Credit Card Woes - The Visit

After battling your way through those irritating phone calls and reading those heart-pounding letters sent your way by the mighty credit card collection agency, we now come to one of their more effective collection strategy. The home or office visit.

By showing up in a place where you feel most safe and secure, they hope that they’d be able to shake your steely resolve with one thing that frightens us all – public humiliation. So, they come out in a van with screaming bold letters on the side exclaiming – DEBT COLLECTORS – much like those pest exterminator vans you see around.

How to fight it? There’s only one thing you can do. And that’s to just grin and bear it. Because even if you can complain in court for harassment, there’s no way you can undo that day when they came. But there are a lot more Don’ts.

Don’t get scared. That’s what they’re hoping you’d do.
Don’t let them in. You can talk to them outside. Unless they have a court order which I doubt. If you’re in the office, tell the receptionist or the building guards not to let them in the next time.
Don’t let them pressure you into signing anything.
Don’t take their insults personally, they're just doing their job the best way they know how. So ignore the drama and you might even find it amusing.
Don't agree to anything immediately. Just get the details and tell them to give you time to think or consult a lawyer about it.
And finally, don’t stop your big dog from barking.

  1. Hi I am also in the same predicament--am over my head with credit card debts. I just realized that I got woed into having 7 credit cards. Before they didn't bother me at all. But with a housing loan on top of it, I am really way deep in debts. I still manage to make payments. But it is getting harder every month. I have read about debt consolidation, debt elimination on the internet. But I don't think we have that here in the Philippines. Anyway, it just feels good to hear that I'm not alone on this situation. But I don't want to reach the point when I have to deal with the threats and insults from collection agencies. More power to you! I enjoyed reading your thoughts on credit card woes. I will try to work things out with the credit card companies and negotiate...and just pray...after this, I won't use a credit card ever again!

But I have a question, in my case the bank i owe to is based in Dubai (Standard Chartered Bank) and they have authorized a collecting agency to recover the amount I owe which is also way over my head. Do they have legal grounds to prosecute me under Philippine Law?

  4. They have a court order? To do what?
    You get a court order if there's a case filed. If there's a case filed, you would have to know about it. If you don't know anything about a case being filed against you, then I don't think they have a court order.

Nakahanap n ko work with sister company ng previous work ko, hindi ko na inform yun cc agent na nawalan ako ng work and yun new work ko. Pro nakatanggap ako ng call recently hinahanap ako and sinabi ko na di na connected sa company. Pasok po ba yun sa RA 8484?

  6. hi there guys! im also in the same situation.. credit card depts.. natatakot na nga ko minsan kc dami ko na rin na rereceived demand letter... hay... buti na lang nabasa ko mga comments d2.. khit pano na relief ako hehe! ask ko lang pwede ba kong makulong dhil di ako nakakabayad? yung dumating kc sa kin demand letter kakatakot galing na daw court yun.. may civil case# pa... totoo kya yun? sabi pa nung tumawag sa kin hinihintay na lang daw nila court order for property search.. di na ko makatulog dhil d2.. help me naman pls... ano sa tingin nyo???

  7. Hi. Same as the others, I am also in a CC dilemna. My CC spending was only less than 100K but not it has ballooned to about 400K+. Would it make any difference if I keep a periodic payment in small amounts? At least I'm showing them my willingness to pay even at an amount even less than the minimum. Please comment. Thanks.

    thank you for all the informations you shared, very englightening, however, marami pa akong gusto malaman, how about b.p. 22? kapag sobra ka bang lubog na sa utang, ay wala na ring lusot kundi ang pagka kulong, kasi wala ka na maibayad, wala ka na ring pang compromise, pano na kaya ang mga anak ko?

    I hope na mabigyan mo pa ng magandang insight ang concern ko.

  11. hi..im also in the same predicament..i have 4 credit cards and it all amounted to 600K because of interest and finance charge..its very frustrating and im beginning to be paraniod of what to do..can they file a civil case against me bcoz of the amount??pls..reply soon..

    Sad to say, but yes they can file a case against you regardless of the amount. Maybe even just to make an example out of you. Hehe.
    Just remember, don't be bullied into agreeing to payment terms you can't afford. You'll be in deeper trouble. If calls get nasty, remember it's just an agent who for all we know may even be deeper in debt than you are and could just be venting his frustration on you. If you get a visit, read carefully what you sign.

Hello again, im a girl with Credit card's i just want to share my experience...may pumunta kase sa office namin na from collection agency and she will give me the agreement for the payment pero sobrang laki ng binibigay nila..and di kaya ng 250/day kong sweldo, and dinala nya ko sa Baranggay nearest in my office coz hindi ako nag sa sign sa Agreement nya..ayun pina blatter nya ko tapos, pina blatter ko din xa..kase nung una mahinahon naman yung voice nya pero nung sinabi ko na di ko kaya yung payment na binibigay nya, tumtaas na yung boses nya..kaya pina blatter ko din xa ng harrassment...ayun the other day yung collection dept. na pinagtatrabahuhan nya, tumawag sakin and they will give me the terms of payment na kaya ko..ng walang pinipirmahan na agreement..ayun..but on my other CC tinawagan ko na mismo yung bank para makiusap.pero still they want me to call in the law office. hay kakaloka...and may situation in this bank is this, nung nagamit ko xa, hindi ko talga nabayaran coz of financial problem, hindi ako nakatawag sa bank coz naging busy ako to do something and to find a money, tpos ngayon nung tinawagan ko sila, ki question nila yun na bakit daw hindi ak tumwag,..ayun..actually honestly naging iba-iba na ata statement ko with them and the law office kase ang kulit nila..and gusto ko kase mabigyan ako ng lowest promo...my question is may dapat ba akong ikatakot with that...Salamat po sa Answer mu sa last comment ko..

  15. hi, i also got 1 credit card...i sum up all may payments since i started with it..and found out that i was able to pay almost 30K...and my credit limit is only 20K..do i need to pay my outstanding bal? they keep on sending me demand letters and visiting our house..im very afraid because i dont want to be in jail because of this...

  16. I would say paying off credit card bills on time makes a lot of difference in our credit reports. If we can pay it on time it will show up as a positive point on the report.:)

    Tnx for such a wonderful uplifting blog... it really gives me relief... upon writing this, i got a txt msg frm stating " this regards wid complaint filed by credit committee of the bank. they held a meeting for delinquent accts and ur name was being included. they decided to formalizes a possible case under CIVIL n CRIMINAL CASE (credit run away & estafa), circulation of ur name for CMAP & BAP blacklisting may happen, an add'l 30k from ur outstanding balance as computer downloading fee. Kindly call at (02)4682842 for inquiries and payment options." that's the exact words & letters, is this true? can this really happen? your comment would really be appreciated... meanwhile i'll just do your advice... many thanks!

  18. Hi im currently working in a call center and I am the one who supports my family. when i first had my credit card i was paying on time and i never missed a single month. Unfortunately i am not earning that much i have to prioritized our needs. I maxed out all of my cards and it came to a point that I wasnt able to pay 1 of my cards. It's been a year already and the last time I talked to the collections agency, my past due is already 50k but my debt is only 15k. I tried to contact the bank at first and they were able to give me terms that I can pay. Sadly they wont agree on the specific date that i can do my payments. Im scared most of the time because i am getting harrassing phone calls from this agencies. I dont want to run away from the CC but i cant afford to pay such big amount. I just dont know what to do anymore... I dont want to end up taking my own life just to solve all of my problems... :(

    Taking your own life because of a credit card would be a little too drastic.
    If you've read all the letters on this page and all the other pages in this series, you'll realize that your case is not unique. And some people have it even worse than you.
    Your cross is something you can bear.
    If they call or visit you, well... it's just a call, or a visit. It's their job.
    Don't take it personally, although they try to make it personal like calling you names and insulting you. If you think they're too much, you can even file a complaint.
    If you haven't read Conclusion, then read it. If you have, read it again.
    Life is good.

    i made the biggest mistake of my life
    dahil sa sobrang takot ko sa mga collecting agency... napapayag nila kong mag sign ng agreement to pay my debt.
    i agreed to pay my debt amountung to 55K on december 15... i just wanna know argus... if i failed to pay that amount on the date we agreed upon... ano sa tingin mo ang unang unan nilang gagawin?

    what do you think should i do?
    please help me... give me advise please.

    Now don't think you're the first to have done that so expect the same series of calls or visits but they could be more persuasive as they have that signed document of yours.
    But as your debt is below 100k, they could only go to a Small Claims court for recourse.
    I think your situation ain't worse than before you signed that document. (Unless you signed a check)

    if they filed in small claims case.. may matatanggap ba ko letters to informed me na may complaint? may chance ba ko manalo?

    possible pa din ba na idemanda nila ko at hindi sa small claims case nila ipasok kaso ko?

  25. Hi,

    1.) Estafa is a complex case, just signing a promissory note and not being able to comply with the conditions stated therein may not be enough grounds to be convicted of this crime. There are other determining factors. Just don't get into the habit of signing documents with a promise to pay. If they want you to sign, just tell them to give you a copy and that you will then ask for your lawyer's advice before signing.
    2.) If they filed a Small Claims Case, you will receive a summons to appear in a Small Claims Court.
    3.) Do you have a chance of winning? A Small Claims case is not about winning or losing but more about settlement. There are no lawyers and the judge just acts as a referee.
    4.) Can they file the case other than in a small claims court? Yes, but filing a case is expensive, and add to that the lawyers' fees plus the more likely outcome is a settlement. These are the very reasons why the small claims court was created.
    5.) Small claims courts do not handle criminal cases, so no, you won't go to jail.

  27. need help po, the molaer firm tex me , they get my properties if i cant pay my personal loan at standard charterd, originaly my loan amount is 75k, three yrs contract and will end 16 dec 2009, but i was not able to pay from march to may due to the compny im working is in slow down, at nagtangal ng tao, buti lang di ako natangal, pero we work 3 or 4 days a week, kaya hirap ang buhay. tanong ko po can they realy comfiscate my properties?

  31. sir AG, nagloan po ako sa standard chrtrd, and they let me open a checking acount sa other bankm para doon ako mag deposit my payments, and they ask me to issue a check unitl december 2009, nandun sa kanila yung lahat nang check, nagyon iwas not able to deposit my payment to the bank due to financial prob for two consicutive month, kaya na close young checking acount ko, then they said i have to pay directly to standard, every month, and pay additional 200 php for every check each month, ginawa ko naman, kaya lang nung global crises struck, natigil naring ang payment ko, ngayon for 4 months, ngayon the molaer low firm is demanding to chose 3 option to pay, 120k php, 6 mos. to pay, 50k php, 3 mos to pay and 23k php instant cash, di ko naman kaya yung term nila, i tel them i will avail option 3, but in due time, so they let me pay 6k advance, but only 2.5k lang kinaya ko, the next mos, pay naman ako 1k, then 500 php the preceeding mos, din i ask them for my statement of acount, wla naman sla bnigay, at prang nagalit pa ata nung mingi ako sa acount statemnt ko, ngayon 2 mos. nko di naka pay, they treatened me na they will enforce the law so that i will feel them and the law, to get whatever property i have, can you help me Mr. Argus, pls advise me of what to do... sorry po f msyado haba letter ko... thnks that i found this blog site and you Mr. Argus... tulungan nyo po ako.

    Maybe off-duty cops or guys claiming to be cops but definitely not real uniformed policemen. That's beyond the call of duty. :)
    Better prep your mom and the rest of the household that things are less serious than they look and tell them to just give these collectors your contact numbers if you're not home.

    One element that could qualify an act as estafa is deceit. Like issuing a check to pay for something but all the while knowing that the checking account has no funds to cover it. I don't think that element of deceit is present in your case.
    And do the math. Their real demand is just 23k. The cost they have to cover just to file this case for estafa is I think already 10k. And the court might rule for you to just pay a fine.
    So forget estafa.

Thanks for having a blog like this, My mom is really bugging me of the number of collection letter being sent to me, i always tell my mom, even if i want to pay, e how can i pay i dont have enough money to pay. My earning doesn't suffice the needs of my 3 kids. Iam not running away or trying to escape from my debts its just that i don't have and not capable of paying at this moment. I always get nervous everytime letters reach my place... it's good thing i read your blog, i feel relieved that nothing bad would happen to me... Thanks again Mr.AG

      You don't have to force yourself to come up with the amount on the said date.
      Don't get too affected by what he is saying.
      That deadline is for him to collect. Not for you to pay.
      So expect more calls and more threats. No need to negotiate at this time.

      It's better if you answer the call.
      Keep in mind that he's trying to scare you.
      It's all scripted.
      Some of what he'll say may be personal attacks but don't get affected as it's not his money you owe. He's just play acting.
      Try counting 1 to 10 in your head first if you feel you want to react to what he's saying. He'll do most of the talking then. And you avoid prolonging the conversation and you get to say just a few words like Hello, ok, thank you, bye.
      Not answering the call might just encourage them to escalate their tactics like, calling your office, house, and talking to anybody who does answer.

      It's no big deal.

      They could check but there's a higher chance for it to get approved. A Pag-Ibig loan is a secured loan, your house is the collateral. Plus you're an active paying member. Of course it won't help if you go telling them the details of how bad a payer you are.

  42. hello...i was informed by my mom that a police visited my hometown..actually i'm not staying there that much and ng bigay ng number sa akin na contakin ko dahil they were contacted by the police of quezon...ala na din akong balak na kausapin sila at baka me masabi pa akong mali at madali kasi uminit ang ulo ko...so hindi ko na din kinakausap ang mga collectors na tumatawag sa akin..is it okay na di ko na sila kausapin po?...thank you...

    Hope you can enlighten me on my problem!
    I have the quite the same dilemna. But mine is non-payment of credit card in UAE (Dubai). After more than 3 years of working in Dubai, I lost my job so I decided to go home (Philippines) in 2011. I have left my credit card unpaid.
    Recently, according to my family, a kagawad in our barangay came looking for me and informed my family that a person called them informing them about my credit card debt.
    So I asked my parents to give my number to whoever called. I was contacted by a secretary of a collection agency and asked me to pay my credit card debt.
    They are saying they will send demand letters to my parents and I told them they cannot do that since I was the one who has the debt and not my parents.
    They sent me an SMS informing me I have to pay less than 90000 pesos. And sent an email as well and I quote from the letter, "FINAL DEMAND is hereby given to you to pay in full your unpaid account within five (5) days from receipt hereof. Otherwise, our client shall be constrained to file the necessary criminal/civil case in the courts of United Arab Emirates (UAE) which may lead to penalty of imprisonment, as the case may be, as you have submitted to the laws of the non-exclusive jurisdiction of UAE."
    Do they have legal grounds to prosecute me here in the Philippines under Philippine Law? What worse could happen since I am not capable of paying that huge amount?

      Yes, they can file a case against you here.
      What's the worst that can happen? If you stay here, then not any worse than what everybody here are experiencing from collection agencies. But I'm not sure what would happen if you go back to UAE, as they have a different law or process with regards to credit card defaulters.

    natatakot po ako na baka bumalik at pumunta pa sila sa baranggay namin.. natatakot pa po ako baka mapahiya ako lalo at yun kapitan dito ay tito ng asawa ko...
    ano po ba dapat kong gawin hindi po ako mapakali... hindi ko alam kung paano nila natunton yun bago namin address.. plano ko naman bayaran pero hindi pa po sa ngayon dahil walng wala po ako...

      A: This is exactly the purpose of their visit. To scare you and to embarass you. So that when they ask you to pay xxx amount in 5 days, you would sign an agreement just to see them go.

      2. sa tingin niyo po ba pupuntahan nila ako dito sa bahay... at may kasama pang pulis?

      A: That's always a possibility. If they do, just don't do or believe anything they say. Someone I know dealt with it by looking so happy to see them, shaking their hands and kept smiling the whole time. His neighbors thought they were old friends who came to visit. But not everybody can do that.

      You might not be able to avoid having those feelings of shame and fear. But feelings go away. Charge it to experience.

      There are more important things in life to worry about.

    Thanks sa blog mo.. I was surfing the net about this "demand letter" from CC collection agency & I'm glad I found ur blogsite... But pls bear w/ me, I need to attend to my newborn baby so I have not enough time to read all the comments for now... Let me just ask the following questions please:

    1) My credit balance (accdg to my BDO cc statement last Feb 6, 2013) was 67k only -- DUE IMMEDIATELY since my last payment was Nov 2013. However, to my surprise, I received a demand letter this morning from ENZI Corporation (BDO colection agency based in Davao City), informing me of my cc outstanding balance amounting to 84k!!! When I calculated, 25% was added to my original outstanding balance of 67k based on BDO cc statement acct! Is this valid? Are they entitled to add 25% to my existing balance?

    2) Is it ok if I just pay any amount per month direct to BDO until I pay off my 67k balance & ignore/not negotiate w/ ENZI collection agency?

    3) Do I have to pay the original 67k or the 84k demanded by ENZI?

    May tanong lang po ako na halos limang taon ng gumugulo sa akin at sana po ay matulungan nyo ako. Dati po akong nagtatrabaho sa isang company at may multiple CC bago magresigned dahil sa kawalan ng titingin sa anak ko dahil ang nanay ko ay nagkasakit. Lumipat din po kami ng tirahan dahil nademolish ang dati naming tinitirahan. Sa takot ko po sa mga tumatawag nagpalit ako ng number,dahil alam ko naman kahit mangako ako wala din akong maibabayad dahila asawa ko lang ang nagttrabaho, Way back 2009 pa po ito.

    Sa ngayon po,gusto sanang bayaran ang cards ko kahit one at a time. May trabaho na din kasi ako at para po maiayos din ang pangalan ko. Medyo malaki na kasi anak ko at di na alagain kaya na ng nanay ko bantayan. Alam ko po na nasa collection agencies na ang accounts ko. Ang kinakatakot ko lang kasi ay ang tumawag sa bangko. Baka kasuhan nila ako ng fraud,kasi di ko sila nainform ng pagreresigned at paglipat ko ng tirahan,plus changing of number pa.

    Gusto ko pong isettle ang mga utang ko pero natatakot naman ako balikan nila ng demanda at baka di pa ako makakuha ng amnesty dahil ipapanakot nila ung di ko pag inform ng contact infos ko. Simpleng empleyado lang naman po ako na sumasahod ng minimum sa ngayon na gustong magbayad kahit papano.

    Sana matulungan nyo po ako. Gusto ko lang makatulog na ng maayos. Limang taon na po akong walang maayos na tulog dahil pag naalala ko,di ko maiwasang di matakot. Maraming salamat po in advance and God bless!

    2. pano po ba ang proseso kung gusto ko ng magbayad,the safest po at di mwawalang parang bula na lang ang binayad ko kasi na-scam lang ako. twagan ko na lang po ba ang bank kahit way back 2009 pa po ung utang ko? wala na po ako narereceive na col or text kasi i changed number na and i even tranferred work and residence na po. Just want to clear my name,just for the sake of my job now, baka kasi masira ang name ko at matanggal ako. Ung totoo po, teacher ako now, sa government. Hinintay ko lang po maging stable ang finances ko kasi di ko naman balak tumakbo.       If you have multiple credit card liabilities which you maxed out, start on the account with the smallest credit limit. Go to your credit card issuer and ask them how best to deal with it. At least if they direct you to a collection agency, you'd know that the agency is legit.

      1. Ask for a discount. You shouldn't really be paying more than your card's credit limit.
      2. Keep copies of your duly notarized payment terms. Keep your payment receipts.
      3. Tell them you will need a certificate of full payment once you're done paying.

    I have money to pay my credit card. CJM is handling my account. How will i know if they are legal and not bogus, also, if they will waived my debts after paying the amount stated on the contract agreement.

      You could ask your credit card issuer (bank) if they have any info or advice regarding your payment plan/contract agreement with CJM and if the bank itself can issue you the certification.
      Better yet, ask your bank if you could still make your payments thru the bank under your old credit card account. If they agree (in writing, notarized), just fax your payment receipts to CJM instead of you paying directly to CJM.
      If the bank says they know nothing about CJM or if they say they can't issue you a certificate for payments made thru CJM, well there's your answer.

Good day sir AG,3 years ago tumawag ako Sa citibank regarding sa credit card ko gusto ko na kasing ipa cancel that time around 70k ang utang ko pro I promise na babayaran ko Ito within 2-3 years pero di sila pumayag Kung gusto ko daw bayaran ko muna ang whole amount kaso lang di ko kayang bayaran ng bou kaya that time wla akong nagawa,after a year pinadalhan na naman nila ako ng panibagong cc kaya tinawagan ko kaagad sila sinabi ko na huwag na nilang I renew d nanaman sila pumayag kaya last year I decided not to pay it starting November kasi every month tumatawag ako as kanila asking for amnesty pero palagi nilang sinasabi try to call next mos.baka May offer na as of now Wala pa talaga "kaya tinanong ko yung citibank representative Kung ano ba ang qualification para mabigyan ng amnesty pro wla silang sinasabi basta ang palagi lang nilang sagot Sa akin "as of now ma'am active kasi ang accnt mo may natatanggap daw sila na bayad kc po kahit papaano nagbabayad ako ng minimum amount or mahigit pa.last feb.may na receive ako na demand letter from citibank at email din galing Sa 24k law firm demanding me to pay the amount of 107k,di k binayaran ang hinihingi nila na amount kasi may problema ako Sa financial.TOday may natanggap na naman akong demand letter galing Sa 24k Europa law firm na kailangan ko daw na bayaran ang buong halaga or else they will file a case with imprisonment of 6-10 years.i hope matulungan mo ako Kung ano ba dapat ang gagawin ko.makukulong ba ako?Sana po you will reply.thank you

      1. No need to call the CA. If you already can afford to pay, approach your bank first for proper guidance.
      2. Whatever you did pay since July as you said would already have been credited to your CC balance. The interest charges though would have effectively erased your payments though as it continued to accumulate when you stopped paying regardless of whether you have been using the card or not.
      3. Whether they can trace your husband or not, one day he'd be spending a quiet day at home and you're at the supermarket and he's gonna answer the phone and the CA is on the other end.. what then?
      Your CC balance ain't your problem. That's nothing.
      If I was your husband and you couldn't tell me?! hmm..
      You remind me of Cadet 1st Class Aldrin Cudia. He said he ain't lying, unfortunately he didn't tell the whole truth either... and he got thrown out.

  52. I sir a I also have a same scenario like the other blogger. I have a cc which I don't pay for about 4 months and now the CA molaer law office been bugging me and my family about my unpaid cc. Kanina lang may nagpunta ng messenger dito sa bahay nataon nman na nka leave ako ngyon kaya ako yung nka tangap ng demand letter. Sa una natakot ako sa nabasa ko pero buti may blog na ganito. Since natanggap ko na yung demand letter kinausap ko na din sila na 5k lang kaya Kong bayaran pero Di sila pumayag since 87k dw ang utang ko. Pwede po ba akong magdemand skanila ng amount n kaya ko lang bayaran?

Until now wala sila binibigay na status sakin. Hangang sa lumaki na yung interest kaya isa un sa dahilan bkit Di ko na binbyaran ang cc ko. Kpag pumunta ba sila sa office ano ang pwede kung sabihin skanila?

      If you can't afford the offer then wait for another offer.
      They can file a case but they never really do that.
      You could tell them you filed a dispute form or how nice the weather is, anything. Nothing will change - because they never really care. They just want to collect. So let them worry about collecting while you worry about yourself and getting back on your feet.

Di ko alm isasagot ko since ang laki n kc ng amount at isa pa sabi nyo Di rin maaayos yung pinapa dispute ko since wala nmn silang pakialam dun, so meaning Lahat un included sa mga babayran ko. At sinabi nya sakin na ka kausapin ng atty nila yung mngt na pinapasukan ko next week. Natatakot ako sa mga pwede nalang gawin since 1st time ko makaencounter ng ganito. Kinulang lng din tlaga ako sa pangbayad kc nagkasakit parent ko. Please help me how to handle this kind of CA and how to answer their questions correctly yung Di nila pwedeng gamitin against me yung mga sinasagot ko skanila.

      If they ask you if you have plans to pay, then tell them 'yes of course'.
      Tell them you can't afford the amount they're asking as you have other obligations.
      If you're afraid the CA will call management then go to HR or your manager and tell them first. Explain your situation. This way, they will understand and they will know what to expect if the CA does call.

  54. Hi! Just want you to know about paying your deliquent accounts or credit card. Honestly, I would like to introduce na isa ako sa mga Agent ng Banko. Or specifically a Collections Assistant. Maybe I can help you since regarding with your questions.. :)

    1. Always KNOW you credit limut..syempre if alam mo lang yung credit limit mo at mataas yung sinisingil sa inyo. Ask for DISCOUNT. Meron po yan. Diba nga AMNESTY ang tawag nun.

    2. If may demand letter po kayong natanggap, maybe you should call that Agency. And ask if any other options, or pwede rin niyo din sila tawagan and ask if legit sila ng banko and tanungin niyo po yung customer service hotline for your credit card. Always 5 digits lang ang hotline ng banko. Not 7digits.

    3. If minumura kayo? Better ignore them :) kasi the more magpapaapekto ka sa mga katulad ko. Mas lalo kang natatakot.

    4. Hwag kayong magpapaapekto if may pupunta sa inyo at haharrassin kayo. Or may nagtext sa inyo or any harrassment call. Alam niyo ang solusyon dyan? Mag-complaint sa Banko or diretso sa Banko Sentral ng Pilipinas. Takutin niyo din. Why? Kasi takot din ang mga agent na magcomplaint kayong mga cardholder sa BSP at lalo na kapag VALID angcomplaint niyo. Why again? Dahil may Penalty na babayaran :) lols

    5. Blacklist ba kayo sa CMAP/BAP if may deliquent account. YES! Pero maa-update po yan and may naka-status na fully paid. Quarterly nag-aupdate ng mga list. Makukulong ka ba? NOPE! Di ka makukulong. May mga small cases lng na mangyayari. Pero why paabutinn mo ba dun if willing ka naman at ayaw mo lumala pa ang problem mo, right?

    -Anyways...eto lang siguro maadvice ko for now..as long as hindi kayo takot and your willing to settle your account and your obligation. For sure makakatulog na kayo ng mahimbing. Why Im telling you this? Para lang po na may idea rin kayo. Yes AGENT ako, pero iba ako sa kanila.. I promise to you that. And lastly, be strong kung may maghaharrass sa inyo. As long as calm ka lang makipag-usap walang mangyayaring harrassment and ofcourse! Kapag nangyari yun? Complaint mo agad! At for now all AGENCIES are required na RECORDED YUNG CONVERSATION NIYO. If it is not recorded. May laban kayo. Bawal na din gumamit ng text at kung may nareceive kayong text para takutin kayo? Oh well, I advice you na complaint niyo na agad :)

  55. Good pm nakatanggap po ako ng 3 demand letters from different collection agencies last year. Paiba iba po sila ng amount na dapat ko isettle. Ang pinakamalaki po ay umabot ng 80k. Pano ko po ba malalaman if kaynino collection agency ako dapat magbayad at magtuwala sa sa 3. Gusto ko na po isettle account ko. At very willing po ako bayaran dahil mejo nakaluwag na po ako ng konti. Kaya lang kahapon po may tumawag daw sa station ng police dito samin claiming hepe sya ng taguig at may reklamo na daw po ako don about may cc debt.nagkataon naman po na nandun sa station yung kapt. Ko na cousin kaya nalaman ko. Nagbigay pa nga po daw ng cp number ung "hepe" ng taguig police at tawagan ko daw po yung cp number para maliwanagan ako. Tanong ko lang bakit cp number ang binigay? I was wondering if strategy ito ng collection agent. Anyway, yung story po ng Cc ko is never ko inapply kusa lang po sya dumating sakin. I was paying it b4 kaya lang po nastop nung umabroad ako at nawalan ng work.pwede po ba kasuhan ng estafa? Wala naman kasi ako pinekeng info kasi kusang dumating sakin ung card ng di naman ako nag aapply. Kung makasuhan po b ako at dumating na sopheana ano po dapat ko gawin after. Ayoko po humantong na makasuhan ako. Sa halagang 20k na credit limit na lumubo sa 80k makakasuhan po ako.. im having hard time po talaga trusting collection agencies kasi baka po masapak ko lang madali po kasi uminit ulo ko and i really have a serious problem regarding anger management. Gusto ko lang po matapos na to.

      Go to your credit card issuer (bank) and tell them you are now ready to settle. Ask them if they have any info or advice regarding the collection agency that is contacting you.
      Better yet, ask your bank if you could still make your payments thru the bank under your old credit card account. Then ask them for a certificate that you are fully paid if you want.
      If the bank says they know nothing about the collection agency or if they say they can't issue you a certificate for payments made thru that collection agency, well there's your answer.
      You should not be paying the entire 80k. You could settle up to the amount of your credit limit.
      Debt is not a police matter, unless you punch the collector in the face.

      Thank u very much for enlightening my mind. .. natatakot lang kasi ako na bigla may dumating dito sa bahay or sa barangay at iclaim na may kaso ako.. pwede ba mangyari po yun na kasuhan nila ako without me knowing it? Yung tipong bigla nlng bubulaga sayo. Nakakapraning lang kasi yung tumawag na hepe kuno ng taguig. Bakit sa police station pa samin tumawag?..is it possible po ba na nireklamo nila talaga ko dun or could it be one of their tactics? Anyway, ilang days nalang nman po ang hinihintay ko at mababayaran ko na . Ang credit limit ko po ay 20k lng..ibig sabihin po ba pwedeng kahit yung 20k lng ang bayaran ko ppyag na po sila? Pasensya na po dami ko tanong. Sa ngayon po ang totoo wala ako work. Single mom. Pero willing ko ibayad yung ntitira ko pang pera..pero wag naman sana yung ganon na tatawag pa sila sa lugar na dyosmio! Wala naman kinalaman sa whereabouts ko.       2. It's a tactic. To scare and embarrass you.
      3. It would be wiser to wait for payment terms that says you would only have to pay 20k or less. Set your money aside in the meantime.

Tinawagan ko po ung number ni fiscal manabt pero d po ako nagpakilala kasi po sa dami ng nababasa ko regarding sa tactic ng mga collection agency nagask po ako kung kanino number ito and saan po ung exact address ng office nila. Hindi po nagpakilala ung sumagot ng phone at ayaw niya din po magbigay ng address.Pinipilit niya po ako sabihin din kung sino ako sinabi ko na lng po may friend po kasi ako na nagpapaverify kung kaninong number ito ayaw niya po sagutin ung tanong ko ko in short po naghang up cia tapos tinawagan ko po cia ulit d niya na po sinagot. May utang po kasi ako 7 years ago sa chinatrust na hindi ko po natapos bayaran. Ano po ung next na gagawin ko if pumunta ulit sa bahay ung mga pulis. Sana po matulungan nio ako.

      Just tell your mom not to worry. She doesn't need to do anything but tell them she already told you their message. Sending cops as messengers is one of their tactics.
      Yes, it's better to contact your bank directly and let them guide you on how you can settle your account if you can afford to pay.
      It's also better not to deal with collection agencies that use dirty tactics.

      Thanks so much po sa repky malaking tulong na po ito.Ngaun oo kakatangap ko lng ng txt ang sabi po sa txt stating that na this isnfrom fiscal manabt of taguig city prosecutors office informing me po na may court summon and subpoena will be serve with in 24 hrs regarding violation of bp22 anti bouncing check law and article 315 of the revised penal which is due for court warrant to be assisted by city police. Ask ko lng po if totoo po ba ito need ko na po ba magprepare ng lawyer?if wala pa po me pera to settle the loan can I request for a staggered payment directly to the bank?Need your advice po.

      If it's true, then what are they trying to do, help you escape by tipping you off that the police are coming in the next 10 hours? Or are they boasting they can hold off a court summons in the wee hours of the morning just because you called back.
      You can try but banks seldom respond to staggered payments.
      Just wait for payment terms you can afford.

Hi Sir Ag good pm po, same po sa mga problems nila may nagtxt po sa akin kanina na may mag punta daw sa amin bukas excatly 12 noon with sheriff for the warrant of arrest and to check our property po.. kinakabahan po ako masyaho baka ,akulong po ako. totoo kaya na may may warrant of arrest ako? bukas ng 12 noon po daw sila magpunta sa bahay namin.   58. Hello sir AG ask ko lang po if pwede pa kaya matrace ng bank kung sino gumamit ng cc ko 3 yrs. Ago? Wala po kasi ako talaga nareciv na CC then pagbalik ko from abroad may utang na ko! Pano ko magagamit un nasa abroad nga ako. At hindi ko man lang nahawakan. Di po ba sa pinas bago ka makagamit ng CC hinihingan ng ID at binibigyan ng copy ng resibo ung bank? Possible po kaya na makakuha ako ng copy nun sa bank? Hindi ko po kasi sure kung pati copy ng id ng gumamit ng Cc ay binibigay din ng eatablishment sa bank.. sabi ng iba ko frend hayaan ko na lang at mabubura din yun after 6 yrs. Iniisip ko po pagbalik ko italy baka magkaproblema ako.card holder din ako dun. Ayoko naman po pagdusahan bayaran yung hindi ko naman ginastos! Dagdag pa yung makukulit na CA na kahit anong explain ko ayaw naman maniwala na hindi ko nagamit yun.porke alam na galing ibang bansa panay ang harassment.tas timing na timing pa 1week after ako dumating biglang may naningil na dito.mahirap magiskoba ng kasilyas sa ibang bansa tapos pagdating ko ganito pa mangyayari.       The bank would have the best answer to your questions. I'm sure they can guide you better. Don't be afraid to approach them if you really want to get to the bottom of this. You can look at it this way too - you'll be helping them improve their verification process and avoid losing money over fraudulent transactions.
      You want the CA to believe you, but the truth is, whatever you say, they don't really care about that. Because, #1. they really can't do anything about your problem and of course #2, they just want to collect. And they will stress you out till you raise the white flag and shell-out the liras.

      If it really goes down to garnishment of properties, it is usually things you own of value which are first levied. Only if these are not sufficient will real properties you own become subject. But usually your 'family home' or primary residence is exempt from execution as provided for in the Family Code.

    4. So I am looking at our 2nd lot (a vacant lot) then that is the one in danger which is in my husband's name. I guess we need to donate that one now to our children. Do you think that is the right option? I don't care if they take all of my old furniture in the house. I have no way to pay all of my debts at this moment.       You could also be over thinking this.
      Also the interest and charges is something definitely contestable. It does not mean you have to pay for every cent they say you owe.
      If you have time, you may want to read this credit card collection case.
      It would be very similar to your case I presume.

      To sum it up, the interests and charges were reduced to 1% per month (12% per year) and debt was reduced to actual principal and award of attorney's fees to plaintiff was removed.

    i have the same situation sa lahat ng nagpopost dito, i have 7 credit cards sa pinas 2 years ago at bago ko umalis ok naman ang credit standing ko kahit pamini-minimum lang nababayaran ko sa ibang cards ko at wala pang naninigil sa kin that time, until i decided to work abroad at ang ending lahat ng yun napabayaan na. At sa 7 credit card na yun, bukod tanging HSBC lang ang masugid kong manliligaw at sa gulat ko tinatawagan ako dito sa work ko sa dubai. buti na lang ako ang tagasagot ng phone. Binigyan ako ng amnesty program na from 138K eh 25K na lang daw babayaran ko, our conversation happens last month, until yesterday tumawag ulit sila dahil last day na raw nilang hahawakan yung account ko at ipoporward na nila for litigation or if i want daw pwede akong magbayad ng 2500 today para lang maretain sa kanila yung account ko, sabi ko, yung 2500 na ibabayad ko para sayu lang yan, still hindi niyo naman ibabawas yan sa 25K na pinapabayaran niyo sakin sabi ko, then sabi niya in that case ifoforward na nga lang daw nila for litigation, sabi ko go ahead, sue me, atleast its fair and legal. then nagalit siya, sinabihan ako na be ready daw sa mga consequences at sana raw makatulog ako sa gabi sabay baba ng phone. Eh sir AG, afford ko namang bayaran sana yung 25K lalo split payment ay pwede raw, kaso my mga nabasa akong ibang blogs na upon full payment wala silang nakuhang clearance until now at masama pa nito meron na naman ibang collecting agencies ang nanggugulo sa kanila regarding same account. kaya nag-hesitate na rin akong magbayad, on the second thought hindi naman biro yung 25k na ibabayad sa kanila kung pinadala ko yun sa family ko mas napakinabangan pa nila.. tama po ba ginawa ko? please advise naman po. medyo kinakabahan rin ako sa next step na gagawin nila at kailangan ko talaga maging ready, lalo't walang alam ang family ko sa pinas regarding my situation..       Until you can personally verify with HSBC and get assurance that your payments will be honored should you shell out your cash. In the meantime save up for your payment so you're ready.

      Have not heard of it. And besides, what if you are to use your SSS salary loan to pay off your debt, how would you pay them if they tell SSS to hold disbursement of benefits? Or if they tell PhilHealth not to pay your hospital bills, you'll certainly use your money to pay the hospital first instead of your credit card debt right?
      If you heard that from the collection agency, next time tell them they don't make sense.

  69. hello po, i just saw your blog about the worries of cc debts. I too am in the same dilemma. I have unpaid cc debts since 2005 and have moved to another country. But each time i want to visit my family back home, i always have this fear of getting arrested or not be able to go out of the country again. I have not followed up anymore the status of my cc debts whether i already have a pending case or subpoena or a court decision. I have not received anything or probably they sent the notices to the address of the apartment i was renting before or to my previous employer. But nothing had been forwarded to me.

    Do you think that i have a court decision by now after 10yrs of default? Is it possible that i could get arrested or will not be allowed to leave the country anymore? I was able to acquire a foreign citizenship and is using a foreign passport but my name stays the same. Will it be possble that collecting agencies continue to harass even after 10yrs of outstanding bills?

    I am thinking of contacting the banks but i still dont have the guts because of fear. I got traumatized with all the harassments i experienced before. One day i will pay for my debts but im still saving for it.

    Please enlighten me about all my queries. Im deep worried now as u would like to visit my family soon.

      Your worries are about the consequences of a criminal offence in nature. Having credit card debt is not a crime (unless you used a stolen credit card or used a fake name).

    I am just the same as they are as i read the blog. I know i Have CC na napabayaan ko na way back 2010.
    I received text message from my auntie at galing po daw ito sa brgy captain namin.. stating my name and address and the violation of Deceit and Republic Act 8484 sum of money. Minsan na lang po kasi umuuwi sa home address ko. Ngworry na po sila kasi there's SPO3 Concepcion from Camp Crame-CIDG yong tumawag sa kapitan namin and telling they will sheriff my property. Unfortunately, wla nman po akong property. I didn't receive any kind of letter pro ang dami nila sinasabi which maybe ikasira nang name ko. Kaya ang ginawa ko i check my emails and i found out that there's one email offering settlement last march 20, 2015 kaya i call the number na nakalagay sa letter. I ask an amnesty or bagong settlement, di po nila maibigay dahil naiakyat na po daw sa legal dept. They want me to pay the full amount at sabi ko hindi ko po kayang bayaran kaya sana bigyan pa nila ako ng options. From 175K, they offer 70k. which i can pay til may 28. 40k for April and the remaining 30k before may28. but person I talk called me after a minute and telling me that i have to pay 10k that day to prove my willingess to pay dahil yon daw ang sabi nang atty. at hindi na may 28 kundi i have to pay the remaining 60k before april 28. Ang sabi ko I can't produce that big amount. Im willing to pay but hindi pa sa ngayon. Hours passed meron tumawag uli ang telling me that i can pay the partial 10k til monday at binabaan na po ang amount to 60k..so 50k na lang daw hahabulin ko til april 28. Ang gulo po nila eh hindi nman umabot sa ganyang amount ang utang ko nong 2010. Sinisi pa nila ako bakit ko daw pinabayaan na lumubo ang utang ko sa CC. Kaya sabi ko wala kasi akong pambayad, hirap kasi nang buhay. Kaya tanong ko lang sana what should i do eh wla pa akong pera sa ngayon?

  73. I received a letter from CJM Strategic Management Solutions and they are demanding me to pay 24k within 20 May 2015. Nakaindicate na final demand na daw yun kaya magbayad na daw ako otherwise mapipilitan silang mgsampa ng kaso saken.. Hindi ko na po kasi nbayaran yung HSBC credit card ko dhil nwalan ako ng trabaho nun hanggang sa lumaki na utang ko. Ngayon may work na ako hindi ko naman kyang mgproduce ng ganun halaga on that certain period. Pag hindi buo yung bayad, back to 70 k ulit yung utang ko payable for 3 months. May nakulong na ba dhil hindi nkapagbayad ng credit card? At sino po dito yung nkakatanggap din ng letter from CJM Management? Ano po yung ginawa nyo? Please help me..

  75. Sir, gud day po.. may i ask po, if i have multiple ccards na nadelinquent ko. Estimately it would amount to 400k. Possible po ba na may criminal offense ako. And also po kasi di ko sinasagot mga calls nila.. and yung messenger na pumupunta, pinagsabihan ko family members ko na im no longer living here and di nila accept yung letter.. would it be grounds po for them to file a case? What if ako mismo naabutan ng agent. Can i pretend na im not that person coz u know he might embarass me or something if they learned it was me. Please help. Thanks a lot. At this moment nasa financial crisis talaga ako and i sent them emails regarding this.     1. Hi, I received a letter from CJM last October. Full payment for me is 14k. I called them and nung una syempre natatakot ako, but they've been very kind. They helped me on how to process the payment and I chose to pay directly sa HSBC. The girl from HSBC office was very kind as well. Gave me a proof of payment and receipt right after.

Nagkaroon din ako ng doubt, so they give me the HSBC hotline number and ask if legit sila. And yes! Legit sila at ang babait pa. And they told me para makuha ko agad ang Certificate ko, direct akong magbabayad sa HSBC BGC. And now, I have my Certificate na. :)

Good day po..ask ko lang po about ps bank flexible loan po kasi ako yr 2014 ..35k yung naapproved na loan..kylangan ko po talaga in..Pambayad sa bahay nman na nasanla..1yr lang po ako nagbyad consistent..dhil nwlan ako ngwork Hindi na ako nkabayad..naexperience ko na po ang demand calls,letter at visit sa office at bahay..ngaun po,may pumunta dlawang lalake sa barangay nman..kinausap ung kapitan at humihingi ng tulong na sumama papunta sa Amin pra isheriff ung bhay at mga gamit..taming ko lang po..pwde ba nlang gwin in at totoo po ba yon? Hindi na kaau ako nkatira sa Amin..ung mama ko lang ang tumawag sa akin..talagang nkakahiya at nag aalala pamilya ko na Baka isang araw wla na silang mauwian..

    I have metrobank and citibank card.I am a good payer until last year but because of financial problem and my friends who ask me favor to swipe for them cannot be found.I am not able to pay even the minimum amount.The balance now is 373,000php.

    Question
    1. Received letter of recommendation of civil case, what should be the next step of that on their end.What to do?How would I check if the filed case is valid if ever?
    2. My friend abroad got a condo, however her papers are not valid in buying, so I and my husband is co borrower...can they freeze the PDC I gave to the developer?What should be the result if they freeze the checking account under my name but the money is from my friend abroad?
    3. If the sheriff will go to our house to collect what would be the right thing to do.Can I call a lawyer as well...or should the bank will notify me before the sheriff will come?

    As of now, i do not have money to pay (not all are my purchase- most are my friends purchase).

      1. Letter of recommendation - it's a means to get your attention. They want to talk. How to check if a filed case is valid? If they filed a case, you will receive a court summons.

      2. Can they freeze the PDCs you issued or the checking account? No.

      3. The sheriff will not go to your house unless that is the court's judgement from the civil case filed.

    1. Hi,

      Check the terms and conditions of your credit card.
      BDO cards has something like this:
      ... ISSUER may, and is hereby authorized by the CARDHOLDER to set off as full or partial payment, and/or withhold, to the extent permitted by law, at ISSUER’s option and without need of prior notice, all monies, funds, and/or proceeds of securities, investments or receivables which may come into the possession or control of the ISSUER and/or its Related Companies...

      So if you have a BDO card and you have funds at BDO, you gave them the right to - deduct as payment from whatever you have that they have control of, and that without prior notice to you.
      Is it legal? Yes. You agreed to it when you signed or used the card.
      If you don't have assets with the card issuer then a court order is needed. They need to file a civil case - which you'll know about - and they need to get a judgement favorable to their request first.

  89. hello po, i have upaid cc with HSBC. the original amount that i owed them is only 18k but due to unfortunate events i failed to pay my dues. i am jobless for 6 months and today 3 guys went to our house saying to my mother that i need to pay them 28k this friday which for me is really impossible and my mom tell them. she got a response from them that will go to our brgy and city hall to file a complaint and locked our house if i fail to pay them this friday. knowing my mom mi know that she is afraid that i might go to jail she gave her number because the 3 men will not leave the front of our house unless she'll gave her number and answer if i can pay them. i really need your advise on how should i face this.

Hi po, same scenario, nasa ibang bansan na po ako now mag 6months na po ako hindi nkakabayad sa bank ko sabi po sa dti kong work nasa burue if immigration na daw ang kaso ko at ipapadeport daw po nila ako pag ndi ko naasikaso ung cc ko. Actually po kaya ako nagibang bansa para po makabayad kahit paano. 70k po ang swipe ko pero umabot na po ng 114k ang dapat ko bayaran ngaun po may letter na pong dumting sa ate na na need ko na byaran po. Please help po, mapapadeport po ba nila ako??? Salamat po

  92. Hi po. Just call me Aquamax. CC holder po ako ng 2 banks.nagka-covid po ako last july 2020 at sa kasamaang palad nawalan ako ng trabaho dahil ayaw na po ako pabalikin ng employer ko at bka makahawa daw ako sa iba kahit may health cert na ako from health center. May unang collecting agency na nag-email sa akin pero I ignore them at nagpalit na rin ako ng contact number kaya hindi na nila ako matawagan.inilipat nila sa isang collecting agency ay same nag email.hindi ko na rin naiwasan na tanggapin ang letter nila.

    Nung panahon na may work ako hindi ako pumapalya sa pagbayad kahit minimum lang.

    Question lang po: 1. Dapat ko ba sagutin ang email ng 2nd collecting agency.pero yung unang collecting agency hindi ko naman sinagot email nila. 2.nakikipag coordinate ako sa bank pero pinagtutulakan nila ako sa CA nila.asking sana ako ng consideration na bigyan pa ng panahon magbayad hanggang sa makahanap ng trabaho. 3. Kung tumawag ang CA dpat ko ba sagutin din. 4. Need ko na ba mag email sa BSP to ask assistance dahil sa hindi ako mabigyan ng consideration ng bank ko.

      2. If the bank says so, then no need to force the issue.
      3. Sure. Just tell them you'll pay when you have money.
      4. If CA becomes abusive (threats, intimidation, public shaming) then you should.

      No need to issue PDCs, or sign promissory notes with terms you can't keep. Just say no.

Ask q lang po..kc po nakarecieved po aq ng letter saying Last Letter Demand ..nakapaloob po dto na kelangan q magbayad ng 169k+ in just 5days...Dati po kc aq OFW..before nakakabayad aq ng monthly due's kahit pa minimum minimum lang ...but mag 4 yrs na po aq dto sa pinas no job..just a plain housewife inaasahan q lang yung work ng husband q na sakto lang sa pangangailangan nmin...gusto q i settle yan but not this time...i planning to apply abroad again after this pandemic...makakakuha pa ba aq ng NBI as this is a requirements to get a new pasport...And last nila na pangungulit to pay this was last 3-4yrs ago...ngayon lang ulit aq nakatanggap ng letter...
