Credit Card Woes - The Letter

Now that you’ve figured out how to deal with that credit card collector on the phone, expect them to start pushing up the ante. The battle has now been joined, and they’re now ready to unleash one of the most effective weapons in their arsenal, The Demand Letter. Just one of these if received unprepared - especially the first time - is enough to bring a grown man down to his knees in surrender. So let’s gear-up and find out if there’s a reason to fret about this threat.

Most credit card demand letters come in two types.

One is the pretty straight-forward type, specifying how much you owe, a reminder of the contents of the credit agreement, plus a bonus threat regarding what action they’re gonna take against you.

The other kind of letter is more indirect in its approach but nonetheless more potent. It is formatted to look like an official civil/criminal Complaint ready to be filed - or to the impression of some - already filed in the appropriate Trial Court. No wonder people who are uninformed and unfortunate enough to get one of these would seriously contemplate on how much painful it would be if they were to jump off a building.

So before you jump, allow this to sink in: You’re not in trouble, it’s just your impression. So CHILL! (repeat as needed)

Let’s look at excerpts of a sample Credit Card Company Demand for Payment:

Dear {Your Name}:

Our client, {Your Credit Card} has referred to us for appropriate legal action your total unpaid account of {Your Debt Amount} as of {Date} representing purchases and usages made thru your above-stated Card, inclusive of finance and penalty charges, as well as collection fee.

Under the terms and conditions of the Card member’s Agreement,
{they now quote the small print at the back of the credit card agreement you so happily and excitedly signed a couple of months or years ago}

Despite repeated demands, you failed to pay your said account, hence, we are formally serving this DEMAND for you to pay in full your said unpaid account, including all charges within FIVE (5) DAYS from receipt hereof. Otherwise, we would be constrained to CRIMINALLY PROSECUTE YOU for Violation of R.A. 8484 (Defrauding of Creditors) if the evidences warrant and/or CIVILLY CHARGE YOU, for Collection of Sum of Money with Prayer for Attachment, before the (Regional or Metropolitan) Trial Court of {City}, in order that you may be penalized with imprisonment including the recovery of litigation expenses and judicial cost, as applicable, and twenty five (25%) percent attorney’s fees, without further notice and delay.

Please consider this as our LAST and FINAL DEMAND.


Scared you the first time right? Now let’s take it apart!


1.) They’re demanding that you pay in full within 5 days?! - Ridiculous! If you don’t have money, you don’t have to pay. Why? Because you can’t! No need to borrow from anybody. It will just get you deeper into debt.

2.) Their asking you to pay in full the principal plus the charges which continuously accumulates every month! - Again, Ridiculous! You weren’t able to pay last month’s balance so how could you pay for it now when it’s higher than last month’s? I’d love to see them jack it up into the millions and let’s see if they’d be able to collect anything by then.

3.) Criminally prosecute you for Violation of R.A. 8484 – now don’t focus on this sentence, focus on the next – if the evidences warrant. Now that’s a big IF!

- So what kind of evidence would warrant a violation of R.A. 8484? Let us quote:

A cardholder who abandons or surreptitiously leaves the place of employment, business or residence stated in his application or credit card, without informing the credit card company of the place where he could actually be found, if at the time of such abandonment or surreptitious leaving, the outstanding and unpaid balance is past due for at least ninety (90) days and is more than Ten thousand pesos (P10,000.00), shall be prima facie presumed to have used his credit card with intent to defraud.”

Ergo you're off the hook!

Why?

How?

Because you're holding that letter. Which means you could actually be found. And as for you not informing them, - the fact that you're holding that letter is the best evidence that you did inform them, - if you did move. Let them prove otherwise.

- Is that paragraph all that R.A. 8484 contains?

NO - but that paragraph is all that could possibly apply to you! The rest is all about credit cards (and other devices which they call access devices) fraudulently obtained. Like if you used a fictitious name to obtain the card, or you used a stolen card. But if you did all that, I don't think getting a demand letter is what you'd be worried about.

So the fact is, a demand letter works to your advantage. It has your name on it. It says that you were honest and upfront when you obtained that card, but unfortunately you can't afford to pay right now.

If you really had any intent to defraud, do they think you'd be stupid enough to have used your mother's house as the billing address?!

4.) Civilly charge you for Collection of Sum of Money with Prayer for Attachment – They can but they won’t. Why? It would cost them more than the amount you owe. And the most likely result would be a settlement. With you paying maybe less than what they’re asking for. But do you know what’s really stopping them? BAD PUBLICITY.

5.) Consider this as our Last and Final Demand – Well, I have a friend who has a box full of these.

OK! But what should I do when I do get one of these?! – Get a big box.

    ask ko lng po ngxt po skin ung legal officer po ng hsbc e2 po ung txt nya po skin "be reminded on ur payment on march 15 amounting to 23k as fullpayment of ur hsbc accnt under ur sbc card no.If u fail to comply,we cant offer d samediscounted amnt,istead ur balance will revert back and immediate filing of cases will b filed against u since u already receive our demand letter prerequisite for dfiling of a case.iyan po ung unang txt po..karen

  6. magkakaroon po ba ako ang bad record sa NBI dahil cc na di ko natuloy bayaran noong 2006 at lumipat ako ng haws kaya di ko narereceive demand. mga 20k lang amount ng cc. ngayon ay na stroke ako at walang work at walang pambayad. salamat.

    Im paying my mom's CC and even though we already have a signed agreement with BPI, we still receive monthly billing statements. Our original debt is about 200k (w/ penalties, interests, etc), the amount now soared to P900k. We're past halfway for the payment arrangement but we have to focus now on my mom's upcoming heart operation. BPI said that if we fail to pay everything on the contract (P200k), then they will revert our original balance to what is the current running balance (P900k). I know of a case raised in Supreme Court deeming that the penalties and interests placed by CC companies are too much and thus considered void. But what can we do? We're still paying our monthly dues and we're hoping to be able to pay everything before the agreement ends by 2014.

  8. hi...i do have a problem i haven't paid my cc for almost a year now. and just now me pulis na pumunta sa bahay looking for me dahil they were contacted daw po ng quezon city police...and now hindi na din kasi ako gano umuuwi sa home town ko...and i haven't answered or talked dun sa mga tumatawag sa akin...considered as defraud ba un by not talking to them and answering them back?

      No. But most of the time they consider avoidance as fear. And they know that a person who is afraid is more likely to cough-up some money. That is why they try to use more of their scare tactics on people who scare easily.
      Just answer the phone when convenient. Don't be afraid. It's not the caller you owe any money to - no matter how angry he seem to get.

  9. in addition me number na binigay sa akin na tatawagan ko dun sa police...ala na din ho ako balak na kausapin sila...since ng me tumatawag sa akin na mga credit collectors hindi ko na din ho sila kinausap...what will happen po dun..pa advise na lang po if what ang dapat gawin dun...

  10. hello sir ag... s pagbbigay nio po ng advise sa mga katulad kong cc holder, ngkalakas po ako ng loob n ibahagi ang naeexperience ko ngaun..
    i'm a hsbc cc holder, unfortunately nwlan aq ng work since jan of dis yr. lagi po nila aq tinatawagan & last 2 wiks nga po ay my dinala po s kin n demand letter ung messenger ng law office. at pinabbyaran po nila s kin amounting 2 100K plus... kinuha din po nila ung # q para makausap nila. Nung una po ay bngyan nila aq ng 3 options, lump sum payment wid disc., at ung 1 po ay 2 payments only & last po ay 1 year 2 pay. sinabi ko po s kanila n hindi ko kyang bayaran un ng gnun klaki at kahit po ung last option nila n staggard payment for 1 yr ay d q kya kc nga po ay unemployed aq. Nakiusap po ako s knila n kung ppde n kahit 2k monthly ay mgbbyad aq para lng po my pumasok n payment s account, kya lng po hindi po sila pumayag, d daw po ppyag ang hsbc, ano po gagawin ko... nahihirapan n po tlaga ako, palagi ko pong iniisip ung panakot nila n idedemanda nila aq...

      Don't worry too much about it.
      As you said, it's all 'panakot'.
      Worry more about getting a job.
      Your credit card debt should be the least of your worries.
      The collectors may make it sound as if your debt is that urgent. But it's not. You not having a job is what most urgently needs your attention.
      Once you have a job, then you can focus your attention in paying.

    We regret 2 inform u dat we will finally bring to court for judicial action the complaint against u, due to your failure and refusal, without valid ground, to pay your debt to our client, HSBC. We will civilly charge you for collection of Sum of Money under the rule on Small claims Cases, which requires one(1) hearing only, and any court's decision rendered is immediately final and non-appealable. Or to criminally prosecute you if legally warranted, for violation of Republic Act 8484 also known as Access Device Regulation Act of 1998 where defrauding of creditor is one of the prohibited acts penalized under the said Act. If you are interested in settling your account before the date of filing of appropriate complaint in court.

      It's better if you answer the call whenever convenient. You're right, they'll just keep insisting you pay. Therefore, you in turn just keep telling them you don't have a job yet. It's their turn to feel hopeless when they think of you.
      But if you let them feel you're hiding, they become imaginative and start harassing other people you know like your family or neighbors just to get your attention.

      I guess by now they would have filed the case if they really intend to.
      As I've always said, if you've got no money then obviously you can't pay. So relax. They'll figure out that they'll just be wasting their money filing a case against you.

I have same scenarios with the other credit card holder, pero gusto ko na din pong itanong, meron po kasi akong credit card from BPI i have 20k credi limit, i was remember year 2009 or 2010 i receive a demand letter from SAULOG and De leon law office to pay my outstanding balance, i remember is 14k something,I called the SAULOG and De leon Law office for the settlement, i told them that i cannot pay the full payment, pumayag sila na ndi buo ang bayad ko, I remember nasa 10k or 11k un binayad ko and pagkakalam ko eh nasa 3k nlng ang balance ko.. and then po i forgot to pay the balance and i receive the bill statement of BPI every now and then at lumaki ng lumaki na nnman ang outstanding balance ko, hanggang dumating na po sa 250, 000.00 na ngaun 2014. Ngaung sir nakatanggap na nnman po ako ng demand letter kahapon feb. 20, 2014 from SAULOG and De leon law office, telling me to settled my outstanding balance, kasi ng po idedemand na for trial court..i settled ko nga po for 5 days prio.. Ang tanong ko sir, need ko po bang tawagan un SAULOG law office o un mismong BPI para kausapin tungkol sa settlement or ididisregard ko nlng un demand letter nila.. at posible po bang un dati kng balance eh un nlang ang bayaran ko..? please i need you help advise sir.

    Just read all the blogs, but my problem is kind a different, I own a ccard way back 2001 and still single then, I requested fora change in my civil status and name but still no action till present, I still used my card with my maiden name, but due financial problems I was not able to pay it anymore I called the bank to settle but they want me to issue a post dated check for the payment but I don't have a checking account, I am willing to pay them and settle my utang but I cannot issue a check..I receivd a letter from a lawfirm that if I will not settle the amount they will file a criminal and civil case against me... what shall I do ?       Check your card's Terms and Conditions. It would be mentioned there if the bank can offset your payables against your deposits, etc. in case of default. It would also be mentioned there if you are giving the bank the authority to inquire about deposits you may have with other banks.

    please enlighten me, i was caught by a collecting agent and forced me to sign a promissory note If dont comply kakasuhan na nila ko? They insist to write a letter na indi ko kayang bayadan un utang ko at pumapayag akong mademanda, kinausap pa ko over the phone i signed promising to pay 15k as partial payment, even though i can't pay.
    can i pay less than that. I'm asking to settle in stagard arrangement pero masyado na daw matagal un account ko. I signed but I had no plan to comply for that 15k as partial payment whereas my account was at around 20k lang... please help T_T

      I don't think they will file a case against you.
      It's just for 20k.
      Just don't get into the habit of signing anything they shove into your face. They forced you? Like with a gun? You don't have to sign or do anything they tell you. They are just collectors. Tell them you have to show it to a lawyer first. Just write 'received by' if you feel compelled to write something.
      Anyway, just charge that to experience.

    I am new here. I am a single mother of three. I have a 400K credit card debt from one international bank here in the philippines. I've been a credit card holder since 1998 and have never defaulted. However, this year I've lost my job and and I got sick. No more income, I've been borrowing to pay for my debts. This somehow made me dug my grave deeper. :-( I do not have the means to pay anymore. I have no properties and no one to borrow from anymore. I've asked a few people with this situation and most of them are telling me, I've no other option but to default and wait months before I receive a settlement. Is it true that I have to default first before getting a settlement offer. I am planning to pay for settlement but cannot in the near future.

    I am trying to pick up the pieces and start anew but for now I have no chance to start again with these debts and interest charges.

    Please enlighten me as this is the first time I am going to do this.

      I guess you would have to default. Credit card debt should be the least of your worries for now. Collectors will try to scare you but if there's really nothing left to take, then there's really nothing to be afraid of.
      It's ok.. eventually everything turns out great.

  32. Hi. I have a loan of like 11k, due to some unexpected reason i lost my job... I have already notified them that i can't make the payment right now but iwill make the payment if I already have the funds. I was just scared because she mentioned to me that they have friends working in the NBI and it would be difficult for us to process the clearance if we will not pay... Is that even possible? Without them filing the case or if they already filed a case will it still stop me from getting an nbi clearance? Btw, when i filed the loan i did not sign any contract or terms its just a piece of notebook stating the amoubt and mode of payment... Thanks!

      You can get an NBI clearance anytime.
      If she mentions NBI clearance again, tell her you won't be able to pay the loan if you can't get a job because you can't get an NBI clearance.
      Avoid 5/6. You need to see more Hollywood movies or read the news. Like the one that happened in Pangasinan where a money-lender-cop shot the teachers and his collector. I bet "...they did not sign any contract or terms its just a piece of notebook stating the amount and mode of payment..."

  33. hi gud am,im a working mom but my salary is not in miminum and the cc i have now is we filled it up thru phone call ni hindi kami naka pag sign sa form nila yon lng then after 1 month dumating na yong card nila. 1 year na akong di naka pag bayad since august cause due to my pregnacy na cs kasi ako kaya hindi ko na nabayaran yong cc ko and they always keep on sending me sms like civil and criminal complaint for violation of article 315 and etc. may tendecy po ba na pag hindi ko sinittle yong account ko pupunta po sila ng bahay at kukunin yong mga na ipundar namin na gamit or sheriff po nila yong gamit namin sa bahay since nag rerent lng naman kami?? please do help me.. thanx ipyang

      When you used the card, it means you agree to the card's terms and conditions. It does not require that you signed an application form for it to be valid and binding.
      Can they go to your house and get your things? No.

  34. Hello. I have a case for my husband. He took out a loan for my mom in 2007 thru Chinatrust since we checked they have the lowest interest rate. My mom and him had a personal agreement that she pays for the loan. Hubby lost his job in 2008. Payments were inconsistent but now everything is getting destroyed. I am trying to sort this out this collection agency BERNALES LAW FIRM and a certain ATTY NENA VERANO who speaks to you directly without you being represented by a lawyer and telling you that she can only spend 5-7 minutes per call to know your decision. I asked them not contact my husband until we are able to work out this matter. Now they have contacted him last Tuesday and my husband has already threatened to kill me if I show myself to him. He is being asked to put down 30k as lumpsum and pay monthly. His original debt was 57k. Around 70k plus including interest. However, he is now "forced" to pay 390k. I feel that previous payments are not acknowledged. Please help because hubby has cut paying the tuition fee of our children in favor of this debt which I feel he shouldn't be paying at all because its too much. Please help.

  36. Hi argus gable.. he hasn't negotiated anything yet. But this has gotten into his nerves. according to the BERNALES AND ASSOCIATES they won't accept monthly payments alone. They need the 30k as lump sum. I wanted to go to Chinatrust directly. Would you help me find a good lawyer to help my husband be enlightened that he can still work this out.

      If you want legal advice or mediation try ndvlaw.com. I heard their fees are affordable. But I don't know anyone there personally. Just give them a call and see what goes from there. One thing with lawyers, always ask if they're billing you for the conversation, and if so, how much.

      Not true. That would be very expensive for them.
      But what they're doing is considered unfair debt collection practice.
      Part of the BSP regulation on debt collection prohibits:
      a.) the use or threat of violence or
      other criminal means to harm the physical
      person, reputation, or property of any
      person;
      c.) disclosure of the names of credit
      cardholders who allegedly refuse to pay
      debts,
      d.) threat to take any action that cannot
      legally be taken;
      e.) communicating or threat to
      communicate to any person credit
      information which is known to be false,
      including failure to communicate that a
      debt is being disputed;
      f.) any false representation or
      deceptive means to collect or attempt to
      collect any debt

      If he calls again, tell him you are recording your conversation and will file a complaint against their company to the BSP for unfair debt collection.

  39. good am. i applied nbi clearance yesterday, as a requirement for travel abroad. I got hit.

    i have an unpaid credit card bill sometime 1995. i got married and left the house where i used the address during the card application. however, the house is owned by my aunt so any letters from the company will still be received.

    this january 2015, my aunt handed me a letter from a certain collecting company asking me to pay a minimum of 30k, where my credit due balloooned to 70k. if not, they will file a case against me, under RA 8484.

    when I applied for an nbi, i am now using my husband's surname. when i committed the non payment of the credit card bill, i was still single.

    Is it possible that this is the reason why i got a hit in my nbi application?

    tanung kulang po sana i have unpaid cc 2009 pa po tapus last week nakatanggap ang parents ko letter fr. attorney na pinapabayad ako 65k agad agad, ang tanung kulang po bakit parang multo at nagising nanaman sila akala ko wala na po dahil almost 6 yrs na nakakalipas, isang tanung kurin po wala po kaya effect sa pag aapply namen papunta Australia with my family ako po kase principal sponsor natatakut po kase ako baka magka problema ako pag kukuha nang mga govt. documents tnx po.

    naka-receive po ako today ng letter from Molaer Law Office stating na I should settle my accounts within 2 days I received their letter. May naka-attached po na another letter na sinulatan nila ang Metrobank na ina-advise nila ang Metrobank na sampahan ako ng civil case under small claims court at idadamay nila ang husband ko sa case. Ang outstanding balance ko po ay 34 thousand including the accumulated interest. Hindi po ako nakabayad kasi inuuna ko po ang medication ng husband ko na may kidney problem. Informed naman po sila before sa situation, kasi sa pangugulit nila hindi ko na po sinasagot ang phone.

    Itutuloy po ba nila yun case, kung matuloy man po ano po next action nila against me kung hindi po talaga kaya magbayad kasi inuuna ang medication ng husband.

  42. Hi Argus, in 2004, i left manila for d u.s. Becoz i lost my job. I had credit card debt i left with 100k balance. In 2006, a collection agency said my balance was already 1 million due to interest and penalties , u tried to pay 10k /mo for 36 months but they not accept my offer then i never called them anymore and my kids received collection letter until 2008 when my kids left our place of residence becoz it was foreclosed by another bank. I just learned in 2011 that my money in two banks were garnished by the bank of my credit card that i owe but it was only 5k. I think they did file a case against me in court but i or my kids have not received it becoz the cc company doesnt know where to reach us. Can they file case for RA8484? I have had my card with them for 12 years b4 i defaulted due to loss of job. If i go back to manila , will they arrest me and be imprisoned? What should i do? Will i have a hold departure order if i have already been convicted of ra8484 ? What is my best remedy? Should i negotiate to settle with bank to erase my case? Thank you! Lulabelle

    Ask ko lang, di ako ang cardholder pero meron tawag ng tawag sa akin sa bahay which probably ginamit na add ng malayo kong kamag anak when he stayed with us ten years ago pa. Naiinis ako dahil ako ang pinipressure nila sa utang na di naman ako ang may gawa at pumupunta pa sila sa bahay para ibigay ang letter a hindi ko naman tinatanggap. Ano ba ang pwde ko gawin para tumigil na sila at na iistress ako dito sa bahay. nadidistorbo na nila ako. by the way wala na rin ako contact sa kamag anak ko. Can I sue them or isumbong sila sa BSP? para tumigil na sila? thanks

  50. additional lang po sir..... nasa 20k po yung limit ng card ko ngayon nsa 34k na dahil po sa.mga interest at penalty nagbabayad nga po ako monthly kahit 500 lang nitong mga past months kahit alam kong walang pupuntahan yung 500 ko..last july d nkabigay ng 500 kya may demand letter na ako wala naman po akong balak na hindi bayaran dahil ang utang po is utang nagkataon lang po na ang hirap ng sitwasyon ngayon may nag nagpayo po kasi sa akin na kahit ignore ko muna at ipunin ko nalang yung mga ibinabayad ko monthly at pag ok na saka nlang ako kumontak sa banknor collecting agency willing to pay namn po ako kung sakali bibigyan nila ako ng chance makapagbawas ay 300 monthly lang po kaya ko sa ngayon...tatanggapin po kaya nila offer ko?..:) salamat po sa time nyo sir God Bless

Den, meron din po akong EWB CC, den by nakapagbayad pa ako till august ng boung amount due. It so happen na nagresign ako s job dahil walang mag alaga ng anak ko, di ko na po magampanan ang work ko. In short nawalan po ako ng sources sa pagbayad ng both CC. Ung naloan ko nmn, pinagkatiwala ko sa bff ko pra sa negosyo nmin until last january nagconfess xa na pinautang nya raw sa fren nya. Superstress ako dahil un lang ang tanging mapagkuhanan ko sana ng pambayad sa mga CC ko. Last dec, tumawag c Citibank kz d na po ako nkpagbayad. Almost 11k ang hinihingi, den dahil wala akong work wala akong pmbayad. So collection agency na nagpafollow up sakin, so cnabe ko sa knila ung status ko. Den, lage na po ako nkatanggap ng calls from both CC.Till sa kakulitan nila, i told na magpakulong nalng ako kz wala tlga ako pmbayad.Nagpalit ako ng number.     Need your advice po... meron po akong credit card loans sa Citibank pra sana sa isang negosyo last july 2015 amounting to 114k. Den, meron din po akong EWB CC, den by nakapagbayad pa ako till august ng boung amount due. It so happen na nagresign ako s job dahil walang mag alaga ng anak ko, di ko na po magampanan ang work ko. In short nawalan po ako ng sources sa pagbayad ng both CC. Ung naloan ko nmn, pinagkatiwala ko sa bff ko pra sa negosyo nmin until last january nagconfess xa na pinautang nya raw sa fren nya. Superstress ako dahil un lang ang tanging mapagkuhanan ko sana ng pambayad sa mga CC ko. Last dec, tumawag c Citibank kz d na po ako nkpagbayad. Almost 11k ang hinihingi, den dahil wala akong work wala akong pmbayad. So collection agency na nagpafollow up sakin, so cnabe ko sa knila ung status ko. Den, lage na po ako nkatanggap ng calls from both CC.Till sa kakulitan nila, i told na magpakulong nalng ako kz wala tlga ako pmbayad.Nagpalit ako ng number. Den last week (sep), my co-worker inform me na may naghahanap daw from Camp Crame, police officer viray and atty. Pamaos. Nsa crame na daw po kasi ang kaso ko, RA 8484, defraud... posible po bang makulong ako sir? Kasi ang sabe sa RA 8484, intented to defraud if they ako nag inform sa knila na wala na ako sa workplace.     I hope you can still answer my query. So I has an overdue loan with Robinson's bank which has now been forwarded to collections. The agents kept on calling me and my mom and I have been really cooperative. I remember the remaining principal bal to be at 17k. In the demand letter, it said 35k total with interest and penalties. I wanted to close the account so I decided to pay little by little.

    I made a 10k payment last December to the account number provided in the demand letter. I was advised that payment will reflect this Jan 2017. After several follow ups, they finally sent my SOA and told me that I need to pay 15k to close my account.

    However, after checking the SOA, I noticed that the account number there is different from the one previously provided to me. My bad that I was not able to remember my previous account number (payroll acct).

    I asked them why there are 2 diff acct numbers and why is it that my 10k payment did not reflect on the SOA. They said that it's because the 10k only went to penalties. I told them that even so, it should have reflected on the SOA. Also, they told me that the account number previously given to me is my updated acct number because they have updated the system. But now that they are asking me to pay another 15k to close the amount, they are telling me to use the old account number which is what's in the SOA.

    I have insisted that they revise the SOA to reflect my previous payment but they told me that if I insist in doing so, they would increase the required payment to 25k to close my account.

    The law firm is Lauron Delos Reyes and Partners. By this time I have already insisted that all our conversations should be made via email as I was able to get more sensible answers there and it's in black and white as compared to when I answer their calls and the collections agent always seems unsure and dubious.

    They are asking me to pay 15k to close the account. I am willing to pay this amount just to settle everything but I'm afraid that it would again go to nothing. The collections agency gave me until March 17 2017 to settle the 15k. I have emailed them again clarifying if they would give me any documentationfor my future payments kasi ayoko magaya lang dun sa 10k na walang pinuntahan.

    All I got is a response from the external agency representative of Rbank saying that they have already explained this before (referring to the 10k explanation). Then she told the collections agent to prepare an endorsement letter because my account is now for case filing.

    I now feel like she is not really a bank representative and is just mainly trying to scare me. It's annoying that they feel like they can trick you because you don't know what they're doing when in fact you do feel that they are just trying to manipulate you.

    Now, my question is, do you think naloko ako into depositing that 10k? because they have repeatedly refused to have it reflect on my SOA. Na nakakapagtaka.

    What can you advise to be my next step?

    I have emailed them again today asking if they would still file the case if I pay before March 17 but they didn't reply to me anymore.

    I hope you can advise me. Please. Feel ko kasi pineperahan nila ako because I'm too willing to pay. I'm 3 months pregnant that's why I don't want to be stressed but I also don't want to pay and pay people who are just taking advantage of me.

      For your guidance, take a look at this: BSP Advisory.
      Email BSP with your complaint together with attachments of whatever documents you have and call them for advice on what you can do to correct the situation and to put a stop to this agency's nonsense. BSP contact details are in the link above.

      Don't worry about them filing a case. They should be more worried about you filing a complaint. In that note, next time they bother calling, tell them you are pursuing filing a complaint (yes, say filing - even if you already did file) if they don't do what you're asking them to do.

      You're correct in your assumptions and subsequent actions. You were wrong in being too excited to pay without written documentation of terms of payment.

      So file you're complaint, save your payment money, and be excited about something else - like your coming baby.

I have may eastwest cc before but since nawala un wallet ko together with my phone pinacut ko un cc ko and im not sure kung nacut ba yun kasi ayaw nila pumayag until masettle ko daw un balance ko. Then hndi ko na binayaran since problematic ako that time and nawalan ako ng work.. What should i do.     May pumunta sa bahay, taga barangay namin, pinapapunta ako sa barangay kasi may nag file daw sakin ng estafa, hinihintay ako, isasakay nako sa sasakyan nila. walang dalang subpoena, ang dala, kapirasong papel, mali na name ko na nakalagay. Sinabi na hindi na daw pala, kakausapin nalang daw ako nung prosecutor sa cellphone, binigay ng taga barangay yung cellphone nya, nkausap ko yung tao sa kabilang line, prosecutor daw sa barangay namin, sabi ko, para saan ung pag punta nila? may nag file daw ng complain sakin, estafa. sabi ko, sino, atty daw. mag fifile daw sila ng case, then mag rerelease ng warranty of arrest. Sabi, ko, tao ba yan o ano? di nya alam, sabi ko sa credit card yan. sabi ko, medyo nagulat siya, mukhang hindi niya alam, kausapin ko nalang daw yung nag file, para ma clear name ko sa brgy. sabi ko, hindi ko nga kilala eh. saka, now ko lang narinig na may warranty of arrest dahil sa credit card, as is yung address ko, mobile number, wala ako work, so wala nko sa address ko sa company na nilagay ko. ang gagawin ata i arrange nila yung pag haharap nmin nung taong nag file at ako sa barangay, cge sabi ko, arrange nyo, pupunta ako. yung mga taga barangay sa labas ng bahay namin, mga 6 sila, sabi ko sa credit card yun, nagulat din sila, nakakaawa yung mga taga barangay, akala nila accomplishment yung pumunta sa bahay at makita nila ako, hindi nila alam na credit card. akala nila estafa sa tao. umalis din sila.

    May 2 accounts po ako sa metrobank at parehas pong 7 mos ko ng hindi nababayaran dahil nawalan po ako ng trabaho. Umabot na po ng mahigit 60k at 300k ang sinisingil sa bawat isa kasama po ang mga kung ano anong interest at attorneys fee. Monthly po akong nakakareceive ng demand letter pero lagi ko po silang kinakausap at pati sa banko nag nag explain na rin po ako kung bakit di ako nakakabayad thru email.

    Ang huli ko pong nareceive ngayong april 26, 2017 ay dated pa po noong april 18, 2017 at ang sabi sa letter ay "mag fafile na raw po sila ng complaint for collection of sum of money with prayer for preliminary attachment".

    *Question ko po makakasuhan po ba ako at posibleng makulong sa laki na po ng utang ko? Isa po ba sa basehan nila ay kung gano kalaki ang utang? Kanina po sinabi rin nila na mag sasampa sila ng reklamo sa brgy, pwede po ba nilang gawin yun?

    Nakaka stress na po ng sobrang lalo ngayon na buntis pa ko nag aalala po ako ng sobra.

  64. Hi, a police officer came to our neighboring barangay and theyre looking for me i talked to the police officer over the phone why theyre looking for me. He told me a credit card company filed a case against me and i cried because im so scared the case is RA 8484 they were surprised when i found out that i dont have any idea that someone file a case against me. Then he gave me a number of a fiscal who is handling my case i talked to the fiscal over the phone and he told me about the case and the banks wants me to pay 173k then i told him i cnt afford it then he talked to the corp lawyr of the bank and give me a 50prcnt discount and have to pay 74,000 only but still cnt afford it on that day. Worst i havent receive a subpoena or summon so i asked him he told me that they mailed it twice but no subpoena at all. Maybe theyre just making stories that i havent received it para ilabas na nagpalit na ako nang address. At sabi nila may pupuntang sheriff sa bahay namin para hihilain mga gamit namin. D daw makikialam mga pulis at brgy officials. Need your advice po.

    I'd like to share my current case also. I was paying my monthly installment from Feb 2016 after I signed a Promisory note from the bank which mentions the RA no.8484 as well. I stopped paying Nov 2016 after I resigned from work in October because I was to be married abroad the ff month.I wasnt able to pay since then and when I came back April 2017 I got an email stating Final notice from a Collection Agency telling me to pay 89k or else they will file legal action against me.I am pregnant and jobless right now but I called the collection agency and settled to pay half of the amount. While the other half is to be paid on installment. I paid half of the 89k today.I will be leaving the country next month and there is no definite period as to when I will be back. I am concern if they will be able to take any personal property to recover payment.Though unfortunately I dont have any under my name. How far can they go once they use the promisory note I signed to file legal case?I am worried about it also.I was thinking if I can just settle with the current payment that I have made since I dont have a job to pay the remaining installment.I am preparing for my delivery and I need to save also for that instead of paying the balance. They said they will be sending another document that I have to sign for the installment agreement. What should I do? Please advice. Thanks.

    I was a credit card holder of HSBC years ago and nagkautang po ako ng mahigit 15k pesos last 2010. It's been 8yrs now at hindi ko pa nababayaran dahil sa sobrang laki ng sinisingil nila sakin,nakiusap ako na kung pwede kong bayaran for 4mos.pero gusto nila within a month mabayaran ko in full. Wala po akong pera at trabaho noon. Ngayon po aalis ako going U.K. ang tanong ko po..pag nasa UK na po ako hindi na ba ako makakapag apply ng credit card doon? Kasi maalala ko last 2017 I open a savings account in BDO and tinanong ako kung meron ba akong existing account na hindi na bayaran so sinabi ko meron po sa HSBC,pero nakapag open naman po ako ng account and checking account noon sa Eastwest bank last 2012. Na aprobahan naman po maliban sa credit card na kinulit sakin sa isang mall na pina fill - up ako ng form and I signed it pero alam ko na hindi rin ako maaprobahan dahil nga po sa HSBC ko.

    So now, I am being bombarded with calls and texts but I didn't answer any of those for the sole reason na alam ko namang tatakutin at ihaharass lang nila ako para magbayad e ang siste ay nagaadjust pa ako sa finances at wala pa talagang capacity magbayad.

  82. Hello po. I have question about Robocash Loan. I receive an email saying na magsasampa po sula ng case against sakin dahil di ko daw nababayaran and they want me to pay 18k in 5 days. Tapos po binigyan pa nila ako bg discount na pwede daw maging 15k nalang ung babayaran ko at kung di ko daw kaya kahit 5k muna then saka an ung 10k. Galing po sa Panlilio credit and collection service ang email. Makakaapekto po ba sa paglabas ng bansa at sa nbi ko ung small claims na Fi-nile nila? Saka sabi din nila mag coconduct daw sila ng visitation sa work ko. Please help. Naguguluhan po ako kung legit talaga ung email kasi wala naman ako narereceive na call from them thank you po.

    Last year, sa Manila po ako nagwowork and then nagappl kami ng kaworkmate ko ng credit card and naapprove, and ang nlagay kong billing address don is my present address which is in Manila, pero nilagay ko din dun yung permanent address ko which is ditto sa Batabgas. Nagresign ako sa Company ko sa Manila kase kinasal ako and nagkababy hanggang yung utang ko sa CC ko ay di ko na nabayaran. Lahat ng statement of account ko is di ko na narereceive. But I emailed them na nagpapabago ako ng billing address. Can they criminally prosecute me for violating the RA 8484

Hello Banker!! so glad I searched online and found your new hang out blog.. since 2015 pa tong cc defaulter issue ko.. and today, Sept 24 2019, I received a letter from RTC national capital judicial region, a letter for notice to comply with writ of execution.. I signed the letter po kasi akala ko yong usual incoming sulat tapos I can not see clearly pa po without my reading glasses. Nagulat na lang ako sa content, giving authorization ke sheriff to demand immediate payment sa said utang amounting to 414k. kung wala akong mabigay na pera e pa levy upon the properties of the judgment obligor of every kind and nature whatsoever which may may be disposed of for value etc etc.. Bankerr? what can i do at this point? Do i have the power to let the sheriff in here? wala akong personal properties, i am only living in this house. my uncle owns this place. meron lang akong desktop computer, electric fan, one smart phone. Kukunin po kaya nila ito? Can I not just let them in the house or do they have the right na po with that writ of execution? and most of all, i do not have any bank account whatsoever. I have a job na just enough to take care for myself and my daily needs po.. Pls advise. Ms. Purple68

      If there is a writ of execution, that means there was a judgement on a case they filed (and they won). But do you remember being served? (summons, etc.?) to go to court? If not, the writ of execution is more likely to be another bogus document.

      You normally also should have first received a notice of the decision.
      I also don't think your signature is required to 'authorize' a sheriff to execute a writ of execution.
      I think it's safe to ignore.
      Verify from the RTC if that document is legit for your peace of mind.

  87. Banker, naka sign na ako nitong writ of execution for a sheriff to come to where i live and do his job of getting my things. Sapilitin po ba ito? Do i still have the right na hindi papasukin si sheriff ? I signed the letter thinking it was a usual letter, and not about my cc defalcating isyu. Hindi ko inattend and hearing kasi sa Luzon ang hearing and i am in visayas. wala akong pamesa and place to stay dun. Pls help po. I suddenly got very sick after the reading the letter.. pls advise.

Sir AG, magandang araw po, may citibank card po ako then dumating yung araw na nahirapan ako magbayad and after 5mos na cngilan kinausap ako ng law office ng citibank na update ko daw ng 10k para d na daw lumala at ma prevent ang legal actions against me and para daw d ko i shoulder yung attorney fee na kasama sa mga late charges penalty and the whole amount na lumobo sa 280k constant naman nila ako nakaka usap kaso ang hinihingi nila amount ng money more than sa kaya ko at even rent ko sa bahay hirap ako, anu po gagawin ko, ddemanda na po ba nila ako? Sir Argus, tumawag po citibank sa akin ngayon and pinagagawan ng paraan na pay ko ng 16k and discount nila ako ng 16k and revert daw po account ko kasi for case filling na daw po account ko, naka ilang tawag skin ang law office na partner ng Citibank, pero talagang inamin ko po na talagang hindi ko kaya magbayad sa ngayon dahil sa financial crisis, sabi ng law office na humanda daw ako sa consequences ng bank dahil pang 6mos na wala pa din ako bayad lumobo ng 290k bill na dati 150k lang, natatakot po ako mag ffile na daw po skin ang citibank ng case sabi ng tao ng citibank anu po gagawin ko talagang wala po akong pera kahit na anu na maibabayad skanila

      It's ok if you really have no money to pay right now.
      Just thank God you didn't borrow from the Triad or the Mafia.
      If they do file a civil case, which I doubt, the worst outcome of that scenario would be the judge telling you to pay. Same thing right? It won't be the firing squad or someone blowing up the jeepney you're riding.
      Collectors are more active now - they want a piece of that 13th month pay.
      You're drinking too much coffee.
      Drink milk, get enough sleep, stay healthy, save.

    in the US i understand consumer protection initiatives raise the alarm about banks lending at easy terms to those who may not be qualified. it is still profitable for them, charging say, 10% losses, against a revenue of more than 30% interest rates per annum...

    short of telling consumers... go and max your credit cards, stop at P100k or 200k, a level at which it is not profitable to pursue the card user.... we should at least slap wrist of banks giving away cards with little checking and getting them in a deep hole.

Hi, i have a question kasi i own a union bank cc before pandemic 2020,if i remember correctly my billing statement said 45,000 but due to pandemic i am not able to pay my CC since i we got locked down then i got into a car accident and got jobless...nakaka recieve ako ng emails of demand letter but i just ignored it kasi i dont have the means to pay tlga..kasi it sky rocket to 123,000 in a span of just more than a year... Just recently i recieved a draft complain letter that they will use to file to court...i am really scared about it...what should i do? I am really scared because my family doesnt know about it.

    1. Scarednfirl,
      Best thing to do, is to tell your family or whoever you think will probably receive a call or letter or be there when the collector visits. Otherwise they just panic and get unnecessarily fearful when they learn about the issue and the news would sound way worse if they hear it from someone other than you first. If you're calm and ok about it, they'll be calm and ok too.
      You'll probably discover as I did, years ago when I had your problem that family members are often better in answering calls or engaging visitors as they act protectively, while you probably can only stare and blink when confronted 'coz as you said - you're 'really scared about it'.

      You'll be fine.

      If you've read the article above, you'd know there's not much you need to do.
      If you get nervous thinking about it, think of something else, like how to earn money.

      What to do with the email? File, print? Up to you.

      As for deleting your gmail, now I'm glad you only received an email, but now I'm also curious on what you would've thought of if you received an actual draft complaint letter delivered to your home address. Burn down your house? Is it okay to do so? You think that would stop them from looking for you?

      This is not about escaping or running away. It's that whatever tactic they use to make you feel nervous or scared, is actually just that - but it's not going to get any worse than that.

      The worst thing that can happen already happened in your head.

I am willing to pay them back but im only going to pay the initial amount that i left with them. Its around 50k but the fees that it accumulated i think its not makatarungan anymore...is it ok if i do that? I tired calling the CC Company but they didnt entertain me the operator only told my to txt my name, card ending number, and contact number to the number they have... Which i do so but nobody return the call...i dont want to call the molaer law firm because i know that 25% of the amount they are telling me will be given to them that so unjust..am i right MR.AG?

      Right. You've done your part, leave it at that.

      If you really can afford to pay that much at once, it would be better to contact the bank's recovery department directly and tell them you're willing to settle. You can also tell them you can only afford to pay the balance without the interest. Your goal is to get a bank clearance. Getting that bank clearance stops all the nonsense with the collectors and clears your name so you are able to avail of any bank loans you may want to avail of in the future (housing, auto, etc. and yes other banks check if you're in a list of defaulters)
      Do this ONLY if you can really pay with money you have right NOW. Don't be contacting anyone if it's you promising something you hopefully are to get sometime next week or next year.

      Make a plan - which hopefully does not include deleting your gmail, changing your name, or shaving your head. (unless of course you broke the collector's neck)

      Don't let your actions be motivated by fear - especially in this case - it's just credit card debt.

Upon evaluation of the files submitted they are accusing you a Case of RA 8484 Access Devise Regulation Act of 1998 (small claims- ESTAFA) under the Republic Act 315-318 Person who received Money/ Assets in particular Banks/Financial Institution may held criminally liable for other deceits, this will serve as deterrent on your awaiting transgression punished under 315, paragraph 2(a) of the Revised Penal Code, and the accused can be punishable an indeterminate penalty of imprisonment ranging from (4) years and two (2) years.     They initially asked me to pay 50k as a discount for the debt i have. However if I refuse, i need to pay them 70k for 12 months.

    10k downpayment
    6k for 11 months.

    They sent me an agreement letter in which I havent signed because I could not pay for it. May you please enlighten me with the letter? They called me and said they will take this higher if i cant pay the 70k. I have tried to negotiate w them if possible to pay lesser because i am not earning as much - just enough to feed myself and rent.

    May unpaid debt po kasi ako sa cc ko gamit yung surname ko nung dlaga pa ako and hindi kopo nabayaran dahil sapat lang ang sahod ko noon..ngayon po after 7 years may nag email po sa sister in law ko sa messenger hinahanap po ako SP Madrid Law firm daw po ang kontakin ko meron daw po ako important message na need nang immediate attention ko daw po. May nag add din po sa akin sa FB SP madrid po yung account hindi kopo inaccept and sinabi kopo sa sister in law ko na i block nalang yung nagmessage kasi nagtataka po ako sakanya nag message yung sinasabing law firm.     Madami po akong CC na hnd nabayaran. They texting,calling and sending demand letters telling me they will find a case (RA8484). Wala na po ako sinasahod since madami akong bayarin lalo na nung nagpandemic. Hindi ko po kasi sila pinapansin since wala pa po akong pangbayad. Magkakaprob po ba ako obce na kmuha ako ng NBI. Since lagi nilamg cnasabi na kakasuhan po nila ako.
