Credit Card Woes - The Call

So now after a couple of years in Just-swipe-it Heaven, you find yourself in Barely-scraped-through-minimum-payment Purgatory heading towards Tell-them-I’m-not-here Hell!

For those of you who are inevitably plummeting down credit card debt hell, let me soften-up your landing a bit. And for those already wailing and gnashing their teeth from debt heat, let me ease your suffering a bit with a bucket of ice water.

That’s right folks, there is hope and respite from your credit card woes. But no, I’m not gonna help you pay. All I’m going to do is enlighten you a bit with regards to your situation.

Pop Quiz: You’re receiving maddening calls from seemingly very angry people calling you names, looking for you wherever you are, asking you to pay up.

What to do hotshot: Take the call if you can’t avoid it. Relax, take a deep breath, and sit down comfortably. Answer with a simple yes or no. No need to explain yourself, they’re not there to listen to you whine, they just want your money.
Now most of them will come on to you like mafia dons, shaming you with your inability to pay, threatening that they’re coming to get you and that slab of flesh from your behind.

Well, that’s what they think!

When that guy on the phone starts to raise his voice, just tell him this: "Mister, stop play-acting. I don’t owe you any money, you’re just a poor employee collector agent whatever, so don’t act as if it’s your money I owe."

Now that he has realized you’ve caught him in his act - (yup, that’s all it is, just an act, so relax!) -he can’t possibly get on with it anymore. Whatever he says afterwards will sound flat to you and to him too, like you’re hearing an old joke. Besides, he can’t really be mad, he’ll probably get a commission when he collects from you.

Some of these credit card collectors may try to harass and put you in embarassing situations and even if you're able to put them in their place, you find that the damage has already been done. Well, just grin and bear it, but I'll tell you this: It's just a phase. It will pass.

But what if the caller sounds like an angel from up high? Gently reminding you that you need to pay up or else...

He’s playing the good cop act then so just ignore the ‘or else’ stuff too. But this would be a good time to work-up a deal, just make sure it’s on your terms. Tell him how much you can comfortably pay in a month. If he relents, fine, but if not, you can go hang-up that phone. Don’t worry, he’ll call back. And be it good cop or bad cop, you’re gonna be ready.

    1. Hi Jc,

      If you mean - can the bank deduct from your ATM payroll, check your CC Terms and Conditions. Like in the case of BDO it's under section '19. Consequences of Default'. In item 'b)' it states that "... to automatically debit his or her deposit account for such amount as may be sufficient..."
      So to answer your question do they have the right? Yes. Actually you gave them the right when you used the card.
      Would they? So far it's not standard practice. But again in the case of BDO, don't forget their motto. "We find ways." Whether that's a threat or something comforting, it's up to you.

  4. First of all, madaming madaming salamat bossing AG. Pina panatag mo ang kalooban ko.
    Pero tulad nila, may problema din ako sa credit card debt. medyo malaki po kasi yun nakuha ko gamit ang mga credit cards ko, may 87K, 55K at 40K sa mag kakaibang credit cards from different banks. Wala po interest yan. Meaning to say po, more than 100K po ang debt ko sa kanila. So hindi po ako pwede dun sa small claims office na bawal ang abogado, tama po ba? So pano po yan? Makukulong po ba ako?? Ma i-dedemanda po ba nila ako??
    Bigla na lang po kasi ako nawalan ng trabaho. Eh kaka gamit ko lang nung cards at galing po ako bakasyon, nahihirapan din po ako makahanap ng work. Balak ko na lang po mag work from home, pero maliit lang and sahod pang daily expenses lang. At hindi ko mababayadan ang mga credit card na yun. Pano po ang gagawin ko??

    Kung hindi ko na po tuluyan bayadan yun mga utang ko sa kanila?? Ano po pwede mangyaro sken?? Makukulong po ba ako?

      Sorry for the late reply.
      These are separate cases. And it takes longer and more expensive to recover money if they don't file it under the small claims court. But small claims or not, you can't go to jail because of your debt.
      If you opt not to pay anymore, you'll find it difficult to apply for bank loans in the future.

    2. Even if there's a collateral? For example housing loan?
      Its not that i won't ever pay it. It's been months that i'm jobless, and busy with the case that we filed on NLRC against our company.

      I'd like to ask sir AG.
      How about those bankloans? I mean the text messages i'm getting, that they offer cash loans with no collateral? Are those the same with credit card if you're not able to pay them?

  5. Hi, i also have the same scenario. I have a cc debt sa BPI NA 150K with all the interests andshit. Di ko na talaga kayang bayaran so naendorse na sa Collection. Yung collection pinipilit ako magbayad ng 45k kapag di raw ako nagbayad magvivist daw sila dito para pirmahan ko yung agreement. Need ko ba pirmahan yun. Or papasukin ko lang sula sa bahay to entertain? Magsasama daw sila ng Barangay and all. What do I need to do? Please help

    1. Hi,

      No need to sign the agreement. You could sign that you received a copy. It would be worse to sign an agreement you cannot really fulfill. Barangay would just act as referee nothing else. If you don't want anybody from the Barangay to have to go to your place, just give them your number now and tell them to call you if somebody requests your presence.

    I just received a call from Collections Department of Eastwest ang they are really really rude calling you 4x a day and ang dami dami nilang dinadagdag na kung anek-anek na interest sa card ko.. They are asking for my supervisor's name dahil pag di pa ko nakapagbayad ang next step na gagawin ay salary garnish that's why they want to talk to my supervisor.. Would that be possible?

      It's not possible if you don't agree to it. They just want to embarrass you. So talk to your supervisor and brief him about your situation so he'll know what to do or say and so he's not caught by surprise in any way.

  7. i am highly stressed right now. buntis pa naman ako and i am really worried. i just received an email with the subject "final notice for case file". hindi ko binasa ang content, same with the demand letters kasi baka lalo lang akong mabagabag. may mga nabasa ako na meron daw prang nanghihingi ng assistance sa bgry or pulis na nakakasakop kung san ka nakatira, totoo ba yun? nasa 50k ang principal debt ko, hindi ko nbayaran kasi majority of that ay pinaride lang at hindi na din ako nabayaran.so i just decided na wag ko nlang din bayaran since minimal lang naman ang income ko at minimal lang dn ang kaya kong bayaran. will they really file a case against me?ayokong dumating sa punto na pupunta ako sa mga hearing.if i only have the means to pay i would. gustuhin ko man makipagsettle sa bank hindi ko magawa kasi baka hindi ko rin kayanin yung magiging payment agreement dun. pls. advise. will it be better kung ignore ko nlang ang emails at letters? pls. thanks!

      Until you have the means to pay, you may ignore them. Just be ready and don't get affected as much when they use their scare tactics.

  8. Hi good pm. Just want to say thank for your blog it helps me a lot with regards to my credit cards problems it ease my troubles in worrying on how to pay my dues. Halos magkapareho kami ng problems due to financial problems at halos paglaki ng gastusin dahil na rin pagtaas ng mga bilihin Hindi na kaya pang bayaran ang mga utang credite cards gusto ko rin magbayad Pero sa mad mababang amount but somehow the banks don't allow me to do that halos umiyak na sa pagmamakaawa pero a yaw nilang makinig. So salamat . ask ko lg kung tumawag sa akin ulit ang mga agents dapat bang pangunahan ko na sola minsan na run akong tinakot na ipadakip para mapahiya Pedro ngayon alam ko na puro lies at pananakot lg pala.

      CA is just similar to all the purchases you made under that credit card.
      And showing your identification is nothing more than standard verification. Even department store cashiers do that.

  11. Hi argus, i have east west credit card kanina may nagtext sakin na ppuntahan daw nila ko sa bahayy and kilala na daw nila hr head ko para sa salary deduction. Possible ba na puntahan nila ako? Ok lang din ba na nakipag taasan ako ng boses sa tumawag sakin? Nsa 20k lng utang ko nging 27k ma since last march. Thanks

      Yes it is possible that somebody will go to your place. Don't worry about it, it's not unusual. Also, they can't force you to agree to the salary deduction.
      You can speak to them in any manner that you wish.

    May cc debt po ako sa HSBC as I remember mga almost 8 years na, can't remember my balance I think 14,000, nag migrate Napo ako at Hindi Napo ako Filipino citizen, recently may na tang gap ang mother ko letter pinaldala sa sa barangay sa Dati naming Lugar, gali g daw sa lawyer na bayaran daw utang ko mga 1m na daw, my question is ma habol ba nila ko kahit wala na ako sa pinas? Couple of months may tumawag sa work ko nag tanong about sa akin, shock ako pati ba sa Ibang Bansa kana habulin ka parin? Ilang beses na ako na ka uwi sa atin, just worried nga yong na laman nila na sa Ibang Bansa na ako mag hold sila sa immigration pag umuwi ulit ako sa pinas, please need your reply

    Hold you at immigration? No.
    Local agency to collect outside of the Philippines? No.
    1M balance? It should be something nearer your credit limit and not more.
    They can call and send letters to anyone anywhere though.

    Im lyka , i received a call from Phil Star that someone pay them to post my picture as wanted with 6-10years imprisonment. Is that legal to just post my picture and name and put as wated by not paying East west bank?

      Putting your face in the newspaper would cost them maybe about 15k+. And that's for the smallest ad. Collectors want to collect, not spend.
      Newspapers would demand legal documents to post those kinds of ads.
      You seldom even see those kinds of ads on cheap tabloids. And the "Phil Star" guy said they already got paid?

    I have a similar problem with them.
    I have 2 CC's.
    Both have 25k cc limit each.
    At first, I was diligent in paying them.
    However, I had a financial problem.
    To cut the the story short, I defaulted in my payments. I didn't answer any of their calls, text messages or emails.
    Today, my previous boss texted me informing that a certain Inspector Vasquez called my previous HR office informing them that I have a warrant of arrest for 2 counts of Estafa. I didn't sign anything with them nor I receive a Letter of Complaint.

    Can they really proceed with the case?

      Again, if they already have a warrant to arrest you, why would they bother to tell your boss? So you can go pack and hide in the mountains?
      If I were you, I would not deal with collectors that use these kinds of tactics. If they're deceitful now, they will probably be deceitful later with your payments.

    I am one of the many readers of the blog. And like most of your readers, I also have credit card problems. I have 3 cards - 2 HSBC and 1 BPI. Financially, I am not able to meet the payment for those credit cards. I have detailed a questions here and maybe you can answer them for me.

    1)I have an existing car loan with a different bank. This car loan is being paid on time- can BPI/ HSBC look into this car property and pull it out as paymaster for my cc debt?
    2)I have an existing personal loan also with BPI which I am paying diligently still, the credit card debt with BPI, that I can't pay- are those two different cases or can they use that personal loan against me?
    3) I have 2 savings account with BPI, although wala naman po laman yung mga yun kasi nga wala po ako mailagay magagamit po ba yun against me?
    4) can they go after my salary account in BDO and hold / garnish it to pay off my debt?
    5) I just moved to a new place and did not inform the bank - can they sue me under RA 8484? I still work with the same company though.

    I have been religiously paying my EastWest Credit Card but I realized, 90% of my monthly payment (which is always more than the minimum amount due) goes to the interest/charges. It seems my outstanding balance does not decrease.

    Recently, Union Bank sent me a pre-approved credit card. When I checked they website, they have a balance transfer facility which will require me to pay a fixed monthly amount. This is actually very tempting since the credit limit of the new card is sufficient to pay-off my balance on the old card.

    You think this is a wise move?

      Yes it would be wise to take advantage of it.
      But if I were you, I would also not use both cards for purchases until you get your balance to 0.
      Takes discipline - but that's what it would take to keep your fairy tale life from turning into an epic sob story.

    I received a civil case from RCBC Bankard, sum of money. Stated in the summons that i need to file a reply within 10 days after receiving the letter.
    What should I do, do i need to present anything or have my lawyer with me, honestly I dont have money to pay the 133K + 25% attorney's fee and 1,500 every hearing and I cannot even pay a lawyer to help me resolve this. Please need your advise.

    1. Hi Rez,

      It's highly doubtful that they would file a case for 133k. Banks tend to recover losses from defaulters of unsecured loans by selling the loan to collection agencies. So first, try to verify if that's a real summons you got. A friendly notary public in your place may be able to recognize if it's authentic or not. Otherwise go to the Public Attorney's Office (PAO). You don't need money to have a lawyer.

      But if you don't have money, what are you so worried about?

      But I bet what you have are fake documents produced by the collection agency.

      That's my first reaction but the attachment includes all my SOA from RCBC. I think RCBC provided all the documents to one of its collecting agency where at the same time law office. A sheriff according to my cousin delivers it to our house, He in fact know the sheriff.

      The plaintiff is RCBC according to the summons and im the defendant. Please advise. Thank you.

      You'll need a lawyer to make and file your reply.
      If you don't have money, go to your nearest Public Attorney's Office (PAO) and they can assist you. That is if you qualify as an indigent according to the following:
      1. If residing in Metro Manila, whose net income does not exceed Php14,000.00 a month;
      2. If residing in other cities, whose net income does not exceed Php13,000.00 a month;
      3. If residing in other places, whose net income does not exceed Php12,000.00 a month.

      To prove that you are - bring either one of these:

      1. Latest Income Tax Return or pay slip or other proofs of income; or
      2. Certificate of Indigency from the Department of Social Welfare and Development, its local District Office, or the Municipal Social Welfare and Development Office having jurisdiction over the residence of the applicant; or
      3. Certificate of Indigency from the Barangay Chairman having jurisdiction over the residence of the applicant.

      Don't worry if you cannot bring proof of your indigency right away. PAO lawyers will provisionally assist you since your case is about you being a credit card holder considered as “delinquent” by the credit card company, and immediate action is necessary. (You need to reply in 10 days.)

      If you choose not to reply, judgment may be rendered and they garnish your assets that they have petitioned for in court. Which tells me that they know you have assets / income / salary / accounts that they can garnish. Otherwise they wouldn't bother.

      Just take it one step at a time.

      I think your summons is for you to file a reply to the complaint, so there's no need to appear in court, unless what you have has a specific time, date and place indicated where you are requested to appear.

      Maybe your wife has assets / income too.

      Check your SOA too. If the interest rate is 3% monthly or above, you can indicate in your reply that the interest rate is excessive and unconscionable. You may also file a counterclaim for moral damages (harassment from CA if you experienced that) and claim actual damages (your lawyer's fees / your incurred expenses). But your lawyer will know what's best.

      There's is no specific date written in it and where should I file my reply. MTC Branch 68, Pasig, that is the heading address. The presiding judge witness it last Aug 13 but the summons was delivered only last sunday, Sep 14.
      My wife has work too, in-house based, the income is not consistent. Both of us relies only in our own salary.
      Please advise.

    I need help po..i received a formal demand letter from A.A.Molaer Law Office stated that they will file a case under the rule on small claims cases..they are obliging me to pay the full amount of 56k otherwise they would be constrained to criminally prosecute me for violating R.A8484 in order that i may be penalized with imprisonment...how true is that??nagsabi naman po ko dun sa tumatawag sakin from the said law office that i am willing to pay my debt kaya lang not now coz i dont have enough money to pay my debts.sabi nila may papapuntahin din sila sa bahay namin para mag investigate..sinasagot ko naman un calls nila at alam nila na im still working and living sa mga address na nakalagay sa record ko,hindi ko naman tatakbuhan un obligation ko its just that my obligations ako na mas inuuna eh..what will i do?kinakabahan ako sa demand letter nila eh..plss help me..Thank you! .-cher1818

      They can file a case under small claims that's true.
      Your case is not criminal so the part where you need to pay 56k right away is not true.
      You can wait for their next call or demand letter for better payment terms.

      RA8484 is about using your CC with intent to defraud. Like you maxed it out, disappeared and never paid a cent, or you used a fake identity. That's a crime.
      In your case you're just a delinquent card-holder.
      Small claims is just one court hearing, no lawyers, just the judge as mediator. If you have been to a barangay meeting, that's pretty much like it.
      Will they try to shame you, they will try. So if I were you, I'll tell everybody about how I'm not going to pay my credit card until they correct a bank error ;)

      In case you got one, a summons from the court is not something you just ignore. It will bite you in the ass someday. Also, the other side may win by default and they are granted everything they were petitioning for.

      The Rule of Procedure for Small Claims Cases was enacted to precisely deal with debts below 100k. It doesn't matter how much as long as it's below 100k including interests and other charges.
      This is so ordinary folk like you and me can bring to court and collect from friends who borrowed 5k from us and never paid up. It can also be used by collection agencies of course.

      The judge will of course consider your financial situation and will also see to it that the interest rates and charges being imposed are reasonable. That is why it is better that you appear with your supporting documents. That is also why collection agencies would rather not go to a small claims court because it would most likely be favorable to you because the judge would be more likely to reduce your payables to actual purchases with minimal interest rate applied at affordable monthly installments.
      Also the agency does not like it that they cannot send a lawyer to represent them and that the judge's decision is final and non-appealable and is rendered on the same day.
      That is also why the agency would rather scare you than go to court.

Dahil may kaso din daw ako na Staffa at Swindling nagulat tuloy ako at di ko alam panu ako nag karoon ng kasung ganun. tapos sabi sa akin eh tawagan ko raw si Atty.: Christine Amoranto (office 986-1576) para daw malaman ko kung baket ako nag ka kaso ng ganun.
    pag tawag ko kesyo na check pa sa system nila etc. bago bigay k Atty daw. nag duda na ako at baket need pa check sa system name ko hahaha.       No, they can't do any of those.
      But what they're doing is considered unfair debt collection practice.
      Part of the BSP regulation on debt collection prohibits:
      a.) the use or threat of violence or
      other criminal means to harm the physical
      person, reputation, or property of any
      person;
      c.) disclosure of the names of credit
      cardholders who allegedly refuse to pay
      debts,
      d.) threat to take any action that cannot
      legally be taken;
      e.) communicating or threat to
      communicate to any person credit
      information which is known to be false,
      including failure to communicate that a
      debt is being disputed;
      f.) any false representation or
      deceptive means to collect or attempt to
      collect any debt

      If he calls again, tell him you are recording your conversation and will file a complaint against their company to the BSP for unfair debt collection.

I've tried to catch up and signed a RESTRUCTURING PROGRAM to ease the burden.. I am able to pay it for the past 3 months but again another financial problems arises that I can't able to catch up with my payments to the extent that may card due reaches a total of 200 thousand.. One of the credit card collectors which is EWB terrifies me.. A sort of Atty. Jerry Dela Paz gave me an ultimatum which is due today and he told me that he will go to my office together with his legal team to talk to my superiors regarding my delinquent account.. My concern is the legality of that actions or is it just an act. im afraid that their harassment to me will lead me to lose my job.. I just want to know what to do in this kind of situation..     I hope you can help me, I am willing to settle my credit card balance at HSBC now that I have a job again. But it has been so long ago I don't even know exactly how much but it was below 30K that time.

    Now HSBC has endorsed my delinquent account to Enzi Corp. My outstanding balance amounts to almost 700kbut below that I found a discounted balance amount 65,000k.

    Problem is I don't have the money before the cut off date given, so I let the offer lapse and I didn't contact Enzi.

    My question is, I'd like to settle my hsbc credit card due but i don't want to deal with Enzi now that I see all the negativity in how they make collections in the blogs. I want to pay directly to HSBC, how do I go about it? And I can't pay the 700K outstanding, I have a job but i am now only able to pay for the amount I charged on my card. 700k is very steep. Why would enzi offer to pay just 65000K? I can manage the payment for 65k on a monthly basis but not a one time payment.

    Please help.

    i am also a delinquent payer sa RCBC Bankard naman. may tumawag sakin na ang sabi ay Nicdao law Office daw and sinisingil ako for my debt amoutning to 68k. i tried to ask for payment scheme pero ang binigay lang sakin ay tamnesty which is pay 40k daw within 2 days. or i can issue post dated check daw pwede daw ako manghiram ng check sa friend ko na merong PDC> syempre I can't pay 40k (cash or check) in 2 days! pinapapunta nila ako sa office nila to sign an agreement. so para lang matapos na i told them i will try to come up with the 40k. Nakapagbayad ako ng 18k sa RCBC mismo then sent them the receipt, kaso kulang pa ko ng 22k, they demanded for me to pay it the next day. eh sa wala tlaga akong ganung kalaking pera since yung 18k ay niloan ko lang din.tinetext ko nman sila na hindi pa ako mkakapagbayad pero ang reply nila sakin lagi is nagagalit na daw si atty nicdao na sasampahan na ko ng kaso, itutuloy na lang daw nila yung kaso sakin intayin ko daw subpoena ko pag hindi nagbayad.nagreply ako sabi ko cge intayin ko na lang tinanong ko pa nga anong address ko ang nasa kanila, hindi na sila bigla nagreply. since hindi naman sila pumapayag for me na magbayad pa konti konti, i ignored their txt message or calls. that was 2 weeks ago. then may nagtext sakin using a diff #, may case na daw ako under mtc branch 32 under a certain judge at iseserve na ang subpoena ko within the day by po3 and sheriff daw, then ang sabi pa tumawag daw ako sa # ng isang atty gonzalez to hold the subpoena. hindi ko din pinansin, tapos after a week nagtext uli sila at ang sabi naman nagagalit na daw si atty nicdao at itutuloy na daw kaso ko under sum of money or credit runaway under article 315 daw po. hindi ko na alam ano po gagawin ko. willing naman ako to pay pero pakonti konti lang.. kaso iba iba na silang number na nagtetext at tumatawag sakin. ok lang ba na magbayad lang ako ng kahit magkano sa rcbc at hindi ko na lang sila iinform? ano po ba dapat gawin at paniwalaan sa mga sinasabi nilang kaso ko? sana po mareplyan nyo ako. tnx po! -- scaredy cat

      If it was me, I wouldn't even have paid the 18k because it was not what they were demanding. And the 18k will soon be swallowed up by charges, interests they will continue to add onto the principal.

      Pay when able, and at clear-cut terms you can afford.
      Otherwise you're just throwing away your hard-earned money.
      Just wait for affordable terms. Just tell them you can't afford what they're asking. You're not guilty of any crime. If they ever file a case, it's just a civil case, no big deal. It's easier to scare you than file a case.

    Your blog is such of great help! But like the rest of us here I also have some questions that Im hoping you'll be able to help me with.
    (1) I had a deliquent account with BPI way back 2008, it was around 15k or something. I used to receive few demand letters form law firm but had ignored them because of being busy at work. Until now I dont hear anything from them. I want to pay them in time though, but my concern is the company has switch banks for our payroll and are now serviced by BPI, does BPI have the rights to get into my payroll account and take a portion of it to pay the deliquent amount?

    (2) Can I still apply for another credit card from a different bank, if so, how soon can I do it? Will the deliquent from another bank's cc be not the reason for a denied application?

    1.) Looking at http://www.bpicards.com/Page/60 under provision #10, it would seem so. When you used the card you also gave them power-of-attorney privileges on "... things of value which are now or may hereafter be in the possession, custody or control of BPI..."

    2.) Yes you can still apply for another credit card any time. Yes, delinquency from any bank can be a reason for denial.

    Regarding above, may nagpunta po sa bahay at binigay sa katulong ko yung letter stating na may Total obligation daw is Aed 16,613.13 was long overdue. they will issue daw writ of preliminary attachment. so, ibig sabihin pwede nila kunin yung properties ko, if ever i-file nila sa court? actually, before po nag ask ako sa kanila na mag provide sila ng statement as proof na may utang ako. kasi hindi ko talaga ginamit ang credit card. ni hindi ko nga po pina activate. may credit card nga po ako dito sa pinas na fully paid po lagi.

    Please help me po kung anong gagawin ko. Kailangan ko bang pumunta sa PAO para humingi ng assistance?

      I guess you better clear it with the card issuer first. That should take care of everything. Ask too for a certificate that you don't have any liability with regards to that credit card account.

    Me and my wife have the same problem like others na may 2 deliquent cc. nagkadeliquent po ksi kmi dahil inuuna namin byaran yung mga mailliit na CC namin pra matapos na.. tumawag na amin yung debt collector at sabi ng wife ko bka pwede nxt year na bayran kc inuuna pa namin tpusin yung iba... ask ko lng pwede ba namin gawin ebidensya yung mga natpos nming byarin sa card if ever na ipabarangay kmi? at seryoso kmi na babayaran sila.

    i'm also a delinquent cc holder. yesterday, someone from phil star (daw) told me that they'll post my name and pic in their paper for 3 consecutive sundays and he also told me that a certain atty. rodelio punzalan paid for it. my case daw is libel. i asked for the contact number of atty. punzalan and he gave it to me. then i phoned atty punzalan, asked him about the details and h told me that it is about my outstanding debt with eastwest amounting to 73k. at first i believed them, that's why i asked if how can i settle it so that they'll remove my name on the paper. he told me to pay 20k php in that instance. i said i don't have that amount of money. so he extended the deadline until dec 24. this morning, i asked about this in BSP, i called the consumer affairs dept if it is possible for them to post my name in the newspaper. they told me that it's not. then i found your blog. with similar cases. what shall i do? do you think this atty is legit? or do i have to call eastwest directly and ask for an amnesty for my debt? hope to hear from you soon. thanks in advance.

  44. Hello, please advise naman po, re: sa Eastwest CC ko. As usual, they keep on calling on my mobile, at home and at office. Naniningil at sinasabi ko lang ay wala talaga akong pambayad. Nag ooffer sila ng convert to installment program pero ang laki pa din ng babayaran , hindi kaya ng budget ko for one month since almost 100k na ung outstanding balance ko. Sinasabi din po nila na kailangan ko magbayad dahil kung hindi, maka cancel ang account ko at masisira ang pangalan ko sa lahat ng bangko. Gusto ko talaga silang bayaran dahil nahihiya din po ako sa tumatawag sa office para maningil, kaya lang yung mga monthly amortizations na ino-offer nila, ang laki laki pa din ng magiging total. Hindi po talaga kakayanin ng budget ko. By the way, lumobo na lang po sa almost 100K ang utang ko dahil sa mga additional penalty at interest, originally nasa 60K lang po yun last Aug 2014.     Ako po ay may utang sa credit card na hindi ko nabayaran sa dahilang sobrang gipit ako sa panahong eto. Ang problema ko po ay nakatanggap ako ng summon galing sa Pasig Regional Trial Court noong October 2014 at binalewala ko po eto at hindi po ako pumunta sa korte dahil na rin sa mga advice ng mga kaibigan at mga nababasa kong articles sa ibang site. Ngayon pong January 2015 ay may tumawag sa opisina na pinagtatrabahuhan ko na isang superintendent sa camp crame at hinahanap ako subalit ng mga panahong iyon ay wala ako kaya ang manager ko ang kanyang kinausap. Ayon sa manager ko ang napag-usapan nila ng superintendent na eto na kung sakaling hindi ako makikipag-cooperate at tatawag sa kanila ay nagbanta na ipa-NBI nya ako at ipapatanggal sa aking trabaho at pupuntahan pa sa opisina na pinagtatrabahuhan ko na kasama ang NBI na may dalang warrant of arrest. Hindi po ako nagreturn call sa pulis na eto. Sa ngayon po pakiramdam ko ay parang pang-haharass ang ginawa nila sa akin. Hindi na ako makatulog at nahihiya na rin akong pumasok sa opisina.

    Ang mga tanong ko po ay:
    1. Tama po ba ang ginawa ng pulis?
    2. Sa hindi ko po ba pagsagot sa summon, tama po bang ang CIDG ang maghabol sa akin?
    2. Ano po ang dapat kong gawin ngayong hindi ako pumunta sa korte?
    3. Ano pong kaso ang maari nilang i-file sa akin sa hindi ko pagsipot sa summon? May mairerekomenda po ba kayong attorney para sa akin na bihasa sa mga ganetong kaso sa hindi pagbabayad ng credit card.

    1. How did you verify that he was a real police officer? Also, if the police really have a warrant, they'll just haul your a*s in jail.. why bother to call you?
    2. CIDG for summons on debt collection?
    3. If there was a real case, then just wait for the judgment.
    4. A summons on what charge? If for collection of money, the court would more likely just judge the case on default if you don't appear. Go to PAO (Public Attorney's Office). Also see my reply to Rez on Sept. 16, 2014 on this page.

I payed 400php monthly for 3yrs.til i reached the very last month.. Haven't received calls letters or whatevs from then, til this letter came now, and to my surprise, they are demanding me again to pay?! Should u just ignore this? The letter also tells that my NBi clearance will be marked with "pending case". Is that really possible? My prob is that i haven't secured my payment receipts, maybe some, but absolutely not all.       Go to your bank and tell them. Bring whatever document you can bring. Unfortunately it seems you didn't ask for a certificate of full payment.
      You may choose to ignore it but you already paid money for it to go away so, that's an incentive to fight for it.
      There'll be no 'mark' on your NBI clearance.

Bureau Inc. yung civil case complaint has been finalized to uz under RA8484. we are going to serve with our Investigation team after 24 hrs. as SOP. you can still hold by calling at .... and look for atty....or any legal officers avail. until 3pm. otherwise just prepare the necess docs with your lawyer for your defense. puede ba ito. they have not talked to me for my time available is 5: to 5:30 pm.       Sometimes the police gets used even if your case is not criminal. They get hired (and some of our cops love money) to get your attention.
      You should tell your parents about what's going on to prepare them and reassure them that it's not as big a deal as it seems.

  53. Sir AG. Thanks for the very informative posts. Pinagiisipan ko mag default payment on my HSBC card to avail the amnesty program. I tried calling them for debt restructuring but unfortunately, wala daw silang ganoon. Currently, my debt is 60k due to monthly interest 2k+ since 2013 siguro, my monthly payments all went to interest lang po. I was never deliquent before though I only pay the minimum amount. Now, I want to fully settle my debt but I want it to be lowered kasi alam ko po my purchases amount only to 30k.


    Question:
    1. Ano po masusuggest mo sa case ko? Hindi ko po kaya bayaran yung 60k but I am willing to pay until 25-30k at maximum kasi yun lang po talaga ang actual purchases ko.

    2. If ever I will be in an amnesty program, how can I be sure that the agreed terms will take effect. Example ( they say I will pay 30k then they will issue me a clearance but after paying they ask for another amount)

    3. How true na once you were issued a clearance that you already paid you're obligation, mawawala ka na sa list ng may bad credit history?

      1. If you think defaulting on your payments is your only recourse, just prepare for the calls, visits and all the hassle collection agents dish out until you receive payment terms you can afford. In the meantime, set aside your monthly payments into an account and let it accumulate.

      2. When you get payment terms you are amenable to, go to your bank/card issuer to inquire if the collection agency you are going to make payments to is authorized by the bank or ask the bank if it's possible you pay directly to the bank using your old credit card account. Then ask the bank if the bank itself would issue the certificate of full payment once you complete it.

      3. Your credit history doesn't get cleared. It's like failing English Lit. in college. It's up to whoever is concerned if it still matters or not.

  55. Hi AG, i also have 4 cc and 2 personal loans na di ko na nabayaran since 2012. My problem is this january lang tumawag sila sa police station mismo ng town nmin sa province and nagbigay sila ng mobile number at pinatatawag daw ako ni Fiscal Manabat from Taguig RTC pero hindi sinabi kung para saan yun and nung last october 2014 din eh may pinadala silang letter thru our barangay captain mismo. Nahihiya na ako kc ung father ko ung nag-aalala for that kc sya ang nandon at sinasabihan ako na isettle ung account ko.

    Question:
    1. Kelangan ko po bang tawagan yung number ng fiscal manabat without knowing kung bakit nya ako pinapatawag?

    2. Paano nila nalaman ang number and kung sino ang brgy. Captain nmin sa province?

    3. Ano ang dapat sabihin sa police in case pumunta sila ulit and dapat ba nilang sundin ung tumawag without knowing kung sino at bakit nila ako pinaoatawag? For safety lang ba

    4. Ano po ang unang hakbang or sino ang dapat kong tawagan since gusto ko rin nman isettle kahit paisa-isang cc kc di ko din kayang sabay sabay bayaran?

      3. You can't tell the police what not to do. But sadly some policemen would do almost anything for money.
      4. Just wait for a call or letter from the bank or collection agency with an offer for payment terms you can afford and respond to that.

      What if i'll just go to the bank and tell them that i will pay my cc limit and beg for a little interest rate para masettle na and hihingi ako ng certificate na nagbayad na ako kc if idadaan ko pa sa collecting agencies di rin nila ako tatantanan and i've read some of the comments here na kahit nagbayad na sila e kinukulit pa din sila and wala silang binibigay na certificate na nagbayad na sila? Would that be possible?

    Like all of them, I also have a concern on my CC din po.
    2 years ago po kasi may hindi ako nabayaran sa cc ko. I think that was just less than 5k. At interest nalang po yun kasi yung alam ko na amount ng utang ko is already paid.
    Now, ininform po ako ng previous employer ko na may tumawag daw sa kanila from People's Journal informing that one of their employees (ako) will be placed on the Public Notice section of the said newspaper po, at nakalagay daw po na may estafa case. Nagworry po bigla yung previous employer ko kasi sabi daw po nung tumawag e ilalagay daw po pati yung name ng company ng employer ko dati. So sila na ngayon yung pumipilit sakin na tawagan yung kung sino man nagdemand sakin na they should stop dragging the company's name. After all, 2 years na din po akong wala dun.They are also concerned na malalagay ako sa news with estafa case. Kasi as per people's journal representative, the ad is already paid na daw po. Do you think they will really do that?

    At isa pa po, wala din po silang nabanggit kung kanino ako may utang. Ang sabi lang nila may nagdemanda daw sakin from "Pascual Group of Companies". Bakit po hindi yung bank ang mismong nagdemanda?

    I hope you could answer this because this is scaring me and embarassing me to death.

      Don't worry about your name appearing in the newspaper. It's not true.
      Unfortunately, the damage has been done. You've been embarrassed and scared, which was the sole purpose of the call to your previous employer by your mystery caller.
      Collection agencies can file a case for collection of sum of money. But if they filed a case, you would receive a summons and not a mysterious call from a newspaper company.

    Help naman po, magtatanong lang po re: sa Eastwest CC ko, may outstanding po kasi akong 97K plus. Nag ooffer po sila ng payment arrangement pero magbabayad muna ako ng initial 6K, 3K, or 200 para magproceed sa monthly amortization ang balance ko... ung pinakamababa nga po is 200, pero ang monthly amortization nya ay 2,586 monthly for 60 months (5 years). Mabigat po kasi talaga sa akin ung 2,586 monthly kaya hindi ako maka oo sa offer nila, baka po kasi hindi ko din mabayaran un monthly at mag default na naman ako. Araw araw po silang tumatawag sa mobile phone at office phone ko. Kinakausap ko naman po pero yun ang paulit ulit na pinaguusapan namin at paulit ulit na ineexplain daw nila. Request naman ako ng request kung pwede bang mas babaan pa yung monthly amortization kasi hindi ko talaga kaya yung 2586, dahil may problema po talaga ako sa pera. Papadala daw po nila ito sa legal at magbabayad pa daw ako ng abogado.

    Kapag naman sinasabi ko na saka na ko magbabayad dahil pagiipunan ko pa, nagagalit sila at sinasabi na obligasyon ko nga ito mga ganun... Question po:
    1. Sa tingin nyo po, reasonable na yung payment option na ino offer nila? For outstanding na 97K, magbabayad ako ng 2,586 for 60 months?
    2. Pag nakarating pa daw sa collection agency itong account ko (collection agency daw na labas na daw po sa Eastwest), wala ng ganitong offer at sisingilin na ako ng buong amount. Hindi po ba pwede makipag bargain sa collection agency na kung magkano lang kaya ko bayaran, yun na lang ang babayaran ko?

    Thank you for making this site kasi nakaka gaan po ng loob. I have the same case po kasi about CC from Eastwestbak. Nong nag tatrabaho pa po kasi ako tumatawag po sila to avail their CC then I always refused kasi ayaw ko nga. Suddenly pina dala nalang po nila yung CC. Ayaw ko man gamitin but I tried it & nagbabayad naman po ako.

    April last year po pina resigned po ako ng husband ko para mag full time mom sa anak namin. Nakakabayad pa naman din ako until Aug. I guess. But di ko naka follow up ng payments kasi lumalaki na po. I stop using my CC NOV.2013 kasi plan ko ipapa cut off ko na yung CC ko. But di sila pumayag pag di ko raw po nababayaran ang full amount. That’s why I tried to pay & to pay until it came to the point now na di ko nap o kaya mabayaran kasi wala nap o akong work. Sakto lang din lang po kasi yung income ng husband ko for our needs. The saddest thing is dip o alam ng husband ko about these matter kasi ayaw kong ma bother din siya.

    I change my address din po from my office den sa house na po ng parents ko. Di din po alam ng parents ko na ganito yung problem ko ngayon. Di ko nap o sinasagot yung mga calls & they keep texting me until kanina I received this text: “THE LEGAL TEM WILL BE GOING TO YOUR LOCATION TO GET ANYTHING TO COMPLY YOUR OBLIGATION TO THE BANK. WE WILL POST YOUR PICTURE TO THE IMMIGRATION, DFA, NBI & TO ALL BANKS AS ONE OF THE BLACKLISTED PERSON IN THE COUNTRY. WE WILL ISSUE A SUMMON OR SUBPOENA WE WILL DO THIS TODAY. WHAT IS YOUR OPTION, MAKE A CHOICE. ATTY.FELOMINO ARTECHE LEGAL COUNCIL OF EASTWEST.”

    Is it possible po na pupunta sila sa bahay ng parents ko to do these things?

    Please give me an advice po. I am willing to pay naman but not now. I also tried to ask them for a stagard payment but pag usapan pa raw nila?? Agent kasi yung naka usap ko.

    Ngaun ngaun araw at oras na ito d2 sa boardinghouse ko may pumunta po na isang uniformed police at isang hinde nka uniform and naka motor lang po sila. Tinatawag po ang pangalan ko and asking sa mga kapitbahay ko kung d2 ako naka tira di ko lang alam kung ano nasabi nila then my boardmate entertain them and ang pagkadinig ko may inabot sila na papel at pinapatawag sa akin si fiscal Manabat same name dun sa tumatawag sa province nmin and hindi rin nman alam ng boardmate ko ung tungkol sa issues ko.

    Question:
    Ano po ang sasabihin ko if ever na bumalik ulit sila tom. or any day man?

    Dapat ko ba sila kausapin kung pumunta sila ulit?

    How will i confirm ung pangalan ng pinapatawag nila na si fiscal manabat sa RTC taguig?

    Hindi ko talaga alam ang gagawin ko

    Tanong ko lang po, may utang po ako sa eastwest credit cARD NA ALMOST 50k, actually 25000 lang po iyan lumaki lang dahil kulang ang naihuhulog sa minimum payment, until 3 months na po akong di nakakhulog, ngayon po grabe na ang pangungulit ng collection agency pati boss ko gusto tawagan, ang nangyari po kasi dito yung friend ko nanghiram sa akin ng pera na 25000 dahil may sakit ang tatay nya, sa awa ko sa card ko siya iniutang pero usapan namin siya magbabayad ng bill at ng tubo nito kada buwan, ang naging problema naman po d na nakabayad isang taon na hangang naging 54000 na ang utang ko sa credit card. ngayon po wala ako mapiga sa friend ko kaya ako naman ang kinukulit ng collectors agency, ang pagbabayad po ba ng below minimum ay pwede kong gawin para lang ma prove ko sa kanila na di ako natakbo sa utang ko, di ko po kasi kayang maghulog sa kanila ng almost 3000 a month, para lang po tigilan na ako ng katatawag sa akin ay huhulougan ko na lang po kahit 500 monthly yan lang po kasi kaya ko, kakasuhan pa din po ba nila ako, or kukulitin pa din kahit 500 lang binabayad ko? para lang po kasi patunayan ko sa kanila na hindi ko tinatalikuran ang obligasyon ko.

    I just received a letter from M.C Ramiro & Associates today saying that it's my last opportunity to settle my delinquent obligation which amounts to P 50,000. Sadly, I don't have a money yet to settle such amount, I stopped paying Metrobank since last year because I lost my job and I just got a new job last December as much as I want to pay them, my salary is not enough because aside from that, my father is sick and we need to pay for his medication. Now, the thing is, based on the letter they sent me Metrobank has endorsed my issue to a LAW FIRM which is M.C RAMIRO & Associates I believe. Before that, I called Enzi a collection agency for help though I wasn't able to send the documents they need and now here, MC Romero is the one who are now contacting me. Can anyone help me or can give an advise of what to do? I'm afraid to make an arrangements because if ever that I wasn't able to pay for what we have agreed since I am going to resign by next month on my current work due to some personal issues there. T.T helppppppp please? :(

    I have an outstanding balance from EWB CC to which i cannot fully pay it in one payment alone due to the reason that my wife is giving birth just this March 2k15 and my father was suffering a mild stroke. and now they want me to fully pay the remaining amount which is hard to pay due to short of income. What should I do. They are always calling me and keep on reminding me to pay the minimum but ang hirap na po kasi halos wla na ring matitira sa sweldo ko.

    I have 2 perosnal loans in Security Bank. One account I requested for restructuring which they only send the form cia fax and I signed it. Fortunately I had a chance to fully paid kahit di pa due. May natira kong one account matatapos siya ng September 2014. June 2014, I requested for OB which inemail sakin ng agent. Im rest assured matatapos na ko ng September. The due date arrived I settled the final M.A. I was shocked the new agent told me na may balance pa king 30k dahil narestructured daw account ko and may pinirmahan daw ako na form. In good faith ako na ndi ko inapply yung 2nd Security account ko for restructuring yung 1st account lang dahil yun yung malaking amount amd mas matagal ko oang bubunuin. Unfortunately, nagresign na yung previous agent but I still have her email of my OB as of June 2014. What should I do?

  75. please help me too.. i used my credit card 1 to 5 times a year at nabayaran ko naman lahat ng mga nagamit ko sa credit card pero i had an existing balance and that is the annual fee.. since 2012 up to present ay diko na binayaran ang annual fee plus yung late payment fee at interest so it is amounting now 6,897.51. sabi ko sa agent ipapa-cancel ko na ang card ko kasi diko na nagagamit. ang remaining balance ko naman ay mga annual fee yun.. anu po gagawin ko?

CAP - good evening po sir Argus...i need your advise po. may nagpunta po sa house ng parents ko from the brgy hall at hinhanap ang husband ko. may iseserve daw po warrant sa tuesday dahil may nakafile na 2 civil cases sa Taguig rtc. may binigay po number ng police, tinawagan ko at meron daw nakafile na RA 315 at RA 8484 para sa husband ko, pinatawag po ako sa attorney. nung tinanong ko po kung tungkol saan , sa unpaid credit card bills sa standard chartered amounting to 167K. at buti daw tumawag agad ako kanina dahil may isieserve daw na warrant at pupunta ang magsisheriff sa haus namin sa tuesday, sabi ko wala naman po kami nareceive na subpoena before. sabi nung attorney, nadecisionan na daw ng court dahil di umaatend ng hearing ang husband ko. ayaw nila maniwala na wal kami nariciv na notice at lahat naman daw po ng nakasuhan ay ganun ang idinadahilan. 2008 pa daw naifile yun.sabi ko wala talaga nariciv. nung sinabi ko po kung puede pa mag out of court settlement para wag na matuloy pagsisherief sa haus namin at gamit, ang sabi sige.since ang total price daw po ay 167k, pag 1 time payment ay 83, 857. na lang. at kung staggard payment naman ay kailangan ko daw magdeposit asap ng 33k para makapagfile sila ng motion to close the case sa taguig rtc bago mag 4 pm.saka namin pag usapan terms ng balance. imagine po na nagkausap kami ala una ng hapon at need na agad magbayad? grabe po... nakikiusap ako for an extension para magawan ng paraan at willing naman po kako kami magsettle pero hindi talaga kaya agad agad. kung puede kako hanggang katapusan. ayaw pumayag ng attorney.yun lang daw kaya nya maitulong. at ito pa po nung tinanong ko kung saan ang office nya, sabi po sa akin ay di daw nya binibigay ang address nya . at bakit ko daw kailangan. sabi ko paano po kung magbabayad kami, paano ko makukuha at mapipirmahan ang mga dokumento po? sinagot nya ako, thru email na lang daw ang mga dokumento na kailangan ko./ namin. pero ang pera ay idiedeposit sa standard chartered cc acct ng husband ko at ipafax ko sa kanya ang deposit slip para maiattach nya sa mga dokumento pagfile ng motion to close.ang tanong ko po makukulong po ba ang husband ko sa ra 315 at ra 8484 na kaso ? makakakuha po ba sila ng mga property o gamit namin? at saka pala nung tumawag na ako uli ng 33o pm to inform th attorney na wala pa kami naiproduce na 33k sinabi nya may bagong offer daw. instead na 84k ay 58k na lang ang 1 time payment. maganda po sana kaso talagang kapos po kami ngayun. nag aalala po ako na mapahiya kami sa mga kalugar namin. pero nagtataka lang ako talaga dahil agad agad nid magbayad.ayaw pumayag na sa katapusan pa ng feb.ano po ba mabuting gawin, natatakot po kami.salamat po sir..

  78. Hi. I saw your blog, don't know if you will be able to read this. It was my sister in law's case however nasa ibang bansa na sister in law ko. She was the account holder and since sakin yung nasa credit ayoko naman mapahamak siya ng dahil sakin. I was forced to leave my job due to an illness so ayun it was stopped. Yung binabayaran namin is nasa collection agency na. Biglang may nagpunta samin telling us na magfifile daw sila ng legal actions etc. Gusto niyang isettle yung 80t. Originally ang sinesettle na lang namin is 57t.. with 6180 per mo. kaso nga na stop since nawalan ako ng work. Bibigyan daw niya ako ng discount hanggang 65t dahil d daw sila collection kundi legal daw sila... for 1 week. told them na baka pwede naming bayaran yung last 5 months namin namiss na ipay and then icontinue monthly kaso ayaw niya pumayag. 5 months might be 30t. Tapos yung other 30... inaask ko kung pwedeng staggered with a lower monthly since currently I am not working and I get my means of finances due to freelancing. 30t daw this month and 30t daw nextmonth. That would be impossible for me...yun yung sinasabi ko sakanya. My sister wont pay for it kais nasa ibang bansa na siya. Makukulong ba ate ko doon? I'm thinking of sending it directly to BDO since bdo bank ko. Called them already pero di daw holder. Would want to settle it since I know responsibility ko yun. What course of action should I take? I have the same situation with the others, i didnt pay my credit card for 2 months already, the bank keep on calling me but wala akong maibayad. Now here comes this collector agent ask me to write a letter to their agency and to the bank about my situation and the reasons why i cant pay my card, he told me have also my identification card and my signature with it,para daw ma apply ko nang payment arrangement. my concern is ok.lang ba na magpadala ako ng id at signature with.them? Im just worrid baka ito ang gamitin nila sa akin if ever they want to file a case to me. Ive tried naman sa ibang cc ko.for paymemt arrangement pero never silang nag ask.ng letter, id at signature. Ok lang kaya yun sir? Need ur advise and opinion po. Thanks a lot.

May hatol na daw ang judge ng makati court. at ang masahol pa ay kasama daw ang mama ko sa kaso ko At kami daw dalawa ang makukulong. ang tanong ko po ay pwede ba akong mahatolan ng staffa?     What a great blog you have helping hapless people burdened with financial obligations and the stress and trauma they cause.

    My case was way back 2010. I had a loan from a financing co. payment of which were via PDCs. After about a year of religiously paying monthly, I stopped due to business closure. Lately, a CA sent demand letters to my former address since I already transferred. Can they file estafa/bp22 cases against me if they can not locate me?

Recently i rcve an email from a bank stating they're only giving me until end of august this year to settle my balances n umabot npo ng 700k dhil s monthly charges n more than 60k-70k. Kung hndi ko daw po masettle mag file n daw po cla ng legal complain sa akin. Under CISA law daw po. Ang worried ko po pwede po b aq mkulong dahil dko nbbyran ang debt q s cc dhil kht gus2 w byran financially incapacitated nrin po aq at nagdouble nrin po ang amount ng remaining balance q s knila.   85. Sir AG, possible po b msampahan ng case at makulong aq under RA 9051 daw po. Dahil dko po mbyaran ang balances q s security bank. From 300k lumaki npo iyo ng 700k plus dhil more than 6months q npo ito d nbbyran due to financial problem.     RA 9051 is AN ACT CREATING A SEPARATE ENGINEERING DISTRICT IN THE SECOND CONGRESSIONAL DISTRICT IN THE PROVINCE OF BATANGAS.

    But if you meant RA 9510, then that is an act ESTABLISHING THE CREDIT INFORMATION SYSTEM.

    Both don't imply that you will go to jail because you can't pay.

    Concentrate rather on earnings and savings.

Just recve a mail right now from a law firm office stating that i have to settle may ccard balance amounting to more than 500k dahil s mga nadagdag n interest, at kug anu anung charges. Sabi din po s letter n pag dko daw po nasettle with 5day ay sasapamhan daw po aq ng case stating RA 8484. Sa ngaun po wala p tlga aq pwede maibayad s knila daw inuuna q po bayaran ung ibang ccard n may mababang amount balances. Anu po b dpat q gawin? Pwede po b tlga nila aq sampahan ng case dahil s hndi pagbbyad ng ccard. Please help po. Sobrang worried at takot npo aq.

  93. hi sir AG, tanong lang po, nasa abroad na po kasi ako ngayon, kaso may naiwan po akong utang sa EW credit card ko. maayos naman po ako magbayad kaso po yung bestfriend ko po nagpaapswipe saken hanggang sa umabot na po sa malaking halaga. nagkasakit at biglaang namatay po sya. naiwan sakin lahat ng utang nya. bago po ako umalis sa Pinas kinausap ko yung asawa kaso iniwasan po ako. ngayon po after 1yr na di pagbabayad may naghahanap daw po saken from Crame sa barangay dun sa town namin. yung pinsan ko ang nakausap. may kaso daw po ako at di umaattend ng hearing. ang kaso ko daw po ay violation of article 315 & 318. pinatatawag po ako kay Ps/Ins Manuel Manalastas. nasa ibang bansa na po ako hindi dahil sa umiiwas ako kundi dahil sa nag-asawa ako. wala pa po ako trabaho dito kaya wala pa rin po ako pambayad. pero sa totoo lang po wala ako ganang magbayad dahil na rin sa hindi naman po ako mismo yung may utang nagkataon na napakabait ko at nagpagamit sa kaibigan ko. uhuhu

  96. Im also having problems same as yours and to calculate mas malaki pa sa akin. I dont know what to do. I have 2 cards metrobank 150k and bdo 260k. As of now im trying to pay at least the minimum due but i know time will come that i can no longer afford to it. I have arranged payment with bdo but the amount they are offering i cant afford to pay for it so we i was not able to make arrangements with them. The metrobank they said my account is not qualified for payment arrangement. Im afraid that when my loans reach law office im afraid that someone will call or go to my office. What should i do? Why these banks ayaw pumayag na stop ang interest and to pay them 2k a month until i fully paid my balances? Pls help po thanks in advance

    1. Hi Melissa,

      If you cannot afford to pay anymore, then just set aside the amount you can afford and wait for any amnesty deal that you think is good for you. Of course you'll get harassed along the way and you'll just have to grin and bear it. So yes, you can stop paying. The only catch is that your credit reputation is bust. You'll have a hard time with bank loans or even postpaid line applications. Or maybe not. But one thing is sure, you're not up for any jail time if that's the worst you can imagine.

Do u think metrobank and bdo will file a case? If not a small claims what kind of case? If civil case i-file sakin would it cause my removal from the government service? Thanks a lot for helping us. If only i have a means to pay them like 7 years ago i will but now my salary is not even enough to pay my minimum due. im so worried thanks a lot.

Do u think due to non payment of cc will cause removal from my work in government? Im not sure if theres a law about it that involves public school teachers who can be remove from the service due to non payment of cc debts. Another po ive read from ur above post that banks usually dont file cases if its less than 100k but mine po is 150k and 260k more than the limit and dalawa pa. If only i have the means to pay it i will like 7 years din akong nkakabayad ng outstanding balance. Do u think metrobank and bdo will know both that i cant able to pay them na then magkampihan cla to file a case aginst me. If civil case po i file sa akin what will happen to me po?       I don't think credit card debt will cause your removal from work in government.
      Banks don't usually file cases for credit card debt period.

      Maybe you can still work it out with your banks.
      Whatever the amount, the civil case (if they file) is for collection of sum of money. The end result of which is an agreed upon terms of payment.

    5. Thank u so much for giving ur time to us with ur pieces of advice. I tried calling both banks asking for restructuring my account. Metrobank said im not qualified while bdo the terms and amount they are offering is too short and i know i can't afford to pay for it for now. I dont want to sign an agreement that i cant keep. This must be a lesson learned for me. After 7 years this is the only instance happened and i was hoping that banks would be considerate to offer me terms i can afford.I dont know what scandals will kotong collectors do in my work and in residence to the point il be humiliated to my co workers and neighbors but i dont have the amount(15k+ a month for 2 years) to pay for now.
      But as long as it will not affect my work when im financially capable in the future i can pay them. About harrasments BSP regulations states they cant do that. Im so much thankful that u created this blog. I am praying that all the people here will surpass all the humiliations and stress. More power sir AG and Godbless po!

    i also have issue with my cc. payment was stopped for about 3 mos because of financial issues. i was informed by the bank that may account was endorsed to external collection agency. i got a call from that agency and was offered for a discounted price payable only for a period of days. i told them that i cant pay the full amount but i am trying to pay them kahit paunti unti. would it cause any trouble kung ndi ko iavail ung binibigay ni agency and just continue to pay sa abot ng makakaya ko?

    I need an advice for my mom. Recently po may tumawag sa barangay namin saying na may nagreklamo sa kanya (breach of contract).Tinawagan namin un number na binigay for clarification then atty po un sumagot. Regarding po pala un sa CC ng mother ko 2009 pa. Nagkaroon po kasi kme ng financial problem. So sbe ng mom ko hnd sya makakabayad dhl wala na syang work at retired na po sya. Dun na ngstart un pananakot,may ppunta daw na pulis sa bahay, dadamputin na lng sya, etc. Na trauma po si mama, then ang next na ginawa namin is mkpg settle sa bank, tinanggihan kme since nsa collection agency na daw. Si sa takot nga nun mama ko na makulong napa agree sya na mgbayad ng 3k monthly for 36 months which is hindi naman nya kaya dahil wala na syang source of income. Is there any chance na masampahan sya ng kaso dahil hnd sya nkpg bayad dun sa agreement nila? Estafa na po ba un? Willing to settle naman kme kaso hnd talaga kaya un 3k montly. Ayaw po pumayag nun agency.

    Than may pwede ba namin ireklamo un "attorney" na nanakot sa mother ko?

    Please help po kasi pa almost senior na si mama so bka pti un health nya ay madamay.

      A civil case for collection of sum of money, not estafa.
      If you can't afford to pay, stop paying. Re-negotiate. You can email the agency if you want, advising them that you are stopping payment. Just don't believe everything they tell you.
      For your guidance in negotiating, see this: BSP Advisory.
      Here are some of the key points to consider which are included in the above advisory:
      - Only the credit card issuer can give Final Approval of any type of repayment scheme...
      - Both the credit card issuer and the cardholder should sign on the Promissory Note.

      You may file a complaint against the 'attorney' for unfair collection practices. Specifically - Threat to take any action that cannot legally be taken - (telling you the police will come to haul her to jail); and 'false representation or deceptive means to collect or attempt to collect any debt' (if the person you talked to falsely claims he/she is an attorney.

      It won't likely 'conflict' with your Pag-Ibig housing loan application. Loanable amount is based on your membership contributions and is a secured loan, if you don't pay, they get your property.
