender.

    i am in the same predicament, well after reading blogs 'bout cc issues.. it gave me hope and relief to have a good sleep then..

    i just don't loss hope.. things will be better off someday.. just working hard for now, though i may not be able to pay them for now... i just let them know i my intentions...

    well, its up for them to believe it or not, sad to say they never believe me!

    Thanks AG! for posting this blog! its helpful! but my case is very different hope you can help me.

    i was been retrench last January, then that branch of my company closes. since then i cannot pay my cc anymore, because i don't have job up to now. i am 2mos (60days) delayed 60k, January and February, i made last payment pa last December. Do i need to inform them formally about my status? Actually they can't reach me because the that branch was close and the phone there is no longer use and my cellphone as well. I also leave the house where i am living because i am just renting there which is the address in my cc application. so basically right now, there is no call nor letters i receive. im afraid they will charge me with :

    A cardholder who abandons or surreptitiously leaves the place of employment, business or residence stated in his application or credit card, without informing the credit card company of the place where he could actually be found, if at the time of such abandonment or surreptitious leaving, the outstanding and unpaid balance is past due for at least ninety (90) days and is more than Ten thousand pesos (P10,000.00), shall be prima facie presumed to have used his credit card with intent to defraud. (Ra 8484 Sec 14)

    What should i do now?
    im afraid that if will call them and update my status now they will just harass me and threat me! anyway i think ma account is still in the bank...
    What is best thing i can do for now?

    No harm in informing them about a change in address. But even if you don't they will still find you. It's not that hard, they can just check SSS to find out who your latest employer is. And there are many other ways to find you. And based on friends' experiences, you still get that letter one way or the other.

Thans for the info, please help me what i can do, i have my personal loan year 2005 which my co maker was my previous employer.Payment for the said loan was salary deduction, i pay it from may to october 2005 then i resigned, my previous employer did not give my final pay i expect that they pay it to my loan. but today im scared because i received a notice of criminal and civil complaint.my loan was 88k whereas it was only 30k last 2005. i know becoz of interest. what can i do to this letter of criminal and civil complaint.i have no work because i just lay off and on going pregnant...please advise..do i call them...thanks...scary

  58. Hi there, this is the very first time that I would post my problem at a website. Hope you could help me on this. I left the country in 2005 and had been sending payments from 2005 to 2008. I stopped sending remittance around November because based on my records, I am already fully paid. However, my cousin, whom I entrusted the monthly remittances to, screwed me up. She did not remit some of the payments and worse, she maxed out all my credit cards. Now, I am so much indebted as a consequence. I know it was so stupid of me but its there already so I just have to move forward and address the problem. I have received at my residence in the Phils demand letters from various credit card companies (4 of them). One has mentioned about RA8484. Can I fall under the ground of "not informing the credit card company of my new residence and so they its a prima facie evidence that I had the intent to defraud the company"? For one, there were payments received by the CC companies for 4 long years despite my physical presence in the country. So to me, that proves to show that I did not have the intent to defraud them. Second, the address in their records is still my residence in the phils. I did not think that they would send the monthly bills abroad. It was only recently that I found out about all these fraudulent activities my cousin committed against me when she left the house early part of this year. The letters came which my sister obtained and forwarded me the details. Pls. someone help me and give me advice. I am so much anxious and so confused as to where to get the money to pay the huge amount of debt that my cousin incurred. I tried to negotiate with them thru email but so far no luck, they would not agree with the amount that I can give them. Pls. help me......pls? Hope to get a response from you.     No, you will not "fall under the ground of 'not informing the credit card company of'" your new residence as it is still your valid billing address.

    Be realistic.

    Settle 1 card at a time. But don't get too excited to pay. Wait or negotiate for a good deal like them waiving off finance charges and incurred interest.

    For the rest of your cards, just tell everybody staying in the house to be ready to receive calls, letters, visits etc. The agents might employ scare tactics. So reassure your housemates that everything's ok.

    While waiting for that good deal, just use the time to set aside money. Maybe open an account where you put your future 'monthly payments' to them. If they eventually forget about you, then you end up with all these piles of cash! Hahaha.

    Don't let your anxiety lead you into agreeing to terms of payments you cannot sustain. You'll be in deeper trouble.

    It's ok. Relax.

The other one, with the help of a very nice lady from the collecting agency is pushing an amount of 35% of the total amount to fully settle the amount.   61. Hello Mr. AG! Your blog is such a relief and I just want to say that you are indeed a blessing to all who encounters various problems with their credit cards. It's so liberating to know that there are good souls like you who go out of their way to help people like us... Anyway, I would like to share my own piece of experience. I'm still going through the same problems and dilemma just like the rest who posted their queries & bad experiences from collection agencies. I was able to settle 1 credit card about 2 months ago when I requested the bank president for consideration since I can only pay half of my outstanding balance. A few calls and emails finally paid off, when I got my certificate of full payment from the bank itself. At last, I have peace of mind so one down, one more to go... I made the same move with my other credit card; I emailed the bank president and requested the same consideration of paying only 50% of my total outstanding balance which I can really afford to pay. The following day I received a call from the bank's credit collection department and said that Mr. Bank President forwarded my email to them and approved my request, but then they needed to discuss with me the terms of payments. To cut it short, the said department was not amenable with my 50% one-time payment because it's contrary to their policies, etc. As I was in the midst of discussion on the several options being presented to me, I was also being harassed through text msgs regarding my unpaid account. I was clueless who were sending those text messages because my communication with the bank was in a congenial atmosphere. Apparently, I emailed the bank president again and wrote in the letter the actual harassment text messages sent to me by this "group." I even sent an email copy to BSP, after which BSP replied that they have forwarded my concerns to the Bank's president and requesting him to explain the matter to me within 10 days, copy furnished to BSP. But I received no explanation at all. The phonecalls, text messages, & emails stopped all of a sudden. However, I started receiving text messages, phonecalls and demand letters a few weeks ago regarding my still unpaid account with this bank. So when I got the chance to talk with this "agent" I told her that since I'm still waiting for the bank officer's response pending my final offer to settle, thus they alone that I want to discuss this matter with and foremost I would need the bank's approval in writing prior such payments (actually, I'm incapable of making any settlement at present because our family's daily needs and our kids' matriculation comes first). The "agent" said she'd call from time to time should the bank and myself have finally reached a settlement amount.

    Pasensya ka na Mr. AG for the long novela, just want to know your comment/s lang po if I did the right thing. Further, I would just like to ask a few questions: 1. Do I have a strong point against the collection agency when I told them that I'm still waiting for the bank's response regarding my request (based on my capacity to pay 50% only "at that time") since I consider it as "pending" to-date? 2. Since it was already endorsed to 2 collection agencies, does that mean my outstanding balance could have been written off by the bank? 3. In the event that the collection agency would contact me again, can I still give the same reason till they get tired of following up? Because like I said, at this point I'm incapable to pay/settle since I'm prioritizing my family and kids' needs first as school's opening nears. Hope you can enlighten me Mr. AG so I could regain my peace of mind and save myself from a lot of stress eventually.

I had 2 credit cards at HSBC year 2006. I paid my red master card for almost 10 month from the start i used it. But the other one I never pay because when i start using my second card i don't have job anymore. ALam kong mali pero wala akong magagawa kasi wala akong pambayad. Until I Received calls and demand letters from Molaer.They did stopped then this year 2009 they start again writing me. but didn't received call or text. One thing make me worry is, start 2007 palipat lipat po ako ng bahay not because nagtatago ako sa kanila or no intention to pay.I never inform them of my address. Kasi palipat lipat po ako. Pero dun po sa dineclare kong address sa company card dun pa rin nakatira and family ng kuya ko so sila ang nakakatanggap ng mga demand letters at halos araw araw din po ako pumupunta dun.So pag may letter po ako galing sa Law firm binibgay nila agad sa akin. And the reason why hindi ako nagchachanged adress is because andun p nmn nakatira ang family ng kuya ko at ung tito ko n matagal din tumira dun more almost 14 years at
    last august 2008 lumipat n sa province so ang andun n lang ang pamilya ng kuya ko.
    May questions are:
    1. Makakasuhan po ba ako ng fraud because of abandonement without informing them my new address?though i got their letters, i have some here but i threw others already.
    2. Ever since they started sending me demand letters year 2007 i never communicate with them.kasi nakakatakot sila.BUt i have no intention to run my obligation.I am willing to pay as long as i get a job.So wala talaga akong pambayad kaya hindi ako nakikipag usap muna? Tama po ba yun?

    1. Yes, they can file a case against you for abandonement. But then again, they'd lose money with your case.

    2. It's better if you can communicate when they reach you like on the phone. But if they become rude, don't get affected. The one being rude is not the one you owe money to. He's acting. So just ignore.

    3. They can find out if you have an account. But to know the details or to freeze that account requires a court order.

    I would like to inform you that there's a new way for collection agencies/law firm in demanding payment for delinquent CC holders.


    I used to have a Standard Chartered CC but i have some problems with them with regards to questionable interests on my account since they cannot explain it to me as well as the agents are very rude, i decided not to pay anymore. For the last 3 years, the collection agency never called me in the office nor in my residence about my delinquent account but I occasionally received a letter from them which I totally ignore.

    These past few days, i received a text message from the MOLAER LAW office about my SCB account. They were trying to convince me to call them and settle my account which I refuse to since I don't have the capacity to pay them at the moment and I'm also thinking that the best way for me to settle my account is to settle it directly to the bank.

    In this way of communicating with the account holders by the agency or to put it bluntly a new way of harassing the account holders, what would be the best way to handle this type of situation?

    Ignore the text message even though they are asking if you are the person they are looking for?

    Whether by text or call, don't be hesitant to make a reply or answer the call. Anyway if they become rude, you can always hang-up or ignore the text. Also, if you can't afford what they're asking, even if they call you 50 times a day, nothing's changed. As long as they pay for the call, I guess it's ok. I also heard some of them agents are pretty ladies. ;)

    i just would like to share with you my experience lately.

    after a few years I defaulted my Standard Chartered Credit Card, the Collection Agency is starting to call me back again and asking me to pay for my account.

    What they do is that they will text you first and ask you if your Mr Juan de la Cruz. I noticed that if send them a reply asking them who they are, they keep on asking if I'm the person who they are looking for and then demanded me to pay for the account so what I did is I Ignore.

    then after a few days, I received a call from somebody asking me if I'm Mr. Juan de la Cruz. I asked the caller who he was but kept repeating if I'm Juan de la cruz so I told him why he is looking for that person until I get irritated coz he did not state his name and the company he is working for so what I did was I raised my voice and told him that i am not the person that he is looking for and not to call me again if they don't reveal their identity and I dropped the phone.

    Did i make the right action for not answering the collector who keep asking me if I'm the person he is looking for?

    i have a query.

    My mother is always furios when she is receiving calls from various collection agencies pretending to be a lawyer of a certain firm, an NBI agent or anyone whatsoever. I can really see the trauma this has bought to her. Is it possible we can use it to her advantage inorder for them to stop calling her in the office or her cellphone. There was one time when the caller cursed everyone in their office. It's really hard since they have been told to only call during non business hours. But still insists on bugging her. Can we tell those low lives to "take us off their list" or "we don't accept these type of calls" or even press charges due to harrassment over the phone causing trauma?

    Please help us out.

    So, they still do it.
    Tell your mom to answer the call whenever possible and just stay calm. She doesn't even have to say anything. What the agent wants is to get a negative reaction from you so don't give them the pleasure.

    Don't worry it will stop.

    Or, you can file a complaint with BSP.

    Section 36 of R.A. No 7653 is applicable against unfair collection practices of subsidiary/affiliated credit card companies, collection agencies, and legal counsels, and may serve as basis for criminal sanctions that the BSP may file.

    I have an outstanding balance from HSBC. arount 120T. 2 mos pa lang ako delay of paymet kasi im having ha hard time financially. I think I really cant pay the minimun anymore tapos tumataas pa dahil sa interest. I called HSBC and asked kung ano pwede nila ma offer saken. Sabi ng kausap ko Amnesty program daw. I will have to pay around 6T every month fixed sa loob ng 24 mos. I told them i cant commit to 6T. kaya ko lang mga 3T per month. I'm willing to pay kaya lang hindi ko kaya malaki. what should I do. Sinabi ko na sa HSBC na di ko kaya yung 6T. pag isipan ko daw. Please help - mathilda14

    If you can't keep up with your increasing interest balance anymore, it's better to just wait for an amnesty offer. Just make sure you set aside that 3,000 monthly you say you have (preferably in time deposit so you won't get tempted to touch it). So when the time comes, you can use it to pay off the amnesty in cash. A good amnesty offer often means 50% or more off your balance and without the interest they've been piling up on it.
    So save 3k for 20 months then go grab that amnesty and you're debt free.
    But while you're still saving money, expect and prepare yourself, your family, your co-workers for collection agents' stressful calls, letters, visits etc in the coming months.

    i got a Notice of Final Demand for Payment from ENI Corporation regarding my Personal Loan with HSBC amounting to 89K.

    This is what the letter says:

    Due to your refusal to honor repeated demands to pay your obligation to HSBC we have been directed by our client to take appropriate action to finally resolve the case by way of out of court or by COURTH ACTION. We are therefore giving you 5 days from reciept hereof to directly settle the obligation to our client otherwise you will go through the trouble of defending a collection suit agaisnt you.
    THIS IS OUR FINAL DEMAND BEFORE THE FILING OF THE COLLECTION SUIT AGAINST YOU.

    A court order is still required before a bank can do anything with any client's bank account. In your case, the account could be frozen until the court is able to assign the rights to the legal heirs.

    That is true, but don't make it sound like people who have credit card debt don't want to pay. Maybe they just can't.
    You can't squeeze juice out of a dry lemon. And downright rude collection practices won't get us anywhere either.
    Consideration here is key. When banks run into trouble they go crawling to the government for help and they get bail-out money.

    But who bails out your average credit card user?

    Wondering if you can help me as I have been having slepless nights!
    I was in the UK 2002-2003. In 2003 the bank gave me a cc thats max was GBP2000 (HSBC). I left in Sept 2003 and didnt pay it (stupid I know!) and went back home. I have not been contacted once, and kinda 'forgot about it'. My problem is that I am now applying for permanent residency in Austrlia and need a police clearance certificate. I applied for one for my husband and I, he recieved his a week ago, and I am still waiting... Basically, will this be seen on your criminal record?? I would hate for this to effect my residency, as i know (apart from this) my record is TOTALLY clean- havent even had a speading fine! I am now 7 months pregnant and have a 2 year old, there is no way that I can repay this at the moment (I dont even work!)
    Am I stressing unneccessarily? Or can this be seen as fraud and thus a criminal case and appear on the certificate?

    They can foreclose your property if you're not making any mortgage payments for that property.
    Now, if your question is, can they sequester your property and use it to settle credit card debt, then they can, if they file a case against you and they win and they get a court order to do so.
    Is there a possibility that they will do such an action?
    Yes, if the amount is substantial enough to merit such an action.
    Will they find out that you have properties?
    In this computerized age and time, of course.
    For how long will they give threats?
    How long would you be interested to collect if somebody owes you money?

    It will not be a ground to sequester the property.
    For them to win, a case would have to be filed, and you have been deemed to have been legally informed about the said case, and the court rules in their favor. Your presence is not required.

    True, that a credit card debt is a type of unsecured loan, but what I actually meant was; If the case was decided in favor of the debtor, the court may order garnishment, attachment, or levy any property of the defendant, real or personal to settle the demand.
    That is actually what the statement "...CIVILLY CHARGE YOU, for Collection of Sum of Money with Prayer for Attachment..." in your standard Demand Letter is for.

  90. Dear AG, thanks for the clarification. But do not the rules of court say that the primary residence of the obligor is exempted from the assets that can be seized ?( why, even law books of learned judges, may not be seized on the ground that these are the obligor's tools of trade)


    I have another question. In my case, the court has already ruled in favor of the card company, that is, there is a court order.

    however, i continue to get monthly statements from the card co. Do my obligations continue, with the 3.5 % monthly penalty even after the court ruling? Will there be no end to this?

    My understanding is that what the court determined to be the rightful amount should be the final figure, plus legal interest of 12% pa, and that the amount could balloon at this rate.

    Or this monthly statement merely the mindless generation of a computer?

    It would just then have to be another property of yours if you have more. But then again, this article is not for one that has all that much.

    If you're getting monthly statements; could be that your card/account is still active.

    The court ruled over an amount you owe 'as of' a particular point in time which was the subject of the demand. "~ Our client, {Your Credit Card} has referred to us for appropriate legal action your total unpaid account of {xx,xxx.xx} as of {mm/dd/yyyy} representing ..."
    So your monthly statements now reflect those that were not covered (transactions made after that date).

    I think we'd all really like to learn more about the circumstances of your case/experience. Maybe you could write an article about it. This could be of great service to others and more than I could share.

    If they filed a complaint/case, then what's the case number? If there's a case number, then the court itself will inform you via a subpoena. And also, where's your copy of the complaint?

    If you're not in possession of any kind of document which has information in it which you can verify against, then I think its all just an act of harrassment.

    In your case, you will be informed / summoned thru a subpoena to respond to the criminal complaint filed against you. They could get a warrant if they can justify this with a judge. Maybe because you've been ignoring the subpoena. But in your case as you described it, for less than 100k, to find probable cause to get you arrested by surprise would be well, incredible.

    If you don't have money, then just tell them that. If the guy gets mad, stay calm, let him lose steam, as he just lost his commission.

    If I were you, I'd worry more about getting a job

    Not being able to pay does not necessarily mean you commit estafa.

    I have a huge problem. I have an unsettled CC debt from Citibank since 2005. the collection agencies,law firms keeps on sending demand letters and calling my parents which really scares them. the address that I put for my billing was from my parents since I was still single then. now that Im already married and living with my family in a rented house. will I be possibly charge of Article 8484 section 14 due to my change of address without informing them. and keeps on ignoring them? It's not that I don't want to pay my CC but my Job is very unstable and my salary is just enough for my family needs. My parents received a demand letter this early january and the letter had stated that they will file a case against me if im not going to cooperate with them. there is also a stamp "for Case Filing" in it. Is it ok if I call them and tell them that i'm the card holder's brother and tell them that the card holder is already dead for them to stop bothering me anymore? Hope you can enlighten me......

    Thank you for this information. It really helped me a lot. Previously, I ignored all unknown numbers calling my cellphone (specially those 090888+++ numbers). But right now, I am ready to answer their calls and give them my real reason of not being able to pay my cc bills - not having enough money as of the moment. If they become rude, that won't scare me anymore. The best thing that they can do is to offer some help and solutions that would work for both of us.

    I just want to share to the rest of the readers my case.. I have two CC - one from BPI and one from SCB. Its been about 5 years that I have kept both cards updated. But due to recent financial problems, I wasnt able to faithfully pay my monthly bills. I stopped using my credit cards and from time to time whenever I have extra money, I was able to pay the minimum amount they specified, until it came to a point, I cannot pay both cards at the same time. So, I have to choose one.

    I have chosen to pay my BPI card over my SCB card, mainly because our salary account is also with BPI (fear that they will debit from it), then I also have a car loan under BPI. I worry that they would hold my car's documents in the future even if I settled this car loan. Right now, I am receiving demand letters from ADA law office (with regards to my SCB CC account) and calls to my cellphone are almost 3x a day, which I ignore. Temporarily, I try to maintain my BPI account so I still have one credit card line and I know I will not be able to apply to any other bank (I dont have plans anymore to get a new one - I learned my lesson). Though I haven't paid my outstanding balance in BPI in full, I have brought down my total outstanding balance to less than 50% of my credit limit. If I purchased using my CC, I immediately pay the next day and if I plan to buy something big, I make sure I make online payments ahead before I purchase. This is to make sure I don't buy something that I cannot pay.

    my sister died last year, leaving a time deposit with a bank. i looked into the bank's indemnity doc and found out the bank can pay money from the deposit to any of its branches, and even a to its credit card subsidiary.

    does the credit card agreement typically stipulate that the bank ( which owns the card company)
    can use the card holder's deposit to answer for the cardholder's debt?



    my understanding has always
    been that death extinguishes a clean loan, such as that owed to a credit card company.

    I am sorry to hear of your loss.

    Some banks / card companies do have that kind of stipulation wherein they could use a person's holdings with the bank to settle the debt. This and other stipulations which may include "upon death" clauses can be found in the Terms and Conditions attached with a brand new credit card.

    Death does not automatically extinguish a person's obligations. But "clean" loans are normally the last to get settled if there are any leftovers from the deceased person's estate which on average there are none. Which perpetuates the idea that with death comes respite from earthly concerns. For the poor maybe but if you've got a pile left behind, nope, you even owe the government taxes.

    All of these questions actually are dependent a lot on the size of your sister's estate. If it is considerable, you may need to consult a lawyer.

    Funeral expenses, hospital bills and medical care usually are first priority. Then secured debt, and last are the unsecured obligations. After that, the government by way of estate tax.

    Only after all of the above are settled can heirs inherit what is leftover.

    Note though that creditors of unsecured debt need to file a claim - in the court which handles the estate - for them to be acknowledged and get paid out of the estate. And there's a time limit (1 year?) for filing.

    Under no circumstances does one inherit debt, unless you are a co-signee of that debt. Everything must be paid out of the estate of the deceased. So only when there is no estate to speak of can we say that debt dies with death.

    The nature of your reimbursements do take priority, meaning - if the 130k were actually jewelry pieces valued as such when sold, you get paid from the proceeds from the first one sold. The rest of the creditors would have to wait and at a loss if the other pieces are not realized at the valued price. But proper settlement of all these depend on having a legally designated administrator of the estate, or if there was a will, the executor. I'm guessing you have neither.

    Yes, if there was a legal administrator or executor for the estate. All known assets and obligations are collated, creditors notified, and notices are also published in newspapers. Any other claim for settling of obligations made beyond the alloted time are forever dismissed.

    Terms and Conditions always apply. And they are often printed very small so we hardly take a look. But if you read these carefully, you'll see that what you're really signing off are actually waivers and power of attorney privileges.

    These clauses, waivers, power of attorney privileges are included in the Time Deposit and / or the Credit Card documents your sister signed; and these clauses can be exercised.

    But these can also be contested and recovered even if already exercised because the law acknowledges that there are always presumably other legitimate claimants to these assets. And the court (as estate administrator) decides how much each one gets paid; proportionate - if the estate is not enough, or in full (100%) if estate is sufficient to pay all creditors.

    So if your sister owes more than her estate is worth, and your "reimbursement" claim represents 50% of her total liabilities, then legitimizing your claim would net you 50% of the 130k. The rest is for the rest of her other obligations.

    I hope you have the time to read this long comment, I just want you you to know my current status so you may give me an honest and practical advice. I have been having some sleepless nights about my credit card debts and citifinancial loans. I have always been a good payer , but since I had my second child, I cannot afford anymore to pay all of them.

    1. I had a Citigold visa card with a relevant amount as credit limit. I stopped paying it, and the last amout due was only 46K, but it has now grown to 145K.
    2. Since, like I said, I really was a diligent payer, and my citigold visa has been utilized to the max always because i use it for travelling and business purposes because my previous company, reimbuses all business related expenses. In line with that, they have called and offered me to avail of their Citifinancial Personal loan. I applied for that I was eventually approved. 70k was the approved amount and I was supposed to give them 24pcs of pdc,for a 2 year term) but i only had 10 left then, so the last check had a lump sum of php 68k i think for the remaining balance. ( aplogies for the figures,i really could not remember anymore) The last payment came and they called me up to confirm if they can submit the check to UCPB. I stopped them from doing so,beacuse i do not have such money in the bank and then I paid the usual monthly installment amount through BDO. I agreed that i will pay them a visit to give staggared PDCs for the rest of the balance. Unfortunately, I wasnt able to visit them again because i was pregnant then and was always travelling. for the next month, i paid them again through the bank, i usually pay 4200/monthly. The succeeding months came and I was already too busy and pregnant to worry about it, i failed to pay them, until i gave birth and couldn't afford anymore. They sent me a demand letter to call them atleast to negotiate and said that they will file a case against me and mentioned something about our contract, etc. Again,i failed to do so,because I was scared and I really do not have any money to pay. i am no longer working in my previous company.
    2. I had an HSBC cc also, which i was still able to pay, beacuse that is all that i can afford. But my husband decided that i terminate all of my cc and stop paying all of them since i wont go to jail because of that and we need the money.
    3. i was also given a cc by BPI. My cousin asked if she may buy using my cc beacause she doesnt have a cc and Sm appliance store was giving a 0% interest promo. i agreed and asked her to pay directly to BPI monthly, because i do not use that card and I trusted her. Later on, i found out that she has not been paying and she is now in singapore. the amount is 25k, i used to receive calls and demand letters, and a even a visit from the collection agency but surprisingly they have cease to contact me already.

    Every now and then, there would be someone from the collection company looking for me and leaving lettres, etc. I dont face them,not even once, because i am scared and i do not want them to cause any scene outside our house. ofcourse i wouldnt want him inside my house either:) My husband would usually face them and would tell them that i no longer live there etc. and that i have left already to work abroad. we instructed the maid that if somebody looks for me again, she would say that she doesn't know me and that i dont live there. We told her not to entertain anybody since she and and the children are usually left alone in our apartment. They also could not contact me through mobile, because i have changed my number and my old number is now being used by someone from my previous employer,i also told her 9 the owner of my number now) not to entertain callers looking for me. Now here's my question:

    A. as for the cc, it seems i already know what to do because i learned a lot from your blog, am just concerned about the citigold and citifinacial loan. Can they accumulate and Citibank would collect from me both at the same time? that's why i am scared to call them for my loan because they might try to hit 2 birds with one stone.
    B. Could i be criminally liable for the pdc that i issued? they still have one pdc from me remember? the one that i asked them to disregard because i will just pay in a staggered manner. Can this be considered as ESTAFA?
    C.Since they still have my pdc, and my check account with UCPB is active can they still send it to the bank for clearing? As of now, UCPB has never called me to inform or even notify me that my check has bounced.
    D. We have a condo unit which is named after me and my husband because my parents work abroad and it would be too tedious if they would buy it under their name, thus, they asked me to purchase it under me and my husband's name,but they remit money through UCPB every month for the amortization. Can Citibank sequester that property if they would file a criminal case against me? Because, legally it can be considered as my property.
    E. can they send a police or baranggay staff to invite me due to these loans?
    F. will I be liable for violating RA8484, because, my housemates would deny that i live here and they definitely could not contact me anymore, because i have a new employer,a new mobile number and office number.

    I am really scared and feel that i am indeep trouble..:( none of my relatives know about this not even my parents, and i feel like i am running out of time. I want to know once and for all what's the best thing to do. I do not have the cash to pay for all of them. I actually and honestly do not want to pay them anymore because they've blown uncontrollably. Lastly,i am really concerned about the citifinancial loan.     Relax, your case ain't new, it's you who's new to all these.

    A. Yes they can. It's their money.

    B. No. One criteria for Estafa is knowing you don't have the funds and yet you presented your check as if you have funds to cover it. You stopped them right?

    C. If the clerk hates you... hehehe. Or, since you've already told them not to use the check, you can also just tell your bank to cancel that particular check.

    D. IF they filed a case and IF they win and IF the judge orders the attachment, then yes.

    E. Police and baranggay? They could visit (some readers wrote about these) but that's as far as it goes.

    F. It's no use. They will find you. But liable for RA8484? No.

    Afraid of relatives and parents knowing about it? Heck... just tell everyone of them whenever you get the chance that you think the credit card company's computation is all crappy and you're not paying them one cent until they get it fixed. That way, nobody gets surprised.

    your blog is really helpful. i have cc problems as well. nakaka stress isipin kasi talagang nang haharass sila. yung isa, tumatawag sa cellphone at nag te text pa na kailangan ko raw tumawag sa law office na sinabi nya. ang masama pa, pati sa facebook account ko nag send ng message. ayaw akong tantanan! ang kapal ng mukha, pati sa facebook kino kontak ako. they've been calling me at the office & in my cellphone for 3 months now pero di ko sila kinakausap. i just pay what i can to them kasi wala talaga akong pambayad. di ko nababayaran ang minimum payment since march 2010. i have also received letters demanding me to pay them within 5 days. they threatened to visit my office or home. i'm dreaded this, ayokong mapahiya sa opisina at lalong ayokon pumunta sila sa bahay. anyway, lilipat na ako ng office sa august. same company pa rin yun. should i inform the credit card company that i have a new address? kung idedemanda nila ako at pinadalhan ako ng subpoena, kailangan ko bang pumunta sa hearing? thanks argus!

    1.) Even if you tell them, I don't think you can present proof later on that you did tell them, unless you do it in writing and you have it signed and received by them.
    But unless collectors really handle documents properly, the next agent or collection agency would not know anything about your gesture.
    So in my opinion, telling them is pointless. As my friends could attest to, the next collectors who will handle your case would still claim that you've been trying to hide all along.

    2.) IF a case was filed against you and the court sent you a subpoena then you would have to attend.

    I'am also one of the many people who is struggling from the nightmare of past indebtedness. I have my cards from HSBC, and it came to a point that i was being harrased by the collecting agency, iam planning to pay them in due time. But my question is since i'am already in the list of negative records by cmap,bap or credit or bank instituion, after receiving my certificate of full payment from the bank how long will it take for my name to be clear in the list of negative records from such institution? and where can i verify if my name is cleared already.

    The list is more like a security guard's log book. What goes in there stays there. So the real question is, how far back do they look to say that your past indebtedness is already irrelevant.
    The answer is, it's up to them.

    Yesterday I received a demand letter similar to the sample letter posted but of different case and bank and my fear now is whether or not the letter really come from the Firm..
    The demand letter asking me to pay my cc dues in full amounting to almost 500k... where the card is from uae. Included in the letter is a threat to ban me from any foreign countries and imprisonment. just noticed one thing similar to the posted scam letter to what i received is SIMPLICIO DOMINGO JR remained on leave... and they are asking me to settle the amount stated above to their Legal Officer. Anne Marie Cabaddu (ams_cabaddu@dmolaerlawfirm.com.ph) through company's phone and or to company's mobile numbers.
    for you kind information I left my job in uae after constantly receiving harassment, threats of filing case against me from the collector agent from uae...Though i have promised to pay my 2 months delayed dues which only happened when I was on my annual vacation to Phil., but then after several explanations and promised I have given the agent to pay my dues after receiving my salary, she keeps on calling me and forcing me to borrow from my friends just to pay my dues otherwise she will pursue on filing a case against me that will prevent me from leaving the country and eventually will be imprisoned. Fear that all the threats will ensue, i decided to flew back to Phil after 4 days of arrival from my vacation, leaving my fruitful job where I am receiving almost 200k per month.
    Now Im still here in the Phil..included among others jobless not entertaining offers from employers overseas because after receiving so many email threats of immigration ban, nbi, police blotter etc etc from the collector agent, Im having a nightmares!. Ive lost my car, my house debt ballooned and now my daughters education and future is at stake... I wanted to work abroad but then this threats are haunting me day and night that i couldn't almost sleep... Please help me on this..thank you.

    Get on with your life. You won't be able to pay anybody if you don't get back to work.
    Those "email threats of immigration ban, nbi, police blotter etc etc" are just threats.
    Nobody has filed a case against you. If ever they do file, you can always get a lawyer to handle the worrying for you. But you won't be able to do that if you don't get back to work.
    Again, get on with your life. Your debt is just a part of it. Don't let it rule you.

    the only reason that preventing me to accept offers is the fear that at the immigration area they might catch me and put me into jail...More so now that I received a demand letter from Molaer Firm na lalong nagpatindi ng kaba ko at halos di na ako makahinga sa kakaisip.. I dont have plan of not paying back my cc's after getting a job which I am confident with my profession and experiences is not possible to do... Yun nga lang kasi the moment na maisip ko mag-apply o tangapin ang offer, napipigilan ako sa pangambang baka nakaban na ako sa immigration or naka-timbre na ako sa interpol. Masyado nang malaki ang naidulot na problema sa akin ng cc na yan at ito pang molaer demand letter na ito... how do i know pala kung scam or fake ang letter ng molaer? me nakita kasi ako similar letter they used molaer firm pero me connotation na scam...kinakabahan tuloy ako na baka nga totoo...sa ngaun kahit gustuhin ko kumuha ng lawyer wala naman ako kakayahan dahil 7 months na ako walang work dahil sa mga pagbabanta sa akin ng agent na yun sa uae.
    Anyhow, salamat sa pagpapalaks ng loob ko at sa ngaun magkakaroon na ako ng tapang na magapply ng work o magentertain ng mga offers sa akin..

    yesterday i received a text letter from the law firm/collection agency saying that a writ of preliminary attachment has been issued by so-and-so judge,but that i have 24 hours to "coordinate" with them a withdrawal of the case.

    i am also warned against withdrawing from my bank deposits and from my salaries!

    and this was followed - in the same text message - by a threat: "..otherwise, the bank's legal team will conduct an ocular investigationre: legal case filed against you.."


    my questions:

    can a writ be issued ahead of their winning a decision on a collection case? it's not clear if a case was actually filed, since i received no summons, and if the case had been won, i should be getting a court decision straight from the judge, isn't that the proper way?

    and do not the rules of court specify what they can attach and what they cannot???

    i think the agency is bluffing, because i am not made aware a case has actually been filed and won by them.

    Yes.
    A writ of preliminary attachment is requested and issued BEFORE a decision is made and not after. The purpose is to assure the creditor that whatever he wants to recover will not be disposed off by you or disappear with you while the case is still being heard.
    It can also only be requested and issued AFTER a case is filed.

    You are correct in thinking that they are bluffing because if they did file a case, they should be threatening you with the case number, not with their successful petition to the court for a writ.
    Preliminary attachments are issued for cases where intent to defraud is clearly evident, or if you can't be found in the Philippines.
    As you can be found, (they can even personally inform you of their upcoming ocular inspection) and your intent to defraud is highly doubtful (you're at home watching a movie with the home theater system you bought with your credit card) - then a judge in his right mind would not issue one. This is of course just us assuming there is a case filed.

    i used to own a standard chartered credit card which i defaulted payment a few years ago….. my standard chartered account is with the collecting agency.

    now, i’m having problems with my HSBC account. i’m quite struggling with my finances and i’m afraid that i will not be able to settle at least the minimum amount for my HSBC account. in the event, that i defaulted payment with my HSBC card, what will be the effect of it considering that i already defaulted with my standard chartered card.

    My wife, daughter and I left the Philippines 2 years ago to immigrate somewhere in Europe. In doing so, I also left 2 HSBC CCs with a collective balance of PhP220K, a Unionbank CC with PhP45K balance, and a Zest-Robinsons Bank CC with PhP40K balance, all of which are still left unpaid to this day. My parents have received numerous phone calls and demand letters from collection agencies, of which she constantly denies that she still maintains contact with me (which isn't exactly true). Given this scenario, I have several questions which I hope you have answers to so that I can sleep better at night. First, given the collective size of the unpaid balances from all 4 CCs (is PhP300K big enough for them to pursue me?), should I be worried that a criminal case might await me if ever my family and I decide to go back for a vacation, given the fact that I made no attempt whatsoever to settle these debts before I left the country? Second, is it true that anyone on a credit blacklist is eventually taken off the list after seven years?

    These are from different banks so I don't think they'd lump it like you would. But technically, each of these banks can pursue a case against you if they would want to regardless of amount.

    NO, it's not a criminal case.
    I don't think anything 'awaits' when you go back.
    If by a slight chance they file a case, it would be a civil case. Something you just talk about and settle.

    I know a lot of people that could get into the top 50 of that list but still gets approved for new credit cards. I'm not saying you go and do the same. I think it's bad for your health. ;)

    But to answer you question, I'll quote from my answer to a similar question:

    bit scared and worried right now. . yesterday one of our brgy kagawad came to our house telling me that a certain police chief inspector called them informing them that may husband has a case and according to them he has to call them to settle it coz if not the subpoena and warrant will be issued today. do you think that they can arrest my husband and put him in jail?actually i called the number that they give to our kagawad and i ask him if what is the case of my husband. .he told me that he can't discuss it with me because he's not a lawyer.he also told me that a certain lawyer filed the case with article 8484 republic act 315. . do u think he's a real police?

    A: It does not matter if he's a real police officer or not. But think of this, violation of Article 8484 is a criminal act which warrants an arrest. Do you think a real policeman or a real prosecution lawyer will go out of their way to go to the suspect's barangay and tell the kagawad to warn a criminal suspect that they are going to arrest him tomorrow or next week?
    That's stupid right? They're just trying to scare you. Why they have to these things when all they have to do is ask you to pay is what's irritating.

    So just ignore and don't bother explaining yourself to anybody.

  138. I would like to ask your help po. I have a big problem with my cc same with others. I also received threatening calls that gives me sleepless nights. I have signed up an arrangement po kc before with citibank and eastwest bank for amnesty and restructuring program when I have work pa..During those months naman po nakaka-comply me pero later on di ko na kinaya especially now na wala me work. I received harrassment calls and texts from them..Pinapagawan nila ng paraan na makapag pay me on specific dates which I cannot comply sa ngaun since I don't have job pa. I told them that I'm willing to continue paying once I have na work again but still they demand payments from me otherwise they will sue me daw in court..I am really afraid especially un mother ko nagwoworry. Please help me po what I can do to this..I have mentioned to them naman n willing me magpay kaya lang wala lang me talaga trabaho now and walang source of income..

    I don't think there is much more you can do right now aside from what you are already doing. And you are doing the right thing, telling them of your situation.

    What you need, is to do less of the worrying, and the sleepless nights.
    As you said, your problem is just 'same with others'. So don't feel that you are the only one that they are calling or sending letters to. Just imagine the poor guy who makes those threatening calls. He has to sound angry 50 times a day, every day. After calling you, he will call another poor guy, telling him pretty much the same thing he said to you.
    Worrying more would not make your situation any better.

    Be not afraid.

    You are healthy, and everyday is a brand new day. It is a gift, a fresh start for you. Focus more on getting a job or finding a source of income.

    Tell your mother you'll be fine.

    Your blog is really informative and helpful especially for those who are victims of CC scam.

    My credit card was used by unknown person when my wallet has been snatched from my bag 10 yrs ago. Immediately when I knew that my wallet was missing, the incident was immediately reported to AIG customer service apparently it was too late. there was already one time purchase of 16K from SM Department store which is floating. I also blotter the incident in police station. Police report and affidavit of lost has been sent to AIG office. I also settled all my unsettled dues except for this transaction. however the bank is pressuring me to settle the 16K until now. Same with the others, my family is receiving calls, letters, visits at home(introducing themselves as sheriffs)and lately a call from barangay tanod that a certain lawyer is in our barangay hall waiting. at present i'm working abroad and haven't been home for years now.
    in my case, do i really need to settle a transaction which i haven't made in my CC?
    it's really hard for me to settle the amount since i have other important financial obligations to my family.
    for my peace of mind as well as for my family, i'm willing to settle half of 16k in monthly installment. do i need to send my mother to AIG affiliated banks for amicable settlement?

    A: No. I think you've done your part. The problem is now with the collection agency which acquired your balance. Their collection tactics apply to all regardless of how legitimate your story behind is. And I don't think they get documents about your dealings with the credit card company. You're actually just a number in their list they have to call and collect from by any means.

    A: For peace of mind? Hell. You are being bullied. And bullies proliferate when we provide them with bread and butter. Remember NPA revolutionary taxes? They pressure business folk to fork out money so business could go on in peace. And now you're even thinking of sending your mother out there.
    Whatever they say, there won't be lawyers, cops, sheriffs or any official sounding alphabet institution you will be dealing with unless they file your case in court. And for 16k the most likely place they would file your case would be in a cabinet.
    Think about this, the smaller the amount, the more aggressive their tactics are. Why? Because people are more likely to settle as it is affordable. But in your case, it is not right for you to settle even 1 cent.
    Tell your folks back home not to entertain any fake official that are sent their way.

Hi Thanks for the info, actually I have received a demand draft about credit cards, I've been using them for many years and diligently paid on time more than a minimum amt always, unluckily I search for work abroad, to augment my increasing demand for financial resources as the rate of increase from my local employer here is not proportional to cost of livings to sustained our monthly family needs, I cannot understand these credits card cause while I'm paying deligently they are putting additional charges I don't understand which make the holders feel a more burden of using the credit cards instead of feeling it at ease. There is this insurance premium this citibank is charging every month over and above the purchasement I made which I don't understand, and they instill it against my will. They are very fast in charging 500 php when you're delayed two days, but it not quite easy to request for reversal, because there are some reason for the delay but that doesn't mean I am not willing to pay. Now I not lucky enough because I'm jobless this time, and although I'd like to pay I can't because I have no money, I could hardly send my kids now to school, and these credit cards provider have no heart of whatsoever happen to you, not considering that I was once a good payer but because I have no more work I can't pay now. What will I do? sell my soul to the devil? just to pay them? my good lord, here is another one, you can't pay the amount anymore and yet they are still instilling more interest! May God condemn them! it will not help to put more interest to the previous balance, the more they bury you to debt. Just happy to read articles here, it ease my worries on how will I be able to pay. I have requested the other credit card, to please freeze the ongoing interest and late payment charges. But they ignore it, always telling "we'll just see ma'am/sir", Now I have nothing to pay, No more resources...just good I read your articles here, it enlightened my mind on what to to...so plainly to say, if you have nothing to pay don't pay, because you don't have an intention of not paying only you have no money to pay...thanks a lot for this site....mabuhay kayo...maraming salamat sa site na ito....naintindiha ko na ang RA 8484...

  147. hi, i'm harvey, just quick few question, i don't have loan nor credit card in the Philippines but i got some credit card here abroad, just now, i received a text indicating that it came from credit investigation bureau from the Philippines... it says that i have civil case complain under r.a. 8484... i have credit card here abroad that i already settled in full, no credit cards remain unpaid. i am thinking which loan or credit card they are referring since as i've said, i don't have unpaid credit at all more so, the text came from the Philippines. Please advise.

    for quite sometime the credit cards stop on "calling".

    last week i was surprised when a new collection agency start on calling with regards to my credit card. i don't know where did they got the number here in my new job. i think this is a personal matter but my co-workers are being disturb by these calls.

    i have 4 cc since year 2000 and having no problem in paying it. my problem with cc started when i lost my job in 2008; i have been receiving demand letters for quite sometime but it subsided about 2009. i have read a one of the comments regarding "repeat scenarios". what happen if one of these days i start receiving demand letters again? could they file a case against me? what should ai do if they did file? since i have a new job now should i pay them? last count is at 400k from one cc alone; honestly i don't know how much bigger now.

    A: No. Electronic messages or electronic documents (like your bill) are legally recognized and considered to be like any other document.
    So if you can confirm that you can still receive your bill or if you use email to request for a change of address, all these are indications that you are not trying to defraud the bank.

    A: Collection agencies prefer to send demand letters by post or courier.

    A: They have to file a case against you first. Then they have to get a favorable decision. Then the court may decide how it would be enforced/settled.

Thanks for d info... so that means, all they have to do (CA's) is to file a case sa korte, and if they do get a favorable decision, then the court would allow the CA to get what they want inside the house that would amount sa CC debt nya. Wow! So di rin pala talaga masasabing makaka-relax ang isang na-bankrupt at lubog sa utang kasi lilimasin din ang loob ng bahay nya. Di ka nga kulong, ubos naman gamit mo. Well yan ay assuming nasa 6-digits ang utang mo sa CC. Pero kahit pa 5-digts lang, dami na rin sila makukuha...uunahin na syempre anumang mamahaling appliances.

    All in all po pala, ang makapagsasabi lang ng "wala po akong pambayad" or "di ko kayang magbayad sa ngayon" eh yung walang laman ang bahay... at tipong suot na damit na lang ang gamit...o baka naman pati suot na damit eh kunin pa nila.

    So ang tanong po ay, ano kaya ang basis ng court para katigan nila ang mga CA? Considering na (dinig ko po)malaki ang possibility na malagyan lang ang judge eh sure ball na for the CA's... kasi nga naman pwede sila mag-usap na porsyentuhan na lang once na makuha ang mga gamit at maibenta.

    Yung sinabi nyo po pala sa reply nyo dated June 22, 2006 na "Big or small if you cant pay, then you cant." Applicable po siguro dito yung wala nang kagamit-gamit, as in yung mga nasunugan. Kasi nga po, as long as may gamit sa loob ng bahay, then you can pay... you can pay by giving away your belongings sa CA thru court order.

    A: If you are declared bankrupt then you are discharged from all your debts and enforcement of all claims against you are suspended.

    A: These kinds of court proceedings are lengthy, inconvenient and very expensive.

    This is also why CAs would rather harass you to death than file a case. A phone call by a CA calling you an a**hole for not paying is relatively free.

    A: If you lend 20k to a friend, and he keeps telling you he can't pay, yet you see him everyday playing with his iPhone 4...

    This is not about getting away with it.
    This is about telling you not to be afraid of bullsh*t from CAs.
    This is about giving you your choice back if you feel you've run out of options or money. Pay my CC or food for my kids, or fare for my job-hunting.
    Having a choice lifts that load off your shoulders, and that yes you can relax and deal with it at the same time.

I have received a demand letter from Domingo and Molaer Law Office regarding my outstanding credit card balance to HSBC amounting to 99K... the letter has an attachment, it's a copy of the letter of the Law Office to HSBC recommending to them that they can already file a civil case against me under the Rule on Small Claims Cases to be filed before the MTC of Taguig City on the ff account: 1) based on positive contact; 2) with financial capability; 3) with no positive response to our previous demands to pay..... ....... The law office has been calling my office but my co-workers told the agents that I no longer work there.... The demand letters were delivered in the apartment where I am renting, they were received by my neighbor.... I also have another HSBC card which is still active and i am still using it and paying my dues monthly... The same billing address po ang ginamit ko.... I kept on ignoring the texts from the agents of the Law Office.... Should I be afraid of the latest letter recommending to the bank the filing of a civil case against me? It is stated im the letter that I am given 2 days to positively respond to their demand to settle... It also said, ''This is our final warning...'' what will i do? Thanks so much.....

    I have a credit card which has been past due for over 5 months now. I have been paying it diligently for the past 3 years until, like all of the rest, had a financial difficulty which lead me to just default the balance.

    Now, CAs have been texting me incessantly which I chose to just ignore and decided to have any calls on my current number be forwarded to my old non-existent number.

    Questions are:

    1) my balance is around 51k due to interest and other finance charges but my balance is just around 40k initially before i left it unpaid. do you think they will pursue filing a civil case for that amount?

    2) if they do, can i just ignore the letters and ask my landlord that if there would be any more of these demand letters, just inform the CAs that i no longer live there?

    3) and if i ignore their summon/subpoena/demand letters, would it eventually impact my NBI clearance and have a hit on it?

    1) No.

    2) If they file a case, ignoring subpoenas tend to complicate matters. And why hide from CAs and demand letters?

    3) Even if you ignore a subpoena or any summons made by a court, the court could still render judgement against you in default.

    Ignoring a court of law is generally a bad idea.
    CAs are like dogs, they like to chase the one who runs. Better to just deal with their barking and all.

  167. hello, im also cc defaulter... worried ako kasi nung hindi ko na kayang bayaran ung minimum amount due.. ginamit ko na ng ginamit ung card ko up to the credit limit which is 32k.. nasa 15k ung outstanding balance ko before... ewan ko ba.. prang pumasok sa isip ko na iintayin nilang maubos ung credit limit ko bago nila ako kuliting magbayad.. tapos interest lng ang kakain ng available balance ko kya ginamit ko sya to the fullest.. ibang case po ba sa court yun?? prang intention to defraud?? pero still d2 pa rin ako nakatira sa declared address ko...

  172. Good Day po. Two questions.

    1) How does one file a complaint under RA 8484. One collection agency sent me a demand letter that was signed by a supposed legal counsel. When I checked out the name sa IBP, wala naman siya sa roll. This has happened twice. The second time, the name of another "legal counsel" was there pero wala namang signature. Di ba bawal yon. Misprepresentation yon?

    2) Yesterday, another collection agency called my office for the same account. The man on the line was shouting at me and calling me arrogant. How could I have sounded arrogant when I could hardly speak and was racked with cough. I kept telling him to stop harassing me and to stop being rude but he said that I should wait for their representative to come and visit me and that I should display the same arrogance when they did so despite my telling him that I was so sick and could hardly speak so how could I hve sounded arrogant. I have two credit cards with the same bank. The first one I paid this same collection agency after they threatened to go to my boss and "expose" me for "using" the company to defraud. In order to pay the first card, I had to take out a loan so now,I really don't have the means to pay the 50k Mr collector is asking for. This new collector keeps on pushing me to either give the money or issue a check. I told him both are impossible since I don't have the funds and no way will I issue a check since I don't have the money to fund it. They are coming to my office daw on Monday. I'm hoping to avoid a scene. What do I do? Oh and I asked why the collector was demanding that I pay 50K immediately when I received a text 2 weeks ago demanding 45k. He told me that it was my fault for not taking the earlier deal since various agencies have my account.

    2. What do I do?

    A: If telling your boss beforehand could help then do so. If your office have security guards, then advise them to not let any visitors through. Or let them phone you first to confirm.
    If you don't have guards, then there could be a scene. Just lead them out to talk someplace else.
    But hey, lots of folks here have been through some one way or the other. Important thing is, keep your cool, it's not these guys you actually owe money to, and you actually don't have to do anything, no matter how creative they get to say it.
    Best advice I got was 'recite the alphabet backwards including the - now I know my abc's part'.
    Well, I just wish we could all be there to watch. :)

  174. Thank you po for your advice. I have already sent a letter (a very long one) to the BSP this morning. I got a call this morning at the office from a guy claiming to be a police officer. He said he was acting on a complaint filed by some lawyer's secretary. Supposedly, nagpapasama daw yung babae sa office ko to serve a subpoena for a civil suit. I included this in the letter I sent to BSP. Question ko kasi, bakit yung babae ang magseserve ng subpoena, if ever? And why is the police involved in a civil suit? Puede ba yun?

    First of all, i did not apply for any cc application from any bank and I was surprise to receive a cc from RCBC with my name two yrs. ago, because of financial problems, i started using it just this year and unfortunately I ended not paying it two months ago. Now, a collection agency is starting to email me and demanding for a full payment with interest. Is it possible for them to sue and harrass me even if i did not apply for it? Actually the name on the cc they sent me is not really my name in my birth cert and it was really a big question why did they send me a cc.

    I am really worried, please advise me.

    hi.i applied for a cc.honestly i gave them false name and identification cards,address i was only trying,i was surprised that it was approved.i exhausted the card but i havent paid since. i know i am at fault.a police inspector called at the office but i pretend not to have known such person, that i have to verify first. he said there were cases filed RA8484 and estafa,that they will come to office to file warrant.is it really a police inspector??if i made settlements to the bank or just pay direct to the bank directly,staggeredly,i know my account was already turned over to the collection agency and i am not sure if they were the one pretending to be the police inspector....pls help.tnx a lot

    I have financial troubles thus, disallowing me to pay my CC's. Then I received this Formal Demand Letter saying it is a Final Ultimatum. ANd reading along, it says, "your name would be placed on the roster of persons with derogatory records in the:
    1. NBI
    2. Bureau of Immigration and Deportation
    3. Foreign embassies and consulates
    4. Banking Circuits

    My question is, can this Collection Agency capable of doing such blacklisting my name on the following government agencies? Will it hold true?

    Nag loan po ako nung 2007 sa Psbank ng PhP40K payable for 2 years 2,886/mo. ang amortization para po sa brother ko kasi po di sya ma approve sa mga loans nya, yung brother ko po ang nagbabayad after 9 mos. of paying di na po siya nakabayad at hindi din po niya sinabi sa akin. Nagulat na lang po ako sa na receive kong demand letter from a law firm.tumawag po ako agad sa contact person na nakalagay nakiusap ako na kung pwede P20k na lng ang babayaran ko since nakabayad naman po ng 9mos yung brother ko at babayaran ko ng 500/mo. sabi po ng collector ipapa approve nya muna sa psbank nung binalikan po nya ako sa phone sabi nya sige daw at pumayag na daw ang psbank pinagbayad po nya ako ng initial na 1k sa loan account number ko at ipinafax po nya sa kin agad at ang sabi po nya next month na daw po sisimulan yung 500/mo.buwan buwan po ay nag reremind yung agent ng payment thru text nagbabayad po ako ng 500 sa psbank kada buwan ang last payment ko po ay Dec 15, 2012 3 years na po mula ng makipag usap ako sa collection agent. yung mga payment slip ko po ay naka file ngayong January po pang 20K ko na po ng payment. ngayon po tinex po ako nung collection agent ang sabi po ay umabot na daw po sa 178K ang loan ko at makipag settle daw po para di na mag interest pa...ang intindi ko po ay pumayag ang bangko sa pakiusap ko na 500 kada buwan dahil tinanggap nila yung bayad for three years..paano po ang magandang gawin ko hindi ko po kayang bayaran ang gusto nila...wala akong pinanghahawakan na dokumento na pumayag ang bank pero po the fact po na ina accept nila yung payment pwede ko po bang iignore na lang ang loan na yan kasi naka comply naman na po ako sa 20K @500/mo.? ano po ang magandang gawin ko dito pls po i need your advise po asap..salamat po.

    If you think about it, the caller does'nt have any reason to raise his voice. It's not his money you borrowed.
    This is a business transaction between you and the bank and therefore should be conducted in a professional and business-like manner.
    So I would think that the caller is not from PSBank but rather an employee of the collection agency which uses this scare tactic on you.
    I'd say, answer the call. You don't have to feel guilty. You've done your share paying.
    If the caller is shouting, you don't have to listen. If he's not and seems to be willing to talk nicely, then say what you need to say. But don't agree to paying more.
    Again always remember he's just acting angry. And if he talks case filings then don't be afraid either. They won't file. And if they do, you'll win.

    Answer the call if convenient. Be professional even when others are not.

    Question lng po. I called MTC regarding nga sa unsettled acc ku na 23,000+. Ung agent na nakausap aku finorward nya ung call sa Account Specialist and then c account specialist may binigay na no. Skin and ngbgay din ng specific person na kkausapin sabi nya dun nlng aku mkipgusap " KUNG PAPANO ANG BAYARAN" so nkausap ku na nga ung pinphanap nya..

    I told her na I can't settle nga the whole amount. Ngbgay xa ng opt. Na within 3mos daw P7,000+ monthly.. I said that hindi ku pa rin kaya bka pde khit monthly. Sabi nya the best option na mbbigy nya is bayaran ku ung half ng utang ku pg na settle ku un soon "sarado na utang ku" so xempre prang nkakasilaw kc almost half na ung mbbwas sa iisipin ku. Tinanong ku sya kng sure yun sabi nmn nya "diba sabi ng metrobank sakin ka nmn makipgusap tungkol sa bayaran?" Then tinanong ku sya kng over the counter pa din ang bayaran sabi nmn nya oo basta tawagan sya once na mabayaran na.

    Ang tnong ku lng possible po ba tlga ung mga gnun? Nagnibigay sila ng half payment then icoconsider na nilang wala nkung utang rep po pra alam ku kng tama ung gagawin ku. Thank you!

      You can ask for them to put what you are paying for in writing.
      Then when you get that document, you may consult the bank and maybe they can countersign it, just to confirm.

    Thank you sa mga advices mo about sa CC.

    Ang case ko naman was nawalan ako ng matinong trabaho for a year so I wasn't able to pay all my cards.
    Ngayon, ang tanong ko is if I can still open a checking account kahit blacklisted ako kasi I will be a treasurer of a small company na ire register pa lang sa SEC or they will tell me to settle muna all my obligations?

    Kasi natry ko na un dati para naman sa Pag-Ibig Loan pero sinabihan ako na blacklisted daw ako at I have to show them first all the certifications na bayad na ako kaya lang as of now kasi wala naman na ko natatanggap na mga demand letters.

      You can open a checking account, it's just that the bank could/would check your credit history and it's really up to them if they would allow you to.
      What you can do to make them see you more favorably though is; open a savings account with the bank you want to open a checking account on and make regular deposits. The longer you have that savings account with them, the better.

  185. I read everything and it really starting to make sense now. Like others, I am scared to death and the fact that I didn't expect this to surface after 10 years, as I thought this has been settled by my previous employer as agreed, I received a call stating a huge amount of interest and claimed that I had a CC with the bank which is not true... as far as I know, I have a personal loan. I was in a foreign country at that time and yes my loan was in a foreign bank. If my previous employer failed to settle that loan as we agreed (settle with my end of service settlement), then of course I have an obligations to pay. Do I have the right to request them to waive the interest and slowly pay the outstanding amount whatever I suitable for my current financial status? Do they have the right to decline? Can I sue them for harassing my family or any people I know. Lastly, can I demand for all transactions to be in writing? As when we are discussing over the phone, they mentioned a principal amount that is not accurate since I knew the bank will not at all approved that time due to the amount of my salary and I doubt if these people are for real indeed... Please do advise... disturbed

    ask ko lang, I have ksi may Eastwest CC before. Last year diko na nabayaran in full ung balance ko for 3months then may tumawag skin na agent nag offer na lang to pay it in monthly. Nag agree na ako dun and may nisign akong paper for the fix monthly amort. Before nababayaran ko sya monthyly pero now 3months na di ako nkkpagbayad. Nagpalit na din ako ng # ksi i lost my phone. Pwede ba nila ako ipajail? or may maikakaso ba sila sa akin?

    Nabobother po ksi tlga ako.

      A: Don't worry if they take you to court. It would most likely be filed in a Small Claims Court. And in a Small Claims Court, your liability is minus any charges (interest,fees) that they add-on. That is why they are also less likely to file and just try to scare you to death.
      Debt doesn't merit any jail time.

      Not paying 23k within 15 days does not mean the end of the world.
      Paying 5k now does not mean they would stop either.
      Next time it will just be 18k within 15 days or they could even say 20k because interest charges continue.
      15 days is the deadline for him to collect. Not for you to come up with whatever.
      You can wait for a better deal if you want.
